Government issues Statutory Instrument to strengthen Public Finance Management Act

Finance Minister Margret Mwanakatwe has issued a Statutory Instrument number 42 of 2018 which brings into effect the Public Finance Management Act number 1 of 2018 which has been strengthened.

In a statement made available to the media, Mrs Mwanakatwe says the Statutory Instrument number 42 of 2018, the Public Financial Management Act (commencement ) order 2018, was gezetted and published by the Government Printer on Wednesday,30th May,2018.

She says it envisaged that with effective enforcement of the Public Finance Management Act no.1 of 2018, transparency and accountability in public finance management in Zambia will tremendously improve.

Mrs Mwanakatwe says incidences of misuse and theft of public resources will also be reduced and ultimately eliminated.

She states that this will have a positive impact on resource allocation and eventually improve public service delivery.

The Finance Minister adds that in accordance with the Act, any person who breaches provisions of the Public Finance Management Act no.1 of 2018 will be fined, suspended, demoted dismissed, or prosecuted, accordingly.

She further states that the Act gas been imbedded with provisions to facilitate the operation of the Treasury Single Account and the Integrated Financial Information Management Systems.

She explains that in this regard, the Act will provide a platform for further regulation of electronic financial transactions within the framework of Public Financial Management.

Mrs Mwanakatwe says this is in line with the Government’s e-government policy and is expected to reduce operational costs, improve resource allocation, promote efficiency in management of public resources, and enhance public service delivery.

She adds that with effect from 30th May, 2018, the gazette date for the Public Finance Management Act (commencement) order, 2018, board members of state owned enterprises and statutory corporations will individually and severally be accountable for their decisions.

She says this is aimed at improving the levels of decision morality,transparency,accountability,and integrity among persons in positions of accountability.

Mrs Mwanakatwe has further stated that the Public Finance Management Act no.1 of 2018 also empowers the Secretary to the Treasury to deal with non-performing Controlling officers and Controlling bodies

    • I don’t agree with a fine when someone has stolen public funds and or abused state resources.

      To completely eliminate that, fines should start from public prosecution and then dismissal. Fines are vehicles of corruption.

      You will deter a lot more people if this instrument is to achieve anything of substance

    • I attach a very low probability on its chances of success. Not when people are aware of plain theft of public resources and they still cannot take action.

    • It’s a case of closing the stable doors after the horses have already bolted. Zambian Govt is already BANKRUPT due to theft through loans for infrastructure.

      There’s nothing left to steal. BOZ has started eating into foreign reserves which are now paltry $1.8 Billion. They’ve even stopped publishing statistics on their website since LUNGU started destroying the economy.

      BOZ was getting loans to prevent Kwacha from the bleeding exercise. But for how long can you defy gravity?

      And back to Margaret, there shouldn’t be perception of leniency in this statutory instrument. By all means it should be a deterrent to anything perceived to be corrupt.

    • Why judge women by their looks? Do you know how much psychological damage you cause to women by that bad habit? Maggie Mwanakatwe isn’t finance minister because of what she looks like. Judge her by what she is doing. She cannot do anything about what she looks like. Besides she is a mother and wife of someone. Respect that if not nothing else.

    • Why do people think that Chipata is Eastern Province. It is the only Province in Zambia that in people’s minds is also called by the Provincial capital.

  4. There are other loopholes that need tightening. Seminars, workshops are such. Inflated hotel/lodge bills, exaggerated sitting allowances etc. These are difficult to catch but with will, they can be stemmed. One way is to ban use of private conference facilities and embed sitting allowances into salaries so that workshops become part of job description. We think and lets use our optimal brain functionalities.

    • Workshops are just the tip of the iceberg…Old man Sata tried to curb on them but hit a brick-wall as they are part and parcel of Public service development..its the misappropriation of budgeted funds and misuse of funds..these reckless foools simply wake up and get funds from Toll fees divert it to fighting cholera just like that without shame.

  7. Someone steals $1 million US Dollars to supply a Fire Tender worth $250,000 and you say when such is caught, they should be fined ZMW 10,000. Does that SI make sense on fines?
    It would have made sense if such white collar criminals are executed for their barbaric acts that are genocidally sending many Zambians to early miserable deaths!

    • Exactly…moreover to them as far as they are concerned that procurement and tender process was above board and clean even when the winning bidder had never supplied such equipment, the company was created less than two years ago and the equipment is $750,000 overpriced…..

Issues of paramount importance like this one dull cadres avoid like snails avoid salt…yet when it comes to voting in dull MPs to sit in parliament irrespective of party for 3 years shouting “hear hear hear” and receiving a gratuity of $100,000…they will type paragraph after paragraph yet they wonder why Rwanda is cleaner than the front of their yard.

  11. This is a good move but only if it is wholly implemented without fear or favour. Not when the person stealing happens to be a symphathiser of the ruling party and so you just give him a slap on the wrist. The punishment must befit the crime.

    • Mulenga:If that is your point, then beauty queens should be the ones to run our public affairs. What kind of thinking is that? Quarrel with Margaret Mwanakatwe on what she is doing or not doing in her job. Attitudes such as yours drive women to do apply all sorts of things on their faces in the mistaken belief that it enhances their chances in the relationships market. And the cosmetics industry and the beauty magazines it sponsors comes in to take advantage. Many women don’t know the hidden messaging in these magazines and they get phished.
