Katele weighs in on calls for a Chikwanda tribunal

Former Finance Minister Katele Kalumba has advised people calling for the establishment of a tribunal to investigate Finance Minister Alexander Chikwanda’s alleged dealings with the mines to use available legal avenues as opposed to making unattainable public statements through the media.

Dr. Katele says he particularly finds it disturbing that people in the country have the tendency of making public utterances about individuals when there are legal avenues that can be followed to secure the needed information and establish informed opinions.

He has told Qfm News that even though he does not know Mr. Chikwanda’s estate and how the controversy about his alleged dealings with the mines has arisen, if there is any complainant among people calling for the setting up of the tribunal, the rule of law should be followed.

Dr. Kalumba notes that the country has legal avenues such as the Parliamentary Ethics and Code of conduct committee that can investigate any suspected wrong doing by a Minister.

He says this means that before this avenue is sought, there should be a complainant to seek a judicial position of a tribunal under the Parliamentary code of Conduct.

The Former Finance Minister says the seeking of this judicial position should however be genuine and done on the basis of knowledge of any misconduct by an individual who is being complained against.

He has stressed that this provision of the law should however not be used to do behind the scene type of politics to malign a particular individual.

  1. This Katele is a convict who has no shame to talk about such issues, it is only in Zambia were you let criminals to be free like this when is judgement for his appeal?

    • It is the cartel’s sympathisers that are trying to create a storm in a teaspoon after they lost their battle to control Sata, to team Alex Chikwanda. With the booting out of the boat of their angel Wynter Kabimba, everyone in the PF, except Micheal Sata (or simply Micheal as they prefer) is suddenly corrupt! So if anyone of them has evidence of corruption they should report to the relevant people rather than try to scandalise everyone they perceive to be their enemy.

    • Iwe chap get a life ayi, Ba KAKA is not a convict, he has appealed. Mind you he was convicted by the Post in the court of their opinion. The Post. Ncito and Levy connive t embarrase FTJ. For Mmembe the hatred for FTJ started when hi uncle was alangooed at the first MMD party elections by FTJ. From that time vowed to destroyed any one close to FTJ. Remember he started destroying all potential PF leadership material. The first was Given. As God would have it Kabimba is gone and Mmembe is breathing fire. Old habits die hard.

People should learn to be orderly and procedural and desist from making too much noise to seek mere publicity and destroy those they may not like by making accusations that are based on assumptions with out facts! If a Minister has breached any law or established regulations, procedures are there and those with sufficient facts can use them to bring suck erring Minister to book! We have seen patriotic citizens like William Harrington following laid down procedures with tribunals being set up to investigate erring Ministers. So those who feel so strongly about Chikwanda should just go ahead and follow the procedure! He wont be the first neither the last to be brought before the tribunal. Just go with facts and use the Law to make him answerable!!

  3. Indeed people have made it a habit to accuse each other and rush to make statement to the media even when there is no proof. It is important that people own up and take up the challenge to follow the legal procedure and this hearsay we are now accustomed to.

  4. Does Kalumba expect people to remain silent and not issue public statements about the conduct of a minister?
    If those statements are injuries to Chikwanda there are legal avenues for him to address them. So why are you worried? These are public offices and if any defamatory statement is issued, Chikwanda has other avenues to address them. Today chikwanda is court with Dr. Mphande for issuing what he deemed defamatory and that is how it goes. But to expect people to be silent is out of question. Please Kalumba find other better things to talk about.

    • You must be a retard, Kalumba is simply advising people to follow procedure rather than just talking thru the media. Go to the courts or shut up, full stop

    • Let me be educated I am missing a lot. If I am a Zambian and businessman who has invested in local businesses does it mean that if I seek a political office all my businesses should cease operating? Will HH stop running his businesses once elected as Republican President?

    • @ 4.3: Mposa Mabwe: HH can continue with his business whilst in office BUT WE DO NOT expect him to be LOBBYING on behalf of ZAMBEEF for tax refunds, exemptions etc because we know that HH is a supplier to Zambeef (especially if some subsidiaries of Zambeef are suing the Zambian govt left right and centre& some are bragging of tax evasion) Even if we did not know that HH supplies beef to Zambeef ETHICS demand that he keeps his political decisIons/work AT ARMS LENGTH from his business interests/dealing with Zambeef. Infact he is supposed to declare interest the moment he assumes office!

  5. …why ba LT..??….wrong title again. Katele is merely advising legal platform to be used by the aggrieved and not ‘adding weight to the calls’ for a tribunal…
    At times people just cry foul in order to attract the attention of the appointing authority…which thru its own investigations, the presidency can initiate the creation of the tribunal…..(that is if the presidency is active..)

