Popular independently owned Muvi TV and Komboni have lost their application in the Lusaka High Court where they challenged the decision by the Independent Broadcasting Authority to suspend their broadcasting licences.

Lusaka Judge Mwiinde Siavwapa ruled that the application contesting the suspension of their broadcasting licences is premature.

The two stations therefore remain suspended.

In his judgement, Justice Siavwapa said the application against the IBA was misdirected and incompetent.

Justice Siavwapa said Muvi TV and Komboni used a wrong procedure to try to challenge the IBA’s decision.

On August 22 2016, the IBA announced the suspension of broadcasting licences for Muvi TV, Komboni Radio and Itezhi Tezhi for professional misconduct.

This week, the licence for Itezhi Tezhi was reinstated after the management and the board appealed for lenience from the IBA and apologised.

  1. Did IBA use procedure when they shut it down, there is just lawlessness in Zambia starting from the President through to the judges up to the cadres….

    • IBA keep it up. You have saved this country from total confusion. We appeal to you not to lift the suspension because going by the way these two organisations have behaved, they have not learnt a lesson. If you lift the suspension, they will still continue promoting anarchy and planting seeds of hatred and tribalism in the hearts of our innocent Children. Shut them down for good. Another serious investor will soon come on board and take there place. Thank you IBA.

    • Exactly or better still they must ask Itezhi Tezhi radio how they did it. They must have done something wrong these people….no wonder their colleagues from Itezhi Tezhi had to apologise.. I see a lot of wisdom there. There is no way the whole IBA board could resolve to suspend the license…something wrong must have been done… some rules were broken. I think after this saga we will see media personnel working professionally and responsibly

    • Apologizing for something you don’t believe was legally wrong is what gives power to totalitarian regimes to control the media. You can only apologize if you really, truly believe you broke the law. Otherwise, apologizing when you know you haven’t done anything wrong only empowers the people who want to control what the media can and cannot say. Seems IBA wants all the media in Zambia to be like the government controlled ZNBC. i.e. only singing praises of ECL and PF. That’s not freedom of the press.

    • Just accept the charge, just except that the elections were rigged, just accept, just accept – WHY MUST WE JUST ACCEPT ! This is not a democratic country ! We cannot just carry on just accepting – this is why we will never progress as a country – if leaders are stealing – we must just accept, if there is corrupt deals with oil tenders we must just accept !!!!!!

  2. Can this JUDGE please add more wording to his judgement. You just cant say the application premature, misdirected and incompetent, add SOME justification to that. Why do Our lawyers want to pretend like they are dealing with rocket science on straight forward matters that even an impartial laymen can easily handle??

    Most of these caseS don’t even need a degree from law school to be decided.

    • @Munamwanga, Although I felt the same way I think Zimandola could be right. It may just be the poor reporting to blame for the lack of rationale behind the judge’s rulings

  3. Muvi TV is getting advice from wrong characters like M’membe and Mutembo Nchito, the owner must sober-up and try different avenues to try and sort out the mess they have created for themselves. Stubbornness will not resolve the issue at Hand. that is my free advice.

  4. That is what happens when people are drunk with pride. Everything about MUVI TV was pride. They thought they are too powerful like their friends in the name of the post. Zambia is bigger than any individual.

  5. Its Simple, just accept wrong doing and apologize for irresponsible reporting and come clean. The court just practiced leniency with Itezhi Tezhi radio. swallow the pride and avoid the dumb footsteps of Fred M’membe

  6. Muvi TV should swallow pride and apologise. Its cheaper and less expensive than paying lawyers over a case which is straight forward. Look at how much money you have lost

    Kuwaya waya fye. Dont call others to be useless when you are worse than the word itself. This is the reason why your HH will never rule. Elections are not won in courts.

    • 12 yes indeed HH will never rule Zambia but he will rule Barosteland(Zambezi republic)to hell with this animal farm called Zambia.Zambia will die with Kaunda from Nyansaland.

  8. All the bloggers on this matter have missed the point. I am not a lawyer but for all I know Law is just using simple logic. The judgment is flawed. Yes MUVI and Komboni should have appealed to the Minister, but there is no Minister since Cabinet was dissolved. Where could they have appealed? A word of caution though to these two news media; Do not compromise but misguided arrogance does not pay, humility will take you anywhere and you will get support everywhere.

  9. kuyi chaila look at itezhi tezhi only cost bus fares or fuel tanks with bed space for people who visited lusaka. these courts just cost money and waste time over straight forward issues.

  11. As reporters you have a duty to tell us the meaning behind this: Why does judge Siulapwa deem the application premature? Surely he should have provided reasons for saying this.
    Justice Siavwapa said the application against the IBA was misdirected and incompetent. Why does he think it is misdirected and incompetent? He must have explained or didn’t you read his judgement?

  12. Is it just me or everybody else who sees that Lusaka Times comments are between the Tonga and the Rest of Zambia? How with such flaw and agenda of a tribal party would you ever think that this party can win an election in Zambia?

  13. I LEAVE LIKE IN A FOREIGN LAND WHERE THERE IS NO NEWS SINCE MUVI TV AND POST NEWSPAPER WERE CLOSED DOWN. I HAVE VOWED I WILL NEVER EVER LISTEN TO ZNBC OR BUY ZAMBIAN NEWSPAPER LIKE TIMES OF ZAMBIA, NATIONAL, OR DAILY MAIL.
    I HAVE WITHDRAWN MY MONEY FROM BUYING AS ONE WHO USED TO BUY PAPERS.

The Philosophy of Live and Let Live may apply very well in this case as One great thinker,,,,reasoned to say Power Corrupts and Absolute Power Corrupts Absolutely……HH AND What is the other person,,,i mean his running mate should start thinking of reorganizing their Party rather than trying to fight a………battle. it is high time that they got back to the drawing board otherwise they will loose more than already lost.

I have come to truly believe that surely Humility is a virtue,,,one only attained by those who know that they know not. in life its always good to leave room for correction based on reflective approach in any circumstance faced. as such Muvi Tv, and Komboni,, swallow your pride as institutions which are on the rise and consult what should be done its not cowardice mind you but humility, despite being compromised by certain parties in order to propagate their propagandas, its better for you to clean up the mess
