Chikopa tribunal requests citizens wishing to testify to register

THE tribunal appointed to inquire into the alleged professional misconduct of three judges has asked citizens who want to testify and make submissions before the inquiry to register.

The tribunal, which was appointed by President Sata on April 30, 2012, will be investigating alleged professional misconduct of Supreme Court judge Phillip Musonda and two High Court justices Nigel Mutuna and Charles Kajimanga.

Tribunal secretary Chipili Magayane said in a statement issued in Lusaka yesterday that the tribunal has completed its formulation of inquiry and citizens who want to testify are free to register.

Mrs Magayane said dates and times when the tribunal will start its sittings will be communicated in due course.
“The tribunal has since completed formulating its method of inquiry and is now ready to commence proceedings to be held at New Government Complex.

“The tribunal, therefore, wishes to urge all persons interested in and are intending to testify and or make submissions before the tribunal, whether orally or in writing, to register with the tribunal’s secretariat,” Mrs Magayane said.

She said citizens should provide the tribunal with their full names, particulars of appropriate identification documents, physical address, contact number and an indication of what, within the tribunal’s terms of reference, is of their interest in the matter before the tribunal.

Mrs Magayane said the terms of reference in relation to the three judges will inquire into how they presided over the hearing and determination of the case of Development Bank of Zambia (DBZ) versus Post Newspapers Limited, JCN Holdings Limited and Mutembo Nchito.

She said in respect to justice Musonda and Kajimanga, the tribunal will inquire into how they allegedly interfered in and illegally retrieved or caused the retrieval of the case involving DBZ versus the Post Newspapers Limited, JCN Holdings Limited and Mutembo Nchito.

Mrs Magayane said the tribunal will further inquire into how justices Musonda and Kajimanga interfered in and illegally retrieved or caused the retrieval of the case involving Finsbury Investments Limited versus Antonio Ventriglia and Manuela Sebastiani Ventriglia.

The three judges are alleged to have interfered in, illegally retrieved or caused to have retrieved and presided over the matter from High Court judge Albert Wood.

Last week, the Supreme Court overturned High Court judge Fulgence Chisanga’s decision which stopped President Sata’s action to suspend and appoint a tribunal to investigate the three judges.

  1. WELL SPOKEN. WE WISH THIS MATTER WILL BE TREATED WITH THE FAIRNESS IT DESERVES. ALL OF US WHO THINK WE HAVE ANY EVIDENCE ARE FREE TO MAKE SUBMISSIONS. I THINK IT WILL BE FAIR IF THE TRIBUNAL WILL STICK TO THIS ROAD-MAP DRAWN HERE. WE ALSO HOPE THAT THE PROCEEDINGS WILL BE REPORTED VARBATIM IN THE MEDIA SO THAT WE CAN BE AVAILED THE OPPORTUNITY TO NOT ONLY HEAR BUT SEE FOR OURSELVES THAT JUSTICE IS BEING DONE. THERE ARE A LOT OF ROMOURS CIRCULATING AROUND ABOUT THE FAIRNESS OF THIS TRIBUNAL BY A FEW BUT VERY VOCAL PERSONS WHO LIKE TO EXPRESS THEMSELVES IN SCREAMING HEADLINES, SOMETIMES WITH INSULTS UNFORTUNATELY. THEIR FEARS WHETHER FOUNDED OR UNFOUNDED MUST BE ALLAYED. THE TRUTH ALWAYS TRIAMPHS. GOD BLESS ZAMBIA.

  4. This is a stinking exercise in futility that is being pushed by people with a hidden agenda. But everyone involved in this must know that whatever has been spent on Judge Chikopa and the 14bn owed to DBZ will be demanded back in full by Zambians at an appropriate time. Chikopa must know that we shall follow him wherever he will be after 2016.