  6. People are calling for the rule of law to be applied on ABC. Mr Kalumba should not just argue for the sake of it without understanding the argument.

    • Apparently it is you that doesn’t understand the argument: Katele is simply suggesting that those who are calling for a tribunal should not do so through Meembe’s Post. Like Harrington did in Masebo’s case, they should go to the courts of law or othe relevant government institutions to do so, and present EVIDENCE for their allegations. Isn’t it strange that so-called father Luonde who is very vocal in calling for Chikwanda’s investigation, gets upset when police visit his home to interview him? How else does he expect the police to get the evidence they need to recommend a tribunal or indeed prosecute Chikwanda if his accusers get angry that they are asked to put forward any evidence they may or may not have?

  7. This guy Kalumba is a convict. Convicts have no moral right what so ever to advise on national matters. If it was not for the appeal he should have been in PRISON! I have not heard of prisoners giving advise to free people??

  8. i have got so many questions on my mind. can someone please help me to understand. In the history of this counytry i have seen so many prominent and good charector standing in public being fired and demoted e.g miyanda demoted from vice president to minister of education despite many zambians includin me believing that he was the next president after chiluba. i remember there was no such bitterness or celebrations like the current one. vice president nevers mumba was fired by the late mwanawasa. And the recent one where Lubinda was fired. The fact is that Lubinda was the next likeble person in pf after sata and that no one can change it. he stood with sata in bad and good times. i understand he he is a human being who can error . But is it not the same ba wynter.

    • Suban Chaisa I want you to understand one thing why firing Kabimba has raised to much dust.1.while all those you have mentioned they were fired via a press conference by the president explaining why they were fired in Kabimba’s case only George Cheela announced yet Kabimba was third in rank form the president.2.The reasons for firing Kabimba were based on who should succeed Sata not what Bad has Kabimba done,hency raising the tribal Tag.3.Kabimba played an important role 2011 and was the chief executive of the party If he errored as a minister at least he should have remained as party secretary general but they striped him both to remove him from presidential race as it is nolonger a secreet that Sata is Sick.Its not a crime in Zambia to aspire for presidency.

    That is why one blogger Jay Jay calls Zambians docile. You are afraid to come out as an individual to demand for a tribunal? Am sure you are not alone wishing for such, there are many of you but are afraid of being injured like one Kabimba fellow! Kalumba may be a convict suggesting a commission of inquiry on Mr Chikwanda over his corrupt dealings with the mines so it was with him (Katele), so it was with Kapoko, so it was with Konga, so it was with Masumba, so it was with Stella, Sakala, Muteteka list is endless. Safety from prosecution of Chikwanda now or after Sata is not guaranteed.

  11. @ sido mark, thankyou brother though i am not satisfied with some of your reasons because i don’t remember president sata holding a press conference when he fired sc sebastian zulu who was the first justice minister in pf neither do i remember president sata holding a press conference when he fired honarable Lubinda. all along it has been george chela who announces. remember mr Lubinda recently complained that he din’t e even recieve the dismisal letter. On the issue of contribution, yes it can not be denied that mr kabimba contributed to the coming of pf into government. But so is mr Lubinda. why do you think mr kabimba should be treated special from others even when he errors more?

  12. Well put Dr, In fact most of the people making noise dont even understand the law and what is involved in the vat refunds. They just make noise, if you ask them a few questions the cant even explain what the problem is. Chikwanda having business interest is one issue and the vat refunds is also another issue. People making noise are just muddling the waters with some political motives. Are there any laws in zambia that a minister can not run a business? Just meet the man politically instead of hiding behind non issues,

  15. I want pay tribute to the editors of ZWD, LT, Daily nation and Zambia reports. Thank you for democratizing the press. The time has come for people of conscience to expose and publicize the moral rot at the core of Mmembe’s campaign to demonize the Bemba speaking people. One place to start would be exposure of and his political and ideological allegiances. People of conscience arise.

  16. This Katele is part of the same people who were going to Sata at night to tell him to fire Kabimba. He is part of the Bemba clique, Mmembe keeps talking about. Katele hopes that Sata will finally pardon him.

  17. In a ruling passed by Judge Fairness Postgotohell, the tribunal has found no case against Honourable Chikwanda. The judge described the accusations against the Hon Minister of Finance as malicious, frivolous and at best illiterate. He awarded costs to the Hon Minister, described the Post as busy bodies and advised them to find something worthwhile to do in life than making it a life long occupation to scandalise innocent citizens whatever his personal problems.
