Mopani takes CEC to court for disobeying a court order

Mopani Copper Mines has asked the Kitwe High Court to commence contempt proceedings against the Copperbelt Energy Corporation-CEC- for allegedly disobeying a court order.

This is in matter in which Mopani has applied for a mandatory order in the Kitwe High Court to compel CEC to restore full power supply to the mine.

Mopani wants CEC Managing Director Owen Silavwe and Operations Manager Christopher Nthala cited for contempt for allegedly disobeying a court

Order.

The Court order was directing CEC to allow the Mine draw electricity of up to 2-hundred and 50 megawatts monthly from the various interconnections necessary for its operations.

This is According to an affidavit in support of ex-parte summons to support the application of the committal order filed by Mopani Copper Mine Company Secretary Goodwell Mateyo in the Kitwe High Court today.

CEC and Mopani are locked in a dispute over the revised electricity tariffs.

Mopani contends that the behavior of CEC and its officers undermine the course of justice and may seriously impair the standing and reputation of the court and the entire judicial system in Zambia.

On August 11, this year, Mopani commenced a court case against CEC for restricting power supply to the mining company following a dispute over tariffs.

Kitwe High Court Judge Timothy Katenekwa has adjourned the matter to August 30, 2017, in Kabwe.

  1. The solution isn’t at court but at the Ministries of Energy; Mines and Justice.
    Recall Development Agreements [DAs] the GRZ via privatisation?
    The then Attorney General, Bonaventure Mutale, Grant Thornton Managing Partner, the famous Hakainde Hichilema, and a guy called Valentine Chitalu, must be called to account.

    This high-level corruption bordering on neo-colonization for Zambia isn’t only a trapping but well calculated economic sabotage to pave way for the installation of a puppet regime for the Brothers of Guy Lindsay Scott!

  2. It’s very expensive to run the underground mine. Mopani is among the mining company paying contractors on time. KCM cobtractors and suppliers get paid 90days same as Lubambe Mine. You must look at how huge money cobtractors and suppliers get paid per month by Mopani. CEC is Sindole and Sindole,Milupi are HH supporters and they are trying to hit ECL (PF)

      I have hammered on this point and nobody is paying attention. I happen to have a few shares in CEC and I know their shareholding structure is dominated by UPND supporters like Hanson Sindowe, Executive Chairman and largest shareholder, and an ardent supporter and financier of the UPND and opposition figures like Charles Milupi. This information has been relayed to a number of PF bigwigs, but apparently they are not listening. Is the PF on a suicide mission? I suspect most of the bloggers giving one sided opinions and demonizing Mopani don’t understand this side of the equation.

  4. Facts and Skipper, how do you want CEC to sell power to Mopani cheaply when they are getting it at a higher price from Zesco? Also refrain from putting information out there without facts. This issue has nothing to do with political affiliation but an organisation selfishly desiring to rip off Zambians at all cost, including blackmailing the government. Remember the cost reflective increase has come as a government position, meaning everyone must fall in line as we all have done. All the mines have agreed, what is so special about Mopani?

    • And what is so special about CEC? I hope Mopani can purchase power directly from ZESCO as the mines in the Northwestern Province are doing.

  5. If they cannot manage paying for the services they get why be in business, for the food anyone eats he has to pay there is nothing for free .
    Better zambia has serious investors than some jokers who take advantage of the systems.

  6. The problem may not be with Mopani but with Development Agreements which Government signs with investors behind companies backs. Such agreements normally specify the time frame of very long periods during which time no adjustments can be made to the tariffs.
