
Government has categorically stated that the Draft Republican Constitution currently under debate will be adopted through a referendum.
Justice Minister Wynter Kabimba said in Lusaka yesterday that the Patriotic Front (PF) constitution was clear that the republican constitution should be adopted through a referendum.
Mr Kabimba said the form the referendum would take was, however, dependant on the structure of the draft report adding that Government was yet to constitute a Referendum Commission as doing so now would be too costly.
He said Government would, however, not accept infusion of external ideas into the process and this would be met with the outmost resistance.
He dismissed assertions that the constitution process lacked a legal guiding framework saying the process had so far not been prejudiced by Government influence.
“The constitution process has not been prejudiced by lack of legislation to it, there has not been any government white paper to say what Government wants but the only caveat is that it should be devoid of external influences,” Mr Kabimba said.
He was speaking when he officiated at the launch of a study on political governance in Zambia.
And Government will soon dispatch a team of officials to the United States of America (USA) for a familiarisation study on operations of District Attorneys, Mr Kabimba has said.
President Michael Sata recently said Government would establish District Attorneys in Zambia to accelerate delivery of justice especially in remote areas.
Mr Kabimba said Mr Sata was determined to ensure the District Attorneys were established and that his ministry was also working diligently to materialise the Head of State’s agenda.
He was speaking in Lusaka yesterday when visiting USA counselor Jeffrey Minear to that nation’s Chief Justice John Roberts paid a courtesy call on him.
“We are hoping that we fast-truck judiciary reforms. We want to have a justice system that will deliver judgment fast. Soon, our officers will also be going to USA to learn more about District Attorneys,” he said.
And Mr Minear commended Zambians for their continued efforts to formulate the new constitution and was confident the document would be realised.
He called for continuous exchange of expertise citing the case where some officers from Zambia would travel to USA on a study tour of operations of the District Attorneys.

The referendum is the only sure way of guaranteeing a people’s constitution that will stand the test of time.
What constitution in the world is not,in one way or the other,a product of some external influences Mr Kabimba? All countries always borrow ideas from afar.

Give us dual citizenship and don’t be fools all your lives. Always think out of the square and widen the catch. We have children who should be embraced as Zambians by virtue of being born from either one or both Zambian parents living in the diaspora. We have educated these children with our own hard earned money and now they are ready to lead. Why can’t common sense be so common? Big nations like The US, Britain , yes you guessed right i dropped the Great in Britain but still a force to reckon with, have dual if not multi citizenship but just to mention a few. My daughter is at Oxford whilst my son is at Cambridge. They are more than happy to come and run my estate in Zambia but under what flagship? Foreigners? Give me a break!

Funny that you send people to be trained overseas and then bluntly say that you don’t want ‘infusion of external ideas’ in the draft constitution. Get real, train them at home and infuse them with your one directional ideas and the sooner we return to a one party state and state of emergency the better and quicker your transition of this weak country from hope to heap of ruins will be.

I have noticed something very worrying and I always want to be analytical. I am sure I did not discover the Vic Falls and neither am I first to observe the following:- simple rants including words in English like F00l, 5tup1d,1d10t5 are censored but people can insult in vernacular all they like!
Having read the first three paragraphs of this article twice, I get the impression that the headline is quite misleading. This is a huge difference between the ‘will’ in the opening paragraph and the ‘should’ in the second paragraph. What Mr Kabimba cleverly said is Government may use a referedum to adopt the darft constitution. Implying that don’t get overly excited or depressed just yet.

why send people to USA let some retired/active DA’s from USA come and train Zambian here. Am sure the US govt will gladly assist.
Winter Kamimbya has always emphasised that as Zambia, we do not need others to bring their ideas here. Now I am wondering why some people are earmarked to go at train as District Attorneys in the US. Kamimbya, please shed off your cheap ego and get real. We are not an island; we belong to the world. There is nothing wrong in getting ideas from elsewhere as long as they are good and progressive. Kamimbya talks like an empty tin because of his small ego.

With all the briliant lawyers we have in Zambia, why have we consistently failed to deliver a simple constitution which can stand the test of time??
Even the “lawyer wama lawyer” Mwanawasa failed because he wanted to personalise it instead of being a national instrument for all the people of \Zambia. He got the best people with integrity but he ended up critisising them for, ostensibly, lack of foresight. The truth lay on the fact that they did not please him as “lawyer wama lawyer”.
Our current President is rushing people to the USA for consultation on District Attoneys. Where are we going when he cannot even accept simple items like Dual citizenship available elsewhere on the African continent & world????
