Justice Minister Wynter Kabimba has this afternoon told the tribunal investigating his alleged abuse of office and breach of the Oath of Secrecy, that his 1st August, 2013 letter attached with a government legal opinion and disclosed to Ellis & Co was drafted in his Ministerial office.
During cross examination by the complainant’s counsel, Makebi Zulu, Mr. Kabimba however told the tribunal that typing and printing of the letter was done at his law firm situated at Godfrey House in Lusaka, but that the letter was signed from his Ministerial office.
When asked whether it was proper for him to keep Patriotic Front (PF) letter heads in his Ministerial office, Mr. Kabimba responded in the affirmative that he had no problem keeping PF stationary at his Ministerial office because his positions of Minister of Justice and PF Secretary General are complementary.
Mr. Kabimba further told the tribunal that the duality of his roles is also the basis on which he disclosed the said letter to his party’s lawyers as a matter of public interest because the PF for which he is Secretary General performs public functions despite not being part of government.
Asked whether the party PF paid for the legal opinion which he obtained from Solicitor General Musa Mwenya, Mr. Kabimba told the tribunal that he did not know whether the PF paid for the legal opinion or not.
And Mr. Kabimba has maintained that carbon copying the letter in question to Acting Chief Justice Lombe Chibesakunda did not amount to inference in the independence of the Judiciary.
He was responding to a question from the complainant’s counsel, Mr. Zulu who wanted him to explain whether he did not know that the Judiciary does not receive legal interpretations from the Solicitor General.
Mr. Kabimba however, maintained that what was carbon copied to the Acting Chief Justice was ideally a confidential communication to his party’s law firm and that it did not give specific directives which the Judiciary was to follow.
The matter has since been adjourned to tomorrow Wednesday 22nd January.

What sort of CEO is this who does not even know whether or not his party paid for the legal opinion from the Solicitor General yet he has been gathering all facts related to this matter in preparation for this tribunal? Or is it just one of those empty answers you give when corner in a legal matter to avoid incriminating oneself?
Kabimba occupies two positions; one in his party and another in government and my understanding of the word COMPLEMENTARY is that different things or processes would be contributing to the achievement of one specific goal, and the goals or essence of the position of PF SECRETARY GENERAL are NOT in any way the same as those for which the position of JUSTICE MINISTER exists in government! Does this guy have an English dictionary?

He contradicts himself,he said any citizen is free to seek legal opinion from the attorney general or solicitor general at no charge and when he was being cross examined later in the day he said he is not aware if the pf lawyers paid money to the attorney general ‘s office.wynter u a dull.if am the chief executive of a company and I write to my chief accountant how we can avoid paying alot of taxes to the govt,chances are 95% my chief acc will implement my idea,copying a legal opinion to the ACJ was /is wrong especially if the case is not yet disposed off.this is a very bad precedent been set by pf.

Kabimba is both the (1) Justice Minister (2) Secretary General for PF.
In that sense, he probably does not carry 2 briefcases when going for work everyday. Therefore, he is likely to have PF stationery hanging around in his office or briefcase.
Is this the best they have can bring up in this tribunal, or rather just trying to establish the case and put him at the right place and right time.
They should stick the main course of the case.

We can now expect a back dated cheque to Musa Mwenye from PF. So far, Mr Kabimba is looking naked with no locus standii.
If he wins, there will be an appeal and then the Supreme court will write Zambian law on this matter and what precedent will be set will show what the In-judiciary of Zambia is like.
“Complementary” means “combining in such a way as to enhance the qualities of each other”. How are the offices of Party SG and Justice Minister complementary??

Your headline is somehow confusing as it might mean that Kabinda does want PF to go anywhere (spread) other than being positioned at his ministerial office.

I can’t help but think of the scripture in Proverbs that gives us insight into the impact that rulers have upon their people. In its entirety it states: ” When the righteous rule, the people rejoice; but when the wicked rule, the people groan.” Proverbs 29:2
There are plenty of examples in scripture of the Lord allowing wicked rulers to preside over Israel as a direct result of the people’s wickedness — or, in other words — when every man did what was right in his own eyes as opposed to listening to God and obeying His commandments for righteous living. What else might explain how a nation such as ours could purposely elect such an incompetent, ungodly man who seems to openly mock everything we hold dear day in and day out? All this arrogance is borne out of the fact that he still the minister when he is up there on the accused and witness stand… he should have resigned his position so he doesn’t think like he is bigger than the tribunal.
How can a government position be complementary with a party president? The 2 duties couldn’t be any different because tax payers pays a government position while the other is paid for by the party.
He doesn’t know whether the info he obtained was paid for, oh come on… he is the one who sought an opinion, he surely ought to know. It’s like going to a restaurant to order food, and then coming out and claim I don’t know if the food was paid for by my friend.
Why didn’t he let his lawyers seek the information directly? Yes he did influence…
His letter influenced the judiciary, considering the cases were still being reviewed. In fact he should have been cited for contempt. His reasons for copying the CJ are hollow and shallow.
This is abuse of office and I wish the likes of Sakwiba Sikota or other seasoned lawyers who understand the separation of government and party better were grilling this guy and with his arrogance, he would been toast.
