VICE- PRESIDENT Dr Guy Scott has said Government would probe the Technical Committee Drafting the Zambia Constitution to find out who leaked the draft copy to the online media.
Speaking when he featured on a live programme on Radio Breeze FM in Chipata on Friday evening, Dr Scott said that it was against the terms of reference that were given to the Technical Committee Drafting the Zambia Constitution to leak the document to Online media before handing over the document to Republican President Michael Sata.

Dr Scott said that he suspected that the document was leaked to Online media by some people within the Technical Committee.
“The leaking of the document to Online media was totally wrong and we aware that no outsider had a privilege of having looked at the document but it is within the panel of the Technical Committee who leaked that information to media,” he said.
The Vice President also expressed disappointment that some members of the Technical Committee on Drafting the Constitution have allegedly leaked the Draft Constitution that is circulating on on-line media.
He said the act is a serious breach of the oath of secrecy that members of the committee swore when they were appointed to sit on the committee.
Dr Scott also noted that the technical committee did not present supporting documents to prove that what was contained in the draft constitution were the aspirations of the people when they presented their report.
He stated that the technical committee claimed that it had lost supporting documents of the Draft Constitution.
“We need to prove that what is contained are the aspirations of the people and this is why we need to see the supporting documents,” he said.
Dr Scott said once the report and supporting documents of the Draft Constitution are presented they will have to pass through all the processes of enacting laws.
Dr Scott said PF made a promise to the people of Zambia to set up a Technical Committee to look at the constitution within 90 days of being in power, which it did.

He said the perceived delay in releasing the Draft Constitution to the public is meant to give government time to access the work done by the Technical Committee on Drafting the Constitution.
Dr Scott urged the Zambian people to trust the Patriotic Front government to come up with a people-driven constitution.
He said the PF was popularly elected by Zambians and should, therefore, be trusted with the constitution making-process as it cannot betray the trust of the Zambian people.
He said the Government was waiting for the Technical Committee Drafting the Zambia Constitution to hand over the supporting documents for further action.

The Draft Constitution appeared in the cyberspace days after Mwansa FYABUKAYA Kapeya announced that the government was processing the document upon receiving it from the Technical Committee. So, what makes Scott so sure that the leak isn’t from within government itself?
1. Can he give us the actual dates and times when the official handover of the doc to govt was done & also that at which the leak took place
2. His statement now confirms that the document we’ve seen online is the exact one that that committee handed to government, and we can therefore regard it as authentic !

I just want to acknowledge the work of the ZWD. That online news outlet stands heads and shoulders above everyone focussing on Zambian politics. Scott is saying the technical committee has abrogated the terms of reference which did not authorize them to leak the document; but the same terms of reference were first abrogated by the government by demanding for the printing of only ten copies for cabinet, when the same was supposed to be given contemporaneously to the public.
3. I feel the technical committee was within the terms of reference when they released the document to online media, unless the mode of publication to the public was specified.

Maybe you have missed the point and I hope that Chisenga wasn’t making the same point as you. We are all clear that releasing the document simultaneously does not make it Law. But we are also clear that no one (not even cabinet) should alter or manipulate the draft document without the owners (Zambian public) knowledge or consent and by releasing it, we are all aware of the contents and whether cabinet debate it, like it or not, the wont change anything without us spotting it. Why else would they have wanted only a limited number of copies for them only…to look important? My foot…it was to rob you dimwits…

We can’t expect PF and Sata to do things correctly, i.e releasing the draft accompanied by trumpets and whistles like normal people would do. We should be grateful that some concerned patriot hacker, whistle blower or deep throat had at least done a national duty by releasing the document simultaneously to Mwansa Kapeya (officially representing the president) and to the public via ZWD. At least Kapeya acknowledged receipt and assured us that the document was being studied by cabinet. We do ourselves a disservice if we pay attention to these lying officials. Govt are just facilitating the constitution,in a Democratic system like USA the executive have no say on such but the senate and house judicial committees ,then they will relook the entire draft ,because these are the people ‘s representatives.thereafter it goes on the senate floor for passage and house ,finally to the executive for signature ceremony.using the system their is slim chances for the executive to manipulate the constitution and the public gets what they want as they are the custodians.so the pf is just facilitating but they are not secure.

Note carefully that the document was a public thing, and it should have been simultaneously released to US, the public.
