Acting Chief Justice Lombe Chibesakunda has accepted the resignation of Judge Philip Musonda raising questions whether the Judge is entitled to his life terminal benefits following his resignation.

Judge Musonda is among three judges being probed for alleged professional misconduct.

It is not clear whether or not the Tribunal would go ahead and hear the allegations against Dr Musonda despite his resignation.Unconfirmed reports indicate that President Michael Sata has also acknowledged Judge Musonda’s resignation.

Under the constitution, retired judges are entitled to 80 per cent terminal benefits of the incumbent Judges for life but does not provide for judges who resign their positions.

Attorney General Mumba Malila when asked on the way forward in view of the acting Chief Justice’s acceptance of the resignation referred all queries to the Tribunal secretary Chipili Magayane who refused to comment.

According to a letter to Dr Musonda dated June 19, 2013, Ms Justice Chibesakunda said she acknowledged receipt of letter dated June 18, 2013 concerning Judge Musonda’s resignation from office of judge of the Supreme Court.

She said the bench would ‘deeply’ miss Dr Musonda’s well-researched contribution and support.

“On behalf of the entire judiciary and on my own behalf, I wish you God’s blessings in your future endeavours,” Ms Justice Chibesakunda said.
Judge Musonda had written to President Sata and the acting Chief Justice informing them about his resignation as Supreme Court judge.

He later said his resignation had completely curtailed the Tribunal’s authority to proceed hearing his alleged professional misconduct.

But Tribunal chairperson, who is Malawian High Court Judge Lovemore Chikopa, set June 28, 2013 as the date for the official commencement of the hearing against Judge Musonda.

Mr Sata in May last year suspended Judge Musonda and two High Court judges Nigel Mutuna and Charles Kajimanga and set up a Tribunal to probe their alleged professional misconduct.
Judges Mutuna and Kajimanga have, in their latest legal battle, been granted leave to commence judicial review challenging the legality of the Tribunal.

      Reports from Malabi (Malawi) is that achimwene a Judge Chikopa is looking for a huge mansion to buy in Blantyre or Lilongwe from a pay cheque from Zambia….. the Money he has earned so far for doing Nothing!!!

  1. Sata on the push of his sponsors and captives Mmembe and Mtembo Nchito rejoices when he sees the people he perceived as enemies put under the radar and under pressure.

  2. Good decision by the authorities. The Chikopa led tribunal is illegal according to the learned judges including himself. He’s mentioned his current family circumstances(his wife’s illness etc) so it’s good they’ve let him retire and let’s remember he said he’s still liable to prosecution as an ordinary citizen if any investigations prove that he did something wrong.

  5. Judge Chikopa has at least 2 years and 6 months to plunder our tax payers’ money with the blessing of BaSata’s current tenure of office. The resignation of Suprem Court Judge Musonda has dented Chikopa’s image as a credible lawyer. So far now we know that the Law Association of Malawi is a sham in this part of the world. After 2016 Chikopa will be a PROHIBITED person in this country.
