NCC to continue sitting till 2010

Justice, has today told Parliament that the National Constitution Conference (NCC) will continue sitting up to 2010 in order for it to come up with a constitution that will stand the test of time.

Mr. Kunda was responding to a question raised by Chipili Member of parliament Davis Mwila who wanted to know how much money will be spent on NCC and how the disbursement of funds to the conference has been.

Mr Kunda told the house that about K52 billion has since been disbursed to the NCC for 2008.

He explained that the Ministry of Finance and National Planning gives the money to the Ministry of Justice, which is later taken to Bank of Zambia and then to NCC.

Mr. Kunda said government will ensure that the NCC does a commendable job and comes up with a constitution that will stand the test of time in order to benefit and serve the nation.

He further said about K50 billion was allocated to NCC for the 2009 budget, noting that this would be the last allocation to the conference.

He noted that government was committed to providing Zambians with good governance of the country and improving the electoral process to serve the nation.

Otherwise, make sure you finish your NCC work by 2010 as you have put it so that we will have real better democratic elections in 2011.

    2011 choice yaboola (has come) to all Zambians and for once, let us not make a mistake as we have been doing in the recent past.

  2. iyo kwena. U will see after 5 years they will again propose to change the constitution know that the government takes no time to release the perks for such, not anything to do with health care and poverty. There you will see the president walking like he is wearing cement shoes.

  3. GEORGE CAN YOU PLZ BE SPECIFIC. YOU OUGHT TO HAVE A TIME FRAME AS 2010 CAN ALSO MEAN DECEMBER 2010. WE HOPE YOU REALLY COME UP WITH A CONSTITUTION THAT WILL STAND THE TEST OF TIME BECAUSE ALREADY YOU GUYS HAVE CONSUMED A LOT OF MONEY AND YOU ARE YET TO DO SO.

  5. This doesnt make sense, Mr. Kunda. Worldwide, conferences are nonrecurring. The representatives meet only once to reach a conclusion and thereafter the conference is closed. It is only in Zambia where conferences or commissions are a lifetime appointment financed by poor people taxes.

  6. Money laudering, this is broadlight robbery by MPs. They go for NCC just to have a drink, laugh and get their allowances. Now they want to continue pick-pocketing from poor citizens to next year? How many rural clinics can they build from those allowances, my answer 2 clinics in each MP’s constituency.

Surely, do they need so much time as if the issues discussed are even beneficial to the citizens of zambia. Have they forgotten that such long conferences are costly to the nation. For them, it’s just another opportunity to make money.

It has to be well looked at in all angles. 2010 is just few months from now, i will only ask the Hon to dwell more on specifics rather just saying 2010

  10. This is a tactic inteneded to coincide with th 2011 elections. It is too early for MMD to put contetious clauses but the timing will be right just before the elections. clauses such as degree holder, no running mate, no 50 plus 1 etc. They fear decapaignining themselves and missing an opportunity to twist the costitution. Remember 1996 constitution which barred KK afew months b4 erections….!!!!!!

  11. Ba Kunda babuka. He has been quiet for a while as if he is not VEEP.
    Anyway, he talks as if he is not a lawyer. A constitution is dynamic and cannot stand what he calls “the test of time”. The constitution shall always be amended as need arises and due to changes in circumstances.
    Now Mr VEEP, why should the NCC continue sitting indefinitely or up to 2010. The job was already done by the many previous constitution review commissions so why should these ladies and gentlemen continue sitting for so long?
    And why should all committees be attending the NCC even when some have already completed their tasks?
    This is a waste of public resources.

  14. One probable reason for the MMD GRZ to push the NCC upto 2010 is that the NCC does not want to return the remaining money to treasury. A lot of ill-principled characters like to find all possible avenues to syphone money to their bellies instead of taking back to the relevant place that which has remained after the job has been done.

    However, the MMD GRZ is aware that the new Constitution has a capability to make or break the UPND-PF PACT and so they may be delaying to find an opportune time to catch the PACT napping in future. Unfortunately for the MMD, the PACT looks intact and well resolved on winning the next tripartite elections.

  15. we have heard a lot about ‘constitution which will stand a taste of time’ – give us a break please! personally i will never forgive Levy & Kunda for imposing this time & money wasting NCC on the Zambian tax payers, Levy is no more but here we are still paying for his arrogance and silly decisions as supported by selfish people like GK.

  16. #14 2010 is just a ew months away from now you say, but Kunda has not stated which month, maybe it be 31st December 2010 at 23:59 hours. Why should it take years, or even months to deal with a constitution when we all know what is required to be changed. Let sit until they are 90 years, who cares anyway. Whatever

  17. How much would it have cost the nation if the Mung’omba proposed constitution had been put to test through a referendum?

    The people’s wishes have been supressed by late Levy and you George Kunda, how do you expect your constitution with your NCC to stand the test of time? Kulilapofye nga pa mbale. Keep enjoying yourselves but you will not achieve anything beyond what Willa Mung’omba and his team achieved. Bufi ubo.

