Lungu is Zambia’s 6th President, HH, GBM and the UPND Admit It

The inauguration of President Edgar Chagwa Lungu as Zambia’s sixth president by Chief Justice Mambilima left HH, GBM, the UPND and their opposition allies like my fellow Pastor Nevers Mumba dreadfully puzzled. Although it is within their constitutional rights to verbally reject Lungu as their president, the existential reality remains; Lungu is their president until 2021. It is also illogical to claim that Lungu is not their president while sitting UPND MPs in Parliament. By sitting in Parliament, UPND has legitimately acknowledged Lungu as Zambia’s president—common sense is not always that common.

Long before the ruling, I told one of my UPND friends that HH made a big mistake of taking the case to the ConCourt. This is because no Zambian presidential election has ever been overturned by our cadre-driven courts. This does not mean it will never happen, but the truth is our courts seem to have power over Parliamentary elections but never on presidential elections. KK tried it under Chiluba—the only thing he got was a very big legal bill and sometime at Mukobeko maximum prison!

The UPND should have claimed victory mentally. Politically, this would have had a positive psychological bearing on the electorate. HH and GBM would have had social capital to their claim—the election was stolen from us—we meet again in 2021. This claim could have been employed as an organizing tool. But once the ConCourt and Supreme Court made their rulings, Lungu and the PF have this mental capital—they defeated HH on polls and in two courts—the ConCourt and the Supreme Court. To use soccer language, the referee produced the red card. You can complain as much as possible, but the ruling stands – you are out of the game!

HH and GBM can take their case back to court—but it is a waste of time. Legal avenues maybe limitless, and lawyers are always looking for money from desperate clients – just ask our founding president KK. Unlike KK, however, HH and GBM have limitless resources; hence many lawyers and desperate politicians are lining up for a good taking. Yet promising to reverse Lungu’s victory through the courts is illogical – it is like promising to kill an elephant with a stick.

Regardless of what various “experts” want us to believe, HH and GBM lost the petition on technical grounds. I sympathize with HH and his allies. Nonetheless, they must understand that under the current Constitution, the ruling of the ConCourt cannot be challenged. Pastor Nevers Mumba’s letter of desperation to President Lungu, employing him to ask the ConCourt to hear the petition is inviting the president to commit a constitutional crime. It is also interfering with the judiciary. As President, he cannot undo the Constitution he pledged to defend—in fact, he can be impeached for the same. In short, this is a constitutional matter that would demand Constitutional amendment. Until then, the case is closed!

If the Constitution is not ironed out, we are headed for another drama in 2021. Here is another scenario. Assume the PF loses the 2021 elections to UPND, and takes the case to the ConCourt. The UPND can easily waste time by ensuring that petition proceedings are slowed down until the 14 days are over — winning the case on technical grounds. Across the globe and in Zambia, criminals have been acquitted on technical grounds. Usually lawyers go after loopholes in the law to win cases—this is the difference between a smart and a dismal lawyer. But this does not mean a crime was not committed. On the contrary, lawyers took advantage of some legal loopholes to win their case.

My plea to the UPND leadership is reorganize and start preparing for the 2021 elections if they love Mother Zambia–which I believe they do. Nonetheless, telling cadres that Lungu will be pushed out of office before 2021 is mere propaganda. Such paranoia will negatively project HH as a desperate power-hungry individual — something the PF controlled media will keep on saying—thus enforcing a deleterious perception of HH in the electorate.

If I am HH, I would ignore the Zambian Watchdog’s and other “legal experts’” guidance, and start my campaign for 2021. For a person with a dream, 2021 is not too far. I pray HH will heed.

By the way in other words the rev is admitting the wrongs in the our courts and he thinks there is simply nothing that can be done. This is the very thing HH and GBM are fighting for and they should be commended and ridiculed. What kind of a reverend is this one who thinks emotionally, other than logically. if you would support someone even when that someone is wrong then you don’t love that person. your support for lungu is not genuine. what we want in Zambia for us to develop our country is someone who respects rule of law, and respect for peoples will.     ” HH, GBM and the UPND” are all one and the same. If you say UPND have…… it goes without saying HH and GBM are included.

    “Implied” is not the same as “admitted”. The author should know this. ” HH, GBM and the UPND’s” admission of the ECL Presidency is “implied” in their actions not stated clearly.

    The fact, however, is that ECL is the Republican President whether UPND acknowledges it, accepts it, or chooses to ignore it.

