Chipimo’s proposal should not be quickly dismissed – EFZ

The Evangelical Fellowship of Zambia (EFZ) says the proposal by National Restoration Party (NAREP) leader Elias Chipimo for an interim government to oversee the enactment of the new constitution and subsequent elections is innovative and should be looked at.

EFZ Executive Director Pukuta Mwanza told Qfm in an interview that the Patriotic Front should realize that it is their failure to fulfill their campaign promises to the people of Zambia that people are beginning to come up with such ideas.

Rev. Mwanza said the idea should be looked at in detail, by exploring the modalities of implementing such as idea considering the fact that as it stands now, it falls outside the current constitution realm hence cannot work.

He added that Mr. Chipimo should think through his idea and see how best it can work within the confines of the current constitution.

Rev. Mwanza however pointed out that the idea of having a neutral person with no political interest to oversee the constitution making process may help the country have a people driven constitution ,stating that the process of coming up with a constitution has been affected due to political interests.

He since urged stakeholders not to quickly dismiss the idea by the NAREP leader before critically analyzing and understanding the idea behind it and see how best it can work.

Docile Zambians are afraid to think outside the box to move this country forward.We have a flawed constitution which for several years presidents have refused to change for selfish reasons- it would remove their almost unlimited power..Sata and PF are clearly setting Zambia on a destructive path.Mmmembe and Nchito are having a field day playing Sata like a string puppet and abusing the powers the flawed constitution gives. Zambians need to wake up and act.Chipmo has an idea that can be refined and modified.My secondary school teacher used to say the only think Africans invented was noise…it seems all we do is make noise on blogs we can’t act ..we can come up with an innovative plan to move Zambia forward.We ‘re Zambians first and no political party should be allowed to mess our future

    • Why have an interim government when there is one in place? That fullish proposal!! If NAREP is desperate for a constitution, they should first win the 2016 elections, get a mandate from the Zambian people, then they can do what they want. For now until voters say otherwise, its PF all the way until the elections.

    • The problem is that this proposal is outside the provisions of the supreme law of the land. What legal frame work will you use as your legal recourse. At ka referendum is mentioned in article so so so. Interim government? Which article?

    • @ex-moma, thinking outside the box in legal matters translates to breaking the law. Other than that, you need to foist PF’s hand to quickly pass legislation as quickly as the Ukrainian parliament did when they usurped power after forcing Yanukovich to flee. Therein lies the tale. Is that what you are advocating for?

    • @kal The answer to your question lies in history.How have people world over done away with discriminatory laws and archaic laws? It certainly has not been sitting down waiting for the evil men to change the laws that gave them power in the first place. Ask the Kenneth Kaunda,ask Simon Kapwepwe(late), ask Nelson Mandela(late), ask Abraham Lincoln(late)…When people waited for an evil ruler to change his ways he ended up killing 6 million people unhindered….Unfortunately history shows clearly what happens if people take too long to think outside the box…..

    • No one wrote those promises for PF, therefore if they have failed to deliver let their leader take responsibility and resign. Where is the Law in Zambia?? See Thailand, the Rule of Law forced the Prime Minister to resign her position. We should have such in Zambia so that people like SATA are held accountable.
      No one can force for such but we the Young Zambians. Let us support Chipimo and Kick PF out. Enough with their lies.

    • @ex-momma, I have already suggested what you are refusing to spell out clearly. What did the people you have cited do short of a revolution? In today’s tight-knit world you either spark a Syria-style degenesis or you scupper a Serbia-Kosovo. It is easy to quote those people but spelling it out is what I have pointed out to you in my earlier post.

  2. Elias Chipimo must have been high on weed, and it is strange that EFZ also seems to have been smoking with him. What has been proposed is a waste of time and will make the PF even more popular. Perhaps Elias is PF sponsored to confuse the opposition. BA CONFUZE Elias!

  3. Elias Chipimo is right. The reason why we don’t have a proper constitution is that all drafts fail to pass because of the goverment in power always wanting to shield its interest. We need to explore his idea.

    Just yesterday Watchdog reports that ‘they’ have come up with a ploy to

    1.remove the 50+1 caluse,
    2.insert some vague clauses stipulating that the candidates must be of good standing and not have any pending cases, and
    3. Pass this through Parliament without a referendum.