For those that are Lawyers or know law is there a way for Zambians to take these plunderers to court, is it a zambian’s constitutional right because they have taken Zambians too much for granted. They are producing a constitution that does not have the people of Zambia’s interest, they have rejected 50 +1 votes, they have rejected the vice president as a running mate, they have rejected Parliament to review loans that the Govt intends to borrow amongst other important amendment,yet they want to still continue until 2010 and continue abusing hard earned Tax payers money.If it is legal for Zambians to take the plunderers to court they also need to refund back all the money they have wasted on this futile exerecise.   21. measurable performance. This should be extended to everyone in Public offices, Zambians need to demand for accountability in the present not in the future after another Govt takes over. Those that know Law please educate and explain the legal alternatives available.

  22. Weren’t the Zambians told that the constitution revisions would be completed by June 2008. For those who are Project managers can someone explain to this Govt that there is something called planning and a lot of factors should be taken into account for a Project to meet it’s deadline. This constitution could have even been revised in a month, what are the justifications for this extension is it lack of manpower if so there is what is called manpower planning , the hours needed to fulfil a task should be planned for and solutions need to be put in place to make sure that the deadline is met by increasing the number of resources to finish the work and get rid of the unproductive ones.   23. the conference will not end…..MMD know what they are doing.so nomba in 2010 or 2011 just before election the outcome of the conference will be to adopt a constitution that allows presidential candidate with a degree……..this will put off SATA bringing the end of PF……….so MMD will bounce back………
    do you remember that Dr KK was sidelined from contesting in 1996 by Sata and Chiluba……..what goes around comes around….wait mark my word

    This is contained in the 2007 auditor general?s parastatal companies audit report.
    Public relations officer in the office of the Auditor-General, Ellen Chikale, says most of these financial irregularities are as a result of failure to follow tender procedures.

  26. Morning Pipo, Last evening at Lusaka play house I had the privilege and honor to lisyen to Prof. Clive Chirwa espouse his vision for MMD and Zambia. The man is just brlliant. However, most pipo (in the packed house) kept reminding him that MMD is not interested in him. He indicated that he initially had no plan plan-B away from MMD but the message is sinking that he is probably not need by sycophants in MMD. So, he promised to tell the nation his plan-B in the next few days and he says he is ready to work with any serious and progressive parties. Watch this space………….

Sensible Sata advised the NCC to wind up business and disperse, but they will not listen because they are using it as a legitimate way to plunder Zambia’s meagre financial resources, which would have otherwise been channelled to infrastructure development like paving township roads or paying Health workers and other government workers reasonable wages.

    What a heartless bunch of buffoons we have for leaders. Always scheming how they can bend the rules to enrich themselves and their bootlickers

  28. I just read ““The NCC Act has a provision for extension of the life of the NCC. Those of us participating in the NCC have found it to be very useful and we are learning a lot from there. It is important that we do a good job on the making of our new constitution. We shall continue with extensions and we shall extend in the interim up to the year 2010,” said Vice-President Kunda.” from the POST and really the italicised quoted part is very sad and unfortunate. This simply means that NCC may be extended to 2011 and even beyond — which proves that MMD GRZ is taking Zambians through a circus for their gain politically and in money terms.

  29. What exactly are people looking forward to in the new consititution. What’s the adoption process, what follows after the NCC sittings. When will it become operational. How different is it from the current.

  30. come on people! wot do you expect from politicians, bureaucrats and government? anything they do or participate in is ALWAYS over-budget, behind schedule and fcuk’d up!! these are not leaders, they are a gang of “sanctioned” plunderers. they don’t live or die by the discipline of the bottomline. neither do the parastatals – it’s wishful thinking calling these “gang” sub-divisions as companies.
    just vote china/taiwan in the next election. that should sort our future nicely.
    we need small-and-private businesses to develop health, education and basic infrastructure. expecting the government to develop zed is like expecting a baboon not to bite you in the a.r.s.e the moment you turn your back and bend over. think about that.

According to Times of Zambia, “The vice-president said that there were provisions in the NCC Act that allowed for the NCC to extend its mandate if the delegates felt that they needed more time… He was however optimistic the NCC would complete its works within the stipulated time frame and hoped that by September 2011, the conference could have concluded its sittings.” Does not inspire any confidence in the completion of the NCC Draft and ratifying a new Republic of Zambia Constitution before the next 2011 tripartite elections. This could because MMD want to use NCC as a campaign message aginst UPND-PF PACT to break it.

Following “This could because MMD want to use NCC as a campaign message aginst UPND-PF PACT to break it.” MMD seems to have realised that PF is against the NCC and new Constitution while UPND is for the NCC and new Constitution that might thwart honourable PF leader Sata MC (Grade 2/6, unknown)’s chances of being presidential candidate. Not having a new Constitution will boost the PF leader’s ego to stand on the PACT’s ticket while the UPND may opt to field president HH due to his non-dictatorial tendencies and good education and professional life that can inspire the Nation. This may break the PACT letting MMD enjoy marginal winning.

  33. Following “This may break the PACT letting MMD enjoy marginal winning”. Strange but MMD seems to enjoy ruling Zambians by divide and rule. Thus the UPND-PF PACT must prepare nicely to avoid falling into this trap by the MMD in order to dislodge them from power in 2011 elections or any other any time soon.
    With the above revelations by the Times of Zambia, I have stopped banking on Zambia having a new Constitution before the next 2011 scheduled tripartite elections.