    • Why not ask the really important question here my brother/sister. I remember it being stated that wood was an interested party in more than one of the many cases, do you expect level headed justice there?
      These enemies of RB you talk about, are they not enemies of the state in their contribution to the destruction of our economy and morals not to mention funds? These judges might have a case to answer but is it logical or even moral to bring some foreigner to conduct an obviously preconceived outcome…I find that bothersome, especially that people like you enjoy your own ignorance.

  10. This hired gun of a judge will be taken to the hague after the departure of the Bufi man frm the presidency. He is presiding over a tribunal that was created to protect friends of the president that flaudlently acquired a loan that they knew they wil not pay back.
    Be assured that these guys wil come to pay back even after 20yrs with huge interest.

    • Who told you the friends of the president deserve injustice from the corrupt judges? Wait for the truth. Mutuna’s judgement was a farce. If a limited liability company defaults on a loan, the bank can only seize the assets of the company, not assets of the shareholders. Just google the meaning of LIMITED LIABILITY COMPANY

  11. @ Munthu. YOU SEEM TO KNOW MORE ABOUT THIS CASE. THE TRIBUNAL HAS SAID MEMBERS OF THE PUBLIC ARE FREE TO MAKE SUBMISSIONS TO THE TRIBUNAL. AM SURE WITH THE EVIDENCE THAT YOU SEEM TO HAVE THE TRIBUNAL WILL BE MORE THAN WILLING TO HEAR YOU. WE WANT TO HEAR YOUR EVIDENCE ON HOW THE PRESIDENT WANTS TO PROTECT HIS FRIENDS. WE WOULD LIKE TO KNOW IF YOU ARE A CREDIBLE OR A FALSE WITNESS. OR A VENGEFUL SPECTATOR.

    • Look here, Chisenga, there is no need to start lecturing everybody here as though you possess all the knowledge. You should understand one thing that individuals are free to hold whatever opinion they might have over this issue. Why do you seem to take offense over that? Yes, you may have confidence in the Judge Chikopa tribunal but you should realise that it is not everybody who feels so. Please do not force people to give evidence to a tribunal which they consider to be filthy and stinking.

    I foresee a situation in which the tribunal would find the Three Judges to be found wanting and a case to answer.
    The terms of reference are so narrow and perfectly poised for a short tribunal.
    It’s in public domain that Judge Wood,was the rightful adjudicator on this case and if no proper procedure was followed in allocating the said case to the two judges, then they would be found wanting and the Judge responsible for allocating cases.
    @Muntu, A limited company can only have its directors pursued for loans if they personally guaranteed the same or knowingly acted in a manner that put shareholders wealth at risk. A very difficult case to prove on its own. The airline industry suffered greatly and because they operate in diminshing goods.

How can a judge (Woods) who is a friend of the accused give a fair ruling in this case, why were the accused run to the president if they were not happy with the ruling of justice Mutuna appeal to the Supreme Court like everybody does, are these people the so called cartel more special than any other Zambians. The money that is involved in constituting a tribunal and to pay everyone involved is all tax payers money just because of Membe, Nchito, this is not being done in nation interest. These people are settling scoles using tax payers money.

  16. BUT HOW CAN JUDGE MUTUNA THE ENEMY OF THE ACCUSED GIVE A FAIR HEARING? YES. THE MONEY INVOLVED HERE IS A LOT. AND DBZ HAS THE RIGHT TO ASK FOR THE MONEY TO BE SETTLED. BUT WHO WILL SETTLE THIS DEBT? AND HOW YOU ARRIVE AT THE CONCLUSION MATTERS. IT IS NOT JUST A MATTER OF HOUNDING OUT JUDGE WOODS AND CONCOCTING AN RB-JNDUCED JUDGEMENT HASTILY. THESE ARE THE ISSUES THAT WE WANT THE TRIBUNAL TO DIG INTO.

  17. CHIKOPA should be jailed before he goes back to Malawi. He is a thug like PF criminals. I just hope he will be in Zambia when Zambia experience a winter revolution when Sata and his thugs will run to nowhere.

    This Chikopa should feel ashamed of himself honestly.
