PATRIOTIC Front (PF) president Michael Sata wants to have Zambian Republican President , Rupiah Banda, impeached and he claims that he has the numbers from the opposition parties, independents and the ruling MMD to execute the process successfully. Mr Sata said President Banda has created several scandals since assuming office in November last year. Below are the four main reasons advanced by Mr Sata as grounds for impeaching the president.
- President Banda has breached the Constitution by appointing corrupt people like Ms Dora Siliya and Mr Micheal Mabenga. Ms Siliya was found with a case to answer by the tribunal, but was later acquitted by the High Court when she sought judicial review of the tribunal findings. Mr Mabenga has a Supreme Court ruling against him. The Supreme Court established that he abused about K30 million Constituency Development Fund (CDF).
- President Banda, through his government, wants to introduce a bill in Parliament to amend the Zambia Tanzania Pipeline Act to provide immunity from execution of judgments against the assets of the Tanzania Mafuta Pipeline Limited as well as provide for matters connected with or incidental to the foregoing.
- President Banda, through his government, wants to run away from paying the US$100 million dollars debt owed to ABSA of South Africa. On 29th June, South Africa’s Absa Group Limited , a subsidiary of Barclays Bank PLC sued Zambia for breach of contract involving more than US$74 million in the importation and refinery of feed stock.
- President Banda, through his government, wants to introduce two bills to create different salary structures for politicians and those for civil servants. The first bill is to empower the Minister responsible for finance to prescribe, by statutory instrument, the emoluments payable to the holder of the office of Vice-President, Speaker, Deputy Speaker, Cabinet Minister, Leader of the Opposition, Chief Whip, Deputy Chief Whip, Deputy Minister, Deputy Chairperson of Committees and Private Member of the National Assembly. The second is to make another salary structure aimed at making the minister of finance a paymaster for those in the Judiciary. This could compromise the Judiciary.

Though I know for sure the impeachment bid is bound to fail,the first three reasons are baseless but the fourth one carries some weight.The judiciary deserves independence from the executive arm. This all bid is ill-fated and I challenge Sata and His new Prince to talk to the people what they have in stock for 2011 and not was their on fruitless moves.
Despite the concerns, i dont any reason fit enough to impeach the president. Allegations and rumours fill our politians of the day. If it hurts people so much that Dora was reappointed to a ministerial position, why dont we get a clause in the current constitution to pin RB on that. How many times has Mr. Cycle matter or sorry M. Sata been accused only for the courts of low to find him with no case to answer? Does that mean then that Doras case should be any different. Governments proposal to review the salary schemes is not such a bad idea, if done wrongly, there are ways and routes we follow to highlight our convictions. Impeachment doesnt always work. Come 2011, peoples voices will be heard.

Precedure:
-it required the support of one-third or 53 MPs to sign and state the specific offence that the president had committed to introduce the impeachment motion in Parliament.
-after that, the motion would be introduced and exhaustively debated and could only be passed with the support of two-thirds of Parliament, representing 106 MPs.
In the event that such a motion was passed, a tribunal would then be appointed by the Chief Justice but even after its findings, the actual impeachment would need the support of three-quarters of the MPs.
Based on Mr M. Mabenga’s (Deputy Minister of Lands) case, RB is liable to impeachment.
The appointment of a corrupt person of Mr. Mabenga to a ministerial position defeats the whole purpose and effort of fighting corruption.
Therefore in the name of fighting corruption, RB can be impeached.
Sorry we can, but even the apoointment of Mabenga is not an ampeachable offence. for important is the opposition does not have the numbers. coz even just the 53 might be hard as for the 105 requireed to pass the motion, that is impossible. What I find amusing is that the so called undereducate MCS was able to generate some invalid reasons to impeach the president, while the learned HH could not come up with even a silly reason. Instead of wasting valuable time and other resources on groundless impeachment battles, the opposition should concentrate on making their pact a fomidable force for 2011.
Its is a fact that Mabenga is a hardcore unrepentant criminal and only a criminal can appoint such a dirty man into government. It is for this reason that RB should be removed from power before he completely destroys this country by appointing some more ministers from mukobeko maximum prison!!

Futrthermore not every offence, immoral act or wrong doing is a violation of the constitution. That is the way it is. And I repeat that more energies by us all should be put to working our way out of the economic quagmire we are in.
Looking at the numbers of the opposition, its unlikely that this motion will even be entertained. First Article 37 of the zedian const needs not less than a third of the national assembly to sign for this motion to be tabled. lets say they have about 60 MPs which is a good threshold, then the next is when the speaker tables this motion to be moved by the house, it will be subjected to debate and not less than 2 thirds are needed to support it for it to pass so the Sakala can appoint the tribunal and as you see the picture is too dim, with compromised sakala and his sangwa saga
Honestly these cannot be reasons for impeaching the president, i know this will fail. Even LPM who abrogated the constituition by appointing Nevers Mumba as VP was not impeached. The opposition should be serious.

The constitution according to Article 37 of the “Impeachment of President for Violation of Constitution” stipulates :
” (1) If notice in writing is given to the Speaker of the National Assembly signed by not

and specifying the particulars of the allegations and proposing that a tribunal be

According to this section, RB can consider himself safe.

As for me, I don’t support any political Party or individual politician. I support the democratic system. If the grounds exist for the impeachment of Rupia, the opposition parties should go ahead. As I indicated on #31, the case of moral reasons, herein “gross misconduct” seem not to stand as well because there are no clear pointers to as what constitutes “gross”.
Clearly, there is no constitutional violation in relation to this article (Article 37). That is the reason I finally concluded that RB is SAFE.

Legal brains out there, does one need an “impeachable” offence as described in the constitution to impeach RB. Isn’t a vote of no confidence sufficient if it is endorsed by 2/3 of parliament? That is my understanding, it can be for a general feeling of presidential unsuitability. It is highly unlikely that the opposition can get this support as they rarely work across party lines. The poverty in our country perpetuates poliical patronage because a Mp’s and Ministers cannot earn a living out elsewhere.

Impeaching a sitting president is well outlined in the constitution.
Apparently, the constitution provides only two reasons to impeaching the president.
1. Violation of the constitution
2. Gross misconduct
Your suggestion of the ” NO VOTE OF CONFIDENCE” as a basis of action cannot stand, because confidence boosting is not defined in the constitution. Even if RB was not performing(in national duties) according to the majority’s expectation, it would not fall under violation of the constitution or gross misconduct.
You see, it is the rule of law and therefore any reason apart from the two listed above are considered illegitimate.

Looking at the USA , Indian and our Zambian constitutions with regards to impeachment of the president or judge, it appears there are similarities:
For the USA case, a president can be impeached if found guilty of ” High Crimes and Misdemeanors against the State”.
For India, a judge can be impeached if found guilty of ” Misbehavior or Incapability”
For the Zambian case,a president can be impeached if found guilty of ” Violation of the Constitution or any gross misconduct”
I guess they are pretty the same. The Indian version could have perhaps made sense for the current Zambian scenario. RB could have fallen into the net of “Incapability”!