    Do you think with these plans there can be a people driven constitution?PF have no intention of relinquishing power come 2016 whether the president is fit to stand or not. Kabimba has been around the country campaigning for himself candidate for 2016 and the choices will be to vote for him or vote…

    • Imwe naimwe, all actions you take must have been provided for in the current constitution. Referendum for example is mentioned in the current Constitution as the means by which you can change the Bill of Rights effectively the whole constitution. Now where does it say if you want to have a new constitution then you appoint an INTERIM government to preside over the transition?

  4. Chipimo is proposing a coup and should be arrested for suggesting that a DEMOCRATICALLY ELECTED GOVT should be ousted before its mandate guaranteed by the constitution expires. Some people need to be checked at Chainama.

  5. DEC should find out if Chipimo Jr visited Chibolya compound recently. He should be examined for hallucinogens.

  6. EFZ you think you are the best neutral people, therefore, you can only find it fit to support this wide proposal which is capable of bring this nation to a stand still. In a waste case scenario there is a chance of civil problems in the process.

  8. @Chindakwanda-Galileo Galilei you can not call the Bill of rights “effectively the whole constitution”. I think at this delicate time we all need to read the letter of the law carefully and interpret what it is that we are required to do. Other than that, lobby your legislators to amend the law so that you can do what you want without risking the commission of treasonable acts.

    • Granted. You may be right. I am not a lawyer but I follow these matters fairly well. My point really is about this proposal trying to take a route that is not supported by any article in the current constitution.

      So, as an example, if you want to change the bill of rights, you hold a referendum. Am I right?

    • Yes. If you wish to amend a constitution without touching the Bill of Rights (which in our constitution is Part 3) then you only need the legislative assembly. What we missed was to amend an instrument that would compel this government to actually hold a referendum. Short of that, terms of reference can be changed. I always advocate that we do some chess when we deal with governments otherwise usually they read far ahead of us with their legal machinery at hand.

  10. I now believe my wife concerning naming children. Mr Pukuta is a classic example. Why note concentrate on spiritual matters and not politics Mr PUKUTA.

  11. Chipimo’s suggestion is wrong, it has no legal reasoning. What about elections and election results, you throw them aside? Who will give that power without due electoral process? It would be confusion altogether. If where elections were held and a winner came out backed be the party structures and govt we still have people like Chipimo coming up with useless suggestions like his, what great confusion that would be!?!?!??!?!?

  12. The Constitution that is the subject and object of the intervention does not provide for interim governments at amendment or reform stage. For this reason, it is outrageous or far fetched to dissolve a working government. That is what politicking refers to.

  13. Interim government for what? You claim that you are speaking on behalf of the people over the new constitution, which people? Confess that you speak for your self. First we have a legitimately elected government in place and also a people driven constitution in place. Therefore there is no need to be in hurry to enact a new constitution it is not a priority and for sure no need for interim government sir, we have not been at civil war like other countries. Let the PF Government work and develop the nation. Mr Chipimo and his counter part HH must wait patiently until 2016 and see if people will vote for them.

  14. Let somebody like Mama Kankasa or rev. Suzana Matale rule for 3 months as caretaker to facilitate new constitution before general elections. Thats what the genius is saying. You are cheating yourself if you think you can beat the SNAKE at his game. HH is likely to win on simple majority BUT SATA will not hand over power. PF need overwhelming defeat. You chaps dont know SATA. HH will cry!

    • there is no need to worry about who will cry or not. someone will not even be there to cause such confusion/ be at peace and rest be assured

  15. The current opposition have no formular for winning 2016. You need a stratagy. Sata used lies, PVT , money from crooks like Matthani, propanda by Membe and leaked data to win 2011. When Winter says UPND will not win***** .in bemba they say chimbwi pa kulila nishi pali apo*****

  16. People from Chipata, whats wrong with them especially Pukuta Mwanza. In Bemba Pukuta means confused. Mr Mwanza name leaves much to be desired. The name speaks for itself.

    CHIPIMO IS RIGHT BECAUSE THE PF HAVE ALREADY SAID THAT
    CONSTITUTION ISSUE IS NOT PRIORITY!
