Government asked to release the contract of Acting Chief Justice to the public for legal scrutiny

UPND Senanga Member of Parliament, Likando Mufalali, has urged government to produce the contract of Acting Chief Justice Lombe Chibesakunda to the members of the public to review its legality.

Mr. Mufalali said that parliamentarians rejected her as a Chief Justice and there is no need for her to continue occupying that office when there are individuals who qualify to be chief justice.

Mr. Mufalali said that Justice Chibesakunda is a retired person and she is getting double salaries.

He charged that Ms Chibesakunda is illegally occupying that position and thus the need for her to peacefully step down.

On Friday, Vice President Guy Scott has affirmed that acting Chief Justice, Lombe Chibesakunda will continue in her position.

During the Vice President question time, Dr Scott said Justice Chibesakunda was currently on contract and that the status-quo will remain.

Dr Scott was responding to a question by United Party for National Development (UPND) Member of Parliament (MP), Derrick Livune, who queried the continued stay of Judge Chibesakunda as the Chief Justice when the House had rejected her appointment.

“She (Judge Chibesakunda) is on contract and we have no plans to end the situation and bringing her name for ratification was just routine procedure,” Dr Scott said.

Mazabuka Central UPND MP Garry Nkombo expressed dissatisfaction with the Vice President’s response and quoted articles in the Constitution on the matter but was advised by the Speaker of the National Assembly, Patrick Matibini to file a fresh question.

At this point, several UPND MPs started trooping out of the House including Mr Nkombo and gathered outside the Chambers for close to ten minutes before returning to the Chambers.

Opposition political party leaders have been demanding that Justice Chibesakunda should resign alleging that her stay at the helm of the judicial system was an abrogation of the law.

Meanwhile, Mr. Mufalali has also urged Health Minister, Dr. Joseph Kasonde, not to allow the First Lady to take up her position.

He said that Dr. Kasonde is answerable to parliament on health issues and he should not allow First lady Dr. Christine Kaseba take up his position.

Mr. Mufalali noted that should anything go wrong in the health sector, Dr. Kasonde will be accounted for anything.

He has since urged Dr. Kaseba to allow the Health Minister to carry out his duties normally because he is mandated to do that.

Their President ia able to abuse the constitution, judiciary, the police and anti-corruption commission including other public services and they just sit back and watch. They are so passive and ignorant that their leaders can violate their rights and get away with it. Oppossition parties, and civil society organisation are no longer fit for purpose.

      But if I may address the matter at hand namely whether the contract awarded to the acting Chief justice will ever see the light of day – let us just say it is easier to see the buttocks of a snake than to see this particular document. Firstly, the said document is confidential and secondly, even if one does exist, it would not answer the question being posed namely – WHY DO WE HAVE AN ACTING CHIEF JUSTICE WHEN WE SHOULD HAVE A SUBSTANTIVE ONE? Answer is easy – just ask Daniel Munkombwe for his unedited version.

  2. Dr Kaseba is more concerned with promotion and uplifting women health care issues, thereby supplementing the efforts of the MoH.

    That in itself does not imply that Dr Kaseba is usurping the powers and responsibilities of the minister.

    The ministry of health has two ministers in line with PF manifesto- Dr.Kasonde and Dr.Kaseba -Sata.The official minister-Dr. Kasonde sits in the office while the unofficial minister Dr.Kaseba goes for conferences abroad and gets all the awards.

      I will be very surprised if there was ever a contract, they are just given jobs for who they are, that’s it.
      As for Kaseba it has been observed for a long time that she took over the ministry of health (no contract) and Dr Kasonde is just a sorry sight.

  4. Our Govt is very quick to claim its a “listening Govt” when Sata makes a U-turn and accepts logic. It clearly shows that we do not have a cabinet that is able to exercise its function (debate matters of national importance and dissagree with the President when he is wrong). That is the whole point of having a cabinet. According to the constitution Sata is “out of order” and what gives Guy the audacity to simply say the she is staying. Matibini should also be excused from that role as he serves no purpose or national interst whatsoever. They may aswell have Guy Scott occupying that role too.

    How long can one act on a vacant position?
    Is it legal for someone to get a double salary when acting on another position?
    What qualities do they pick a candidate voor acting?
    In my own opnion i think there should be a specified time of acting depending on what position if not all to avoid ramblings such as what we are having now. I also suggest if at all not the case a single salary payment but negotiated to the acting position for it is crooked for anyone to get a double salary whilst acting, Bloggers what do you think?

      Not sure how much you have followed this story. If you have, then you should know the answers by now. However,
      1. Constitution suggests six months ACJ
      2. No one is suggesting the ACJ is getting two or double salary. Anyone acting in a position will get the salary attached to that position. In this case the ACJ will be paid the same as what a substantive Chief Justice would be paid. If she has retired and on a contract, I think (not 100%) she only gets the difference between her pension and the salary. This is probably why the MP is requesting for the contract to be made public.
      3. It’s very much upto the President to pick who he likes but Paliament have to approve before someone can be confirmed. In this case Parliament has rejected Madam Chibesakunda.

  11. The question that begs to be asked is why is it taking this lady so long to realise that the status quo is simply untenable, her credibility is now being seriously questioned? Why hang on? For the sake of maintaining credible judiciary in Zambia, for the sake of her own children and grand children, and for her own peace of mind, why can she not use her rational judgement and walk away from this nonsense? What’s in it for her? What legacy does she want to leave for her great grand children?

  12. This woman is a disgrace to the Judiciary. What law does she apply when she is presiding over matters when she is failing to appreciate the law that relates to her appointment? What a disgrace!

  13. There is total confusion in UPND. Every Jim , Jack and Henry is now spokesperson of the tribal party. Clearly, Hichilema has lost it, has no control over his underlings. This is good for democracy, as other parties- such as those of Mpombo, Mulongoti, defrocked Bwalya, oh, and even Chipimo- can pick up some support from disaffected UPND members.

If you truly value your Country Zambia and have relatives you love within, it should bother you when the laws that protect your loved ones are blatantly abrogated by those who swore to uphold them.     How useless can we be. The CJ position vacant for months on end. Are all the other justices unqualified dim wits or what? To have no option but contract a dinosaur that is unqualified for the position. To try and sneak her in under the radar like the DPP in hopes that MPs don’t read and are thick as mahogany trees was the plan.

  20. Madame Chibesakunda is a legal person and understands these issues. Meaning she nkows that she does not qualify to be where she is today. Is there any way or possibility that she can be held accountable for being in a position she is not supposed to (yet she nkows it) be there by making or her decisions illigal- that will obviosly be after this government is out of office? I don’t care whether PF remains in power for 20 more years but as long as she is brought to book.
