Kampasa residents challenge eviction in Court

Evicted Kampasa residents have sued Galaunia Farms Limited, the Attorney General and Chongwe district council as first, second and third defendants respectively in the High Court seeking repossession of farm 33a which forms part of Kampasa Settlement.

In a statement of claim filed in the High Court Registry by their lawyers Mushipe and Associates, obtained by QFM News, the 1,223 plaintiffs want a declaration that they are sitting and were sitting tenants with the 1st option to purchase had the land been offered.

They also want an order that the allocation of land by the second defendant’s agents or servants to the 1st defendant is illegal, fraudulent and null and void.

The Kampasa resident further want an order that being indigenous Zambians are entitled to occupy the said land, and had acquired rights by prescription to the land having settled in Kampasa settlement for a period of over 35 years.

They are further seeking damages for wrongful and unlawful eviction, damages for loss of properties demolished and other property lost resulting from the wrongful and unlawful eviction.

They are also seeking damages for inhuman and degrading treatment.

The 1,223 residents are also seeking an interlocutory injunction restraining the 1st and 3rd defendants or their servants or agents from interfering, intervening,demarcating,developing,evicting,displacing,fencing off the land or taking possession of Farm No.33a or in any way dealing with the property until the determination of the matter.

    Those of you who still think education is expensive, learn from these unschooled squatters the price of ignorance.
