NAREP disappointed with PF drama

NAREP is disappointed with the drama being played by the Patriotic Front at the expense of national development. We have seen media houses being silenced whilst others have been forced to close down.

The recent attack on the Judiciary by Mr. Amos Chanda on ZNBC’s Sunday interview should be condemned strongly. This condemnation also extends to other political parties such as the United Party for National Development who have also passed undermining comments on our Judiciary. We do not support any of such utterances whether coming from the ruling party or those in opposition.

The Judiciary’s autonomy should be upheld by all stakeholders and it should be left to operate to its optimum best. We urge President Lungu to take caution with how he is handling national affairs. Considering that he himself is a lawyer, our expectation is that he should understand the importance of according both LAZ and the Judiciary the necessary credence and dignity they deserve.

We observe too that through their Secretary General Mr. Davies Mwila, the Patriotic Front has declared war against the Law Association of Zambia and took the uncouth liberty to declaring the LAZ President, a citizen of Zambia, Ms Linda Kasonde “a hostile political force”. Surely this does not make any political and republican sense. In her capacity as President of LAZ, Ms. Kasonde carries the mandate of the association with every weight intended and does not represent her personal views.

She carries the views of the organisation and what she tabulates and expresses in her official capacity is a reflection of the views carried by LAZ members professionally. It might interest the PF to be reminded that LAZ operates independently and this has always been the case. As such, the PF has no basis for engaging LAZ into politics. NAREP is under no doubt that these kind of utterances border on threats and intimidation to these legal houses. We would not be surprised if the calling of a splinter group of lawyers is being sponsored by the selfishness of the politicians aligned to the oppressive tactics of the ruling party as observed from a press statement released by some small political parties. LAZ will remain a vital organisation to our legal system, therefore Zambians should not allow for multiple replica organisations to carry out identical functions to LAZ as that is a quick recipe for anarchy.

In reflecting the bad policies of the Patriotic Front’s inability to separate their role as government from that of them as a political party, the Patriotic Front youths have also since called for the resignation of Ms. Kasonde as if LAZ is a government wing. NAREP urges politicians to stay away from LAZ and the Judiciary as these are among the few institutions Zambian can rely upon to ensure that justice prevails in the country. We appeal to all Civil Society Organisations, establishments that have a focus on women’s rights and empowerment and all well-meaning Zambians to defend Ms. Kasonde and the institution that she represents with all that they have within their legal abilities. She is such a strong and good leader who has represented her institution with dignity. As for Ms. Kasonde, we would like to ask her to avoid responding to clueless politicians so that she is not dragged in to cheap politics. Mr. Chanda should learn from other journalists who have found themselves in trouble whilst their masters are taking tea. He should not be too excited with his position.

Our further recommendation is that both the Judiciary and LAZ should remain calm as this phase too shall come and dignity will be restored soon. The PF should neither take us nor the Zambians for granted. If they can manage to silence the media they will not silence all institutions. We appeal to Zambians to defend our democracy of which one of the benchmarks is our judiciary. Not everybody can be the PF’s praise singer. We have brains we can think independently and point out the wrongs. As it is, PF is taking this country nowhere. They are too caught up in validating themselves as a political party that the business of everyday governance is running on autopilot. We need formidable institutions to offer checks and balances and LAZ should not be intimidated by the PF. They should remain firm and defend our constitution.

    • Pf has no problem with LAZ as an institution, nut Linda as an individual and some of her colleagues at LAZ.

      HH insulted the judiciary, specifically the three judges who refused to proceed with an expired petition.

      HH called them thugs, criminals, corrupt, thieves etc. Linda stayed mute.

      Linda wanted to join the case as friend of the court. When the court rejected her request HH complained accusing the judges of being biased. Why did HH make such sentiments?

      So NAREP needs to be objective in the criticism. If NAREP believe that Linda has been above board in exercising her rights and carrying out her duty as leader of LAZ they should rethink.

      NAREP should not encourage leader to destroy the trust people had in LAZ, and there by destroy the association.

