
The Anti-Corruption Commission is studying the judgment delivered by the Subordinate Court with the view to appeal against the acquittal of former Ministry of Health Human Resource Manager Henry Kapoko and seven others on 21 counts of theft by public servant and money laundering involving K4 million public funds.
ACC Public Relations Manager Timothy Moono told QFM News in a statement that the Commission is not satisfied with the judgment of the subordinate Court and will appeal to the High Court.
In her judgment delivered on Friday, 26th September, 2014, Magistrate Sharon Newa convicted a Director of Royal College of Secretarial Valenta Miyoba Nkhata and sentenced her to three years imprisonment.
Her daughter Abigail Nkhata was equally convicted but given an absolute discharge for the offences committed.
Magistrate Newa further forfeited to the state properties which include a farm in Lusaka West, 15 computers, a Mercedez Benz, and a Toyota Kluger confirmed to have been bought from the stolen money.
The Magistrate however acquitted Henry Kapoko and seven others on account of what the Court deemed as insufficient evidence.

This Guy will soon be walking the streets with his head held high “as if he has worked extremely hard” for his wealth, when in fact he was robbing people dying on their death beds. It is depressing to think that Zambia as a nation has come to accept theft and criminality as an enviable way of achieving success. People like this deserve to be locked up and the key thrown away. We Laws in our Country that require an individual to explain wealth or posessions that is “reasonably believed” to be proceeds of crime. Now did our DPP forget this when he was reviewing the charges against this criminal?

That ACC department should just be deleted.
ACC can go ahead if they have fresh, or indeed any evidence against the thieving gentleman, Henry Kapoko. Without evidence they can lick his ass and go fcuk themselves. This will go Chiluba’s way – everyone knew that he stole but there was no tangible evidence to prove the thefts. He walked free in the end.

ACC is now chasing kapoko but they ignore criminal Shamenda who refused to report his corruption within 24 hrs,,,, me i dont understand these pro-poor reforms
The ACC should be gotten rid of. They are an incompetent and unprofessional lot. How many cases have they lost so far? Every department in government is corrupt most especially if it deals with the general public. Not to mention the ACC is corrupt itself.

This will be a waste if court time and Tax payers money your investigating officers are useless you failed to link those guys to the crime what new evidence will you bring now? I’m a criminal psychologist I followed up on that case. Whoever will appeal should be fired when you lose in the high Court again which you will.

This a clear case of PF having a hand in this. Who does not know that Kapoko played a role in funding PF campaigns in 2011.So under PF and the Kolwestan Clan stealing is normal don’t worry Zambia will soon be liberated from such forms corruption.PF is stinking with corruption especially Road deals being awarded from state house.

The suspect is or was a Human Resources Manager working for a Government institution that does not pay much who was still in prime years and had not yet obtained his pension or gratuity but was found to be the owner of expensive assets and/or properties who could not explain the origins or how he acquired such assets/properties. Not from his savings, no bank loans, no unsolicited gifts or indeed not by inheritance. How difficult should this be to prove by prosecutors that he illegal methods were at play in acquiring that which they think he should not have?
Our investigative wings need sober sharp minded intellectuals. Ones that can not only gather evidence, but present it in the most eloquent of format.
Kapoko was just a victim of political persecution, under Rb goverment he was suspeted to be supporting then opposition PF. Outside public service kapoko industrious and always thought outside the box in becoming what he became.
You can also build a successful career, regardless of your field of endeavor, by the dozens of little things you do on and off the job.
While we appreciate that dedication towards work is important we should always remember that … what happens from 17:00 – 08:00 hours while we’re off the job is INFINITELY more important

Excellent. This is what we want to hear. Our gov’t bodies doggedly chasing for our taxes. He must account for his wealth. We want a judge in favour of the state and people. We want our money.
What is relevant is ‘how’ he came to gave a gov’t contract awarded him whilst being an employee of MoH. Auditors must pronounce that wrong and contrary to good governance. This should open a venue for justice to follow.
We want the riches made from this advantage for kids education. Well done. More prosecutions please. We have debts to pay, the poor to look after. We need revenue.

As a medical doctor in a struggling Ministry of Health, despite the genuine hard working paramedics, general labour force, dedicated nurses and committed medical doctors’ efforts this is “breaking news!” The man laughs at the system!!
Does it mean that crime pays? The clinical and legal evidence is obvious!
Meanwhile community members have died with preventable deaths because;
– No money for antibiotics and especially TB drugs in a world of AIDS & TB
– No money for managing diarrhoea, malnutrition and pneumonias in children
– No money for for life saving equipment and laboratory facilities
– No money for training workshops / upgrading of patriotic healthcare workers