  8. The Reverend is not objective in his analysis. he is not being fair to lungu, because what lungu has done by forcing his way to power disadvantages lungu more than any other person. The future shall judge lungu properly when everything shall be looked at clearly when its cast in the anals of history. there shall be no debates at that moment, only the facts shall speak for themselves. kaunda ruled for 27 years,chiluba 10 years, and bithe never wanted to go of their own will but eventually they were made to go. leave lungu as he is, he is just planting his own bomb.

However he should do so within the confines of the law, otherwise at the rate he is going he may end up committing a serious crime. UPND simply did not have a case. up to now they don’t have. even if they just socially claimed they were robbed of victory, we would have just laughed at them. HH prayed for the elections to be overturned by abuse of court process. unfortunately the constitution does not say as he wished namely that a president who is petitioned steps down or aside as Mumba wa ciwowo likes to say. the constitution doesn’t say that. HH even admitted he only read the constitution in less than an hour. and he expects to understand it? so boastiful. unfit to be president!

  13. I am still waiting to see evidence of how a majority party in Parliament lost the Presidence. Every one who voted in those PF MPs was PF or a PF sympathiser who voted PF. HH and GBM should show us how people voted for them while voting for PF MPs at the same time. Show me your Parliament and I will show you State House.

    I agree with the Rev only on one point that HH and GBM have lost the sympathy vote that Sata tactifully used so craftly by telling his supporters to hold their peace when he claimed his victory had been stolen. He assured them they would win next time and they did. From the results it was clear HH had made inroads into PF strong holds and he was well positioned for a killer punch in 2021.   14. What It Means and Does Not Mean to Honor Our President

    A couple weeks ago I wrote in a post that we should never badmouth the President, but honor him. We are to honor him because God commands us to, not because we deem him worthy of honor. Peter told his readers to honor the emperor, who was Nero, a wicked murderer. But what exactly does it mean to “honor” our President? Here are a few thoughts:

    First, to honor the President means we recognize that God has placed him there.

    Let every person be subject to the governing authorities. For there is no authority except from God, and those that exist have been instituted by God. Therefore whoever resists the authorities resists what God has appointed, and those who resist…

  15. Then courts and the tension of waiting for the President to be innaugurated shifted the sympathy to the President Elect. The PF highlited the Dundumwezi voting pattern to cast UPND in tribal light and many people bought their side of the story so much that if a re-run had been ordered at that time Zambia would have voted in exactly the same pattern but with Dundumwezi extrimism which would have left us gravely polarised.

    • PF are the master of lies and dupery. There is nothing but lies, lies, lies about dundumbwezi.

      One thing is clear. Lies have short legs. There is no sympathy vote for PF. PF is by nature a government of looters and thieves. Lungu is the chief warlord looter. The chickens will soon come home to roost. The North Western enclave of Zambia will be vindicated that a PF leadership is wrong for Zambia for it stands on simple philosophy: massive looting, corruption, theft, violence and unconsitutionalism.     No matter how much we disagree with or disapprove of our president, we must realize that God has placed him there to accomplish his own sovereign purpose, as God did with Pharaoh in Moses’ day:

    Since God has placed our president in office, we should speak of him respectfully, not in a dishonoring, mocking way. We should also pray for him and bless him.     To “be subject” or “submit” to our government means to obey the government. We may not be happy about taxes or regulations we must follow, but God…

    What honoring our President DOES NOT mean
    To honor our president does not mean we must agree with everything he says or does or that we must commend it or condone it. Or that we cannot speak out for truth and righteousness.   32. This matter is still b4 Concourt. Fr Kaoma is not a Constitutional lawyer nor a Concourt Judge to make such a declaration. The Petetioners would like a declaration for Concourt that Lungu was declared the 6th President of Zambia on a date and was sworn in by the CJ. To our knowledge Concourt has not yet made such a judgment or declaration. The Petetioners want this judgment to persue justice thru the UN International Court of Justice. It doesn’t matter how long it takes but history will judge Lungu as a person who stole Zambia’s 6th Presidency in 2016. Meanwhile the vote theft and fraud will hound Lungu for the rest of his life if he has any sense of shame.

  33. UPND needs to separate sense from no senses because at the end will look fools in eating own vomit. No matter how long it will take but one day shall accept that Lungu remains a Zambian President and what will be the reaction from the people who were incited to join in rejecting Lungu.