      CRITICISM OF THE JUDICIARY IS LEGAL AND PERMITTED BY LAW. INFACT YOU CAN CALL THEM WHATEVER YOU WANT. THAT IS A RIGHT BESTOWED BY FREEDOM OF SPEECH. WE ONLY HOPE THAT WE ALL USE THAT FREEDOM RESPONSIBLY. THE DIFFERENCE BETWEEN WHAT HH MAY HAVE SAID AS YOU CLAIM AND WHAT CHANDA, CHANDA AND MWILA DID IS THAT THE LATTER THREE THREATENED COSEQUENCES AND ACTIONS THAT COULD ONLY BE INTERPRETED AS PUNITIVE. AS CITIZENS WE ARE ALL FREE TO CRITICIZE ANY ARM OF GOVERNMENT INCLUDING THE JUDICIARY.     • The Judiciary is not above the law … we have a history of even the Chief Justice acting unethically – does Justice Matthew Ngulube ring a bell to anyone over 23 years old here? The very own Chief Justice was found guilty of abuse of office among other things.

      To refresh everyone’s memory, FORMER chief justice Matthew Ngulube had in the FTJ’s pocket and even lost an appeal before the revenue tribunal against paying tax over funds he obtained through Zamtrop account when he was in office.

      We have stories of overzealous LAZ partisan officials also acting unethically while others used the platform to gain notoriety for personal ambitions. Now, I am as UNIP as they come but we have a history with these things … thanks a trillion

    • B R Mumba, Sr – Just so you know, Justice Ngulube was framed by Chiluba to compromise his independence and fair discharge of the law. Justice Ngulube is one very intelligent justice whose career was messed up by the powerful politicians in order to execute their evil schemes unimpeded.

Ms Linda Kasonde is simply defending the integrity of LAZ members. If you were the LAZ president, would you stand with your members when they are being threatened or you will praise the one threatening them? I do not support HH’s calling Concourt Judges names, but look at how the Concourt handled the petition case. On a Friday, they ruled that the case would be heard the following week from Monday to Thursday. Come Monday the same Judges change the ruling.     • There’s something wrong when a supposed winner is so thin skinned and cannot sleep because of minor criticism from citizens.       So even if it is PROVED in Court they rigged the election they will get off Scot free!

  8. Talking about LAZ, surely one does not need to be a rocket scientiest to see its political bias and associate membership of UPND. The behaviour of the Linda Kasonde led bunch LAZ and its chain of donkey connetions is open tosee. A case in point look at the disciplinary proceedings on Martha Mushipe following Concourt request. On three occasions Martha has not attended the hearing giving lame excuses, ranging from not feeling well to being too busy with court cases. She has not even given her exculpatory statement and yet LAZ keeps postponing the hearing. It is obvious yhat when the hearing takes place Martha will be found guilty and if her licence may be suspended. Now insolvent as she is that will.kill her practice as a lawyer, and kill her liveluhood. So because she is UPND LAZ will…

  11. The point is that those with instruments of power should not unfairly use those positions to suppress the rest. The Executive wing of Givernment has all the powers of military, security, and finance. They should not abuse the previlege they have to intimidate and suppress those without it, including the other two arms of Government, the Opposition and Civil Society.

    Amos was representing the Executive. He was abusing the previlege to intimidate the Judiciary. Amos Chanda should be condemned in no uncertain terms!

    UPND is a less previleded person just like any other citizen. Let them speak!

  13. NAREP party is too causal, PF is up to no good. But the response of NAREP shows too much weakness . That’s why the majority of Zambia wonder if you can form government. You act like civil organizations.
    I don’t mean those civil organizations like the one Ms Longwe is representing.
    UPND behaves same as PF but those who oppose PF they would rather go to UPND because they oppose PF actively and with immediate effect. People are looking for the alternative party which can put Zambia back on tracks.

    • Jay jay you are right. What is happening today is totally different from other resumes. If you analyze PF from its formation to the founder, it is based on miltancy and blind following.
      The founder all his lifetime was a vigilante or cadre who liked to bulldoze anything.
      If you remember well Amos Chanda was working for the Post Paper. Post was the campaign media for PF, all those chaps from the Post we’re given jobs in PF government. So don’t expect Amos Chanda to behave like a civil servant , in his life he didn’t dream to have that job. Amos has kiss his boss’s ass to please him.
      Remember Emmanuel Chilubanama was permanent secretary state house , he didn’t even know his duties, he was full time PF cadre with a team of thugs as his commander.
      That is the nature of PF violence.
