Probe Speaker Matibini over GBM ruling-YALI

The Young African Leaders Initiative has called for a probe on whether Speaker of the National Assembly Patrick Matibini breached the Constitution by declaring the Kasama Central parliamentary seat vacant.

YALI Governance Adviser Isaac Mwanza said in an interview that a probe should be called to establish whether Dr Matibini was in order when he declared the Kasama seat vacant.

Mr Mwanza has since called on Dr. Matibini to reflect on his conduct in determining the question of the membership to the National Assembly in light of the matter that the PF had used the due process of the law as provided in Article 72 of the Constitution to determine the question of Mr Mwamba’s membership.

He said YALI was of the view that Speaker Matibini could have waited for the High Court to rule over the matter.

Mr Mwanza said the High Court was best placed to determine in the application by the PF with recourse to the Supreme Court.

He said Speaker Matibini knows very well that only the Courts can determine whether the seat has fallen vacant.

But Law Association of Zambia President George Chisanga has supported the decision by Speaker Matibini to declare the Kasama Central Seat vacant.

Mr Chisanga said the ruling by the Speaker is consistent with Article 70 and 71of the Republican Constitution.

He however said he was not sure that the Speaker did the right thing considering that the matter between Mr. Mwamba and the PF was in court over his earlier expulsion from the party.

    • Mr Isaac Mwanza please stop wasting your breath. GBM is contesting the seat under UPND which renders your sentiments redundant. The speaker only declared the seat vacant. It was up to GBM to decide which ticket to contest on and he chose UPND!

    • This Matibili chap is corrupt! why Only GBM`s seat?,,,,,, declare those seats for those kachemas from UPND hiding in PF chitenges also,,,,,,dont forget those traitors in MMD who sold off man of God Nevers Mumba for a afew pieces of silver

    • ECL will never lose to your Kachema HH who is even failing to win parliamentary seats but Pf was winning prior to its grand finale. UPND is still boasting for nothing. I can not wait for 2016 to see HH sent in political retirement. GBM will definately take over from him if they block him then he will cry foul that he is marginalised because he is not Tonga. Watch the space. What I say always come to pass.

  4. We call what YALI is saying ukusabaila. As for GBM and the UPND that seat belongs to PF and to PF it will go back. Both HH and GBM will try to put in a lot of cash into the bye-election but that will help only a little. PF will still retain the seat and it be the beginning of woes for fat Albert because you cannot have a vice president for administration who will have lost elections in his constituency and expect him to be effective in that opposition political party.

  5. Cimbi….. another thing, those who think UPND will defeat PF in the 2016 general elections should learn to heed to what the GENIUNE and TRUE prophets of God have uttered. I have heard and believe that PF will win those elections but there is a time when HH will later win and rule Zambia. Those who think this is not true should not die but live to see what God revealed through his servants, the prophets. Remember God still speaks today, I mean the True and Living God not the idols and names of dead people that some people worship.

  7. We have potentially the most expensive, violent bye election on our hands. PF don’t want to open floodgates of northern province to UPND, GBM is the man who sponsors violence especially the time he was minister of defence, one hand this is a bye election so it favours the ruling party, on the other hand, GBM has been denting holes in PF all along and he is been getting sympathy voters. I wouldn’t be surprised to see the president camping and finishing all the eurobond in kasama just to win this election

  8. yes the speaker shud be probed and perhaps the laz president shud tell us why mps facing expulsion from their parties have been turning to courts of law for protection and not the speaker, assuming he has such powers.

    Legislature and Judiciary are two different arms which operate independently! One cannot rule over the other, but they can rule side by side!

    Just because GBM expulsion is in court does not now mean Speaker shouldd tolerate GBM’s confusion! PF expelled GBM and he went to court so Speaker didn’t declare vacant, now the same ***** that went to abuse court process has now broken parliamentary law, should Speaker again wait toothlessly?? Come on

    It’s GBM who has made the move

  10. Well, Mr YALI, that does not call for a probe. If GBM thought that he had a case, he would have asked for judicial review, or whatever they call those legal processes (ab)used by Zambian politicians.

  11. The speaker did the right thing at the wrong time because the case was still active in the courts of law,so GBM can still obtain an injuction to be allowed to continue as an mp till the case is disposed off the courts of law.
