I never engaged in electoral malpractice, Lusambo,tells Ndola High Court

KABUSHI Member of Parliament Bowman Lusambo told the Ndola High Court that he never engaged in any electoral malpractices because he knows the consequences of such acts.

This is in a case in which losing United Party for National Development (UPND) candidate Ernest Lufunda has petitioned the election of Lusambo as Member of Parliament (MP).

Lufunda has asked the Ndola High Court to nullify the election of Lusambo alleging gross electoral mal-practices and intimidation.

When the matter came up for defence before Ndola High Court judge Yvonne Chembe, Lusambo 39 of house number 0241 Lubuto, told the court that he knows and fears the vice  of electoral violence.

“I have been in politics for long and I know what electoral violence is. We know what the electoral code of conduct and what the Electoral Commission of Zambia says about electoral violence and malpractices can do. So we did our best not to be engaged in such acts,”.

“My competitors could not much my popularity on the ground. It will be hypocritical for the petitioner to say that we attacked them. Yes I knew there were some mock graves that were put up but that I was not involved,” he said.

Lusambo further told the court that the petitioner did not campaign enough to win votes.

“Based on the money, I have he (petitioner) called me a satanist. He was saying the money I have was blood money. So that also disadvantaged me a lot. But politics is a game of language where people call each other names, so I did not bother about that,” he said.

After Lusambo’s testimony, the respondents closed their case.

And Judge Chembe said she expected the petitioner and the respondents to file in submissions within seven days.

“We will endeavor to deliver judgment in this matter by November 18, 2016. So judgment is reserved for this date,” she said.

    • Thug Lusambo of Lubuto was once my neighbor, and can’t still be 39, politics is not soccer. That’s where lies starts. He may have money, he was selling anything including firewood, that I respect. But to say no thuggery in campaigns, how can people forget when he was in MMD’ overalls, those MMD’ die-hards were vicious to Sata.

  1. what a naive man this chap is. He thinks zambians are gullible babies. The very fact that you stood under a political party which has assumed power illegally by avoiding and squashing legal redress means that indeed all of you pf mps are illegal. Illegal things dont last. Already failure is clear for all to see with fuel increase after kambwilil was busy praising dull humble lungu about a deal he cut with saudi arabia. Soon imf will teach us a lesson and when people start eating salt for breakfast that is when they will realise that indeed pf are a useless bunch

  2. Lusambo is surely losing this seat.He was violent,abusive(mock graves & funerals,burials etc).There is ample evidence for the learned judge to nulify his election.Lusambo knows the electoral law but vioilated it with impunity.He wanted to win at all costs.

    • I agree with you. In addition of the article, the author has not told us what the petitioner said. How do you go and ask the defendant to speak before the complainant speak? I know there is biasness of the article here.

  3. Uko, all MPs were at one time abusive during campaign. Suggest the right judgement. Our judges are wise. If you were King Solomon, would you really have to share that baby in two parts when you know it would die? Surely, there must be a workable solution that demands spacial reasoning.

    • Not an excuse. Nullifying results will teach them a lesson. To say many people are stealing therefore should also steal is not a defense. If you steal and are caught and convicted, you go to jail simple.

  4. Comment: Don’t be surprised countrymen, Lungu and the majority of his MPs did not win these elections squarely and cleanly. they were malled by malpractices, violence exhibited by police force, carders and the manipulation of results figures by Chuulu.

  5. Upnd is as usual chasing the wind in this case!!love or hate him,Bowman Lusambo won this seat and even if a by-election is called for today,Lusambo would 100% retain his seat under PF,so find what to do ba upnd till 2021 when another painful defeat is awaiting for your kalusa-hh!!!

  7. And Judge Chembe said she expected the petitioner and the respondents to file in submissions within seven days. This guy needs to file his submission in the seven days given. No delaying tactics, only to file on the eighth day.

  8. I have been keenly following Lusaka Times and reviewing commentaries.

    In a class there will always be failures.You do not expect everyone to pass that is an utopian dream.

    The candidate that lost should accept that standing for a Sit there is an opportunity to succeed as well as a risk of not making it which in this case losing and by which he lost.

    There are no two ways about it.Therefore let not the precious time of the Court not be wasted
