Mushipe sues UPND MP

has dragged her client UPND Kaoma Central Member of Parliament Sitwala Sitwala to court for non-payment of legal fees.

Ms Mushipe has accused the MP of refusing to settle the sum of K45, 000 for professional services rendered to him.

The UPND lawyer claims that on instructions from her client, she represented him in an election petition matter where Austin Liato sued him for the nullification of his seat in Parliament.

“On the 9th September, 2016 the plaintiff received instructions from the defendant to represent him. The plaintiff and the defendant entered into an agreement and signed an engagement letter accepting the conditions,” she said.

“Despite repeated reminders, the defendant has refused, neglected and ignored to settle the outstanding legal fees which are rightfully due to the plaintiff for legal and professional services rendered to them.”

Ms Mushipe submitted to court that Mr Sitwala had issued instructions of termination of contract to her firm on September 30, 2016 without payment of the legal fees when the lawyer already concluded his case before court.

She has since requested the courts to compel the parliamentarian to immediately pay the legal fees owing as per agreement, including interest at current commercial bank rate to the date of settlement.

The High Court previously dismissed Mr Liato’s petition and upheld that Mr Sitwala as the duly elected Member of Parliament.

  2. Gen Sitwala please pay up. You may not agree with the quantum of the fees but you contracted for the legal services. Be an honourable gentleman. K45,000 is not a fortune under whatever condition. Don’t show your meanness in public. Negotiate with your lawyers away from the courts.

  5. It’s bad not to pay for services rendered, but quick to claim your sitting allowances. What must be born in mind is that the lender has got to live too so you don’t pay them how are they going to live let alone pay their employees who also have families to feed?

  6. I notice Mushipe won this particular case, can she also represent the many transporters who were duped by Election Commission of Zambia that they would be paid in one month of providing transport to ECZ for elections and they are just being tortured with promises months after elections

    • You better wake up and realise this ECZ is just another branch of Lungu and his PF. You will never be paid your money. This was an easy way to steal in broad daylight by the PF thieves.

      Even before the election the PF rigging plan was put into action by organising IMMUNITY of Chuulu and the ECZ so they could commit any crimes they wanted to without being prosecuted, which includes stealing from YOU!

      So even if it is PROVED in Court they rigged the election they will get off Scot free!

  10. wow! ITS a Dark day when a lawyer sues a client for fees…but these services are not for free they require tact knowledge skill and at times drama…please pay the women don’t let her lose her house on account of your ineptness

  11. If he doesn’t want to pay her, let him vacate the seat, as they would be nothing honourable about his conduct.

    • That would be the most honorable thing to do. Go back to court and ask the court to reverse the judgment.
