ZAIN was given 3G test authorisation-CA

THE Communication Authority (CA) of Zambia has said it legally issued the test authorisation to Zain Zambia to conduct trials for third generation (3G) services in the country two years ago.

And the CA has said Vodacom Zambia chairperson Enoch Kavindele’s interpretation of the injunction against the authority would entail plunging Zambia into confusion because most communication projects would grind to a halt.

Acting director – public relations and consumer affairs Ngabo Nankonde said in Lusaka yesterday the test authorisation was issued on August 13, 2007 before Mr Kavindele obtained any injunction.

Ms Nankonde said the authorisation was for establishing the usability of technology in Zambia among other things.
She said the authorisation of the trial, which would be conducted at no commercial value, was not in contravention of the injunction granted to Mr Kavindele.

Ms Nankonde was reacting to Mr Kavindele’s complaint on Sunday that the CA had issued Zain Zambia the 3G licences when the injunction restrained it from granting any licences relating to telecommunication until the matter was disposed of.

She said that the interpretation would have telling effects on the tele and mobile phone communication, banking, the national security and the aviation industry.

Ms Nankonde said Mr Kavindele seemed to suggest that the injunction granted to him restrained the authority from issuing or renewing licences until the discharge of the injunction.[quote]

“The above interpretation would also among other things, affect telephone communication, internet banking via the mobile phone, etc. leading to stagnation of national development,” she said.

The situation would also affect national security as the security agencies would not have frequency spectrum needed for their communication.

Ms Nankonde said other effects of the interpretation would be that the final migration of Frequent Modulation (FM) broadcasting band re-planning would not take place while aircraft registered in Zambia would not be able to renew their aeronautical licences.

She said the authority failed to understand Mr Kavindele’s motive saying interpretation would re-orient the social and security situations.

“We do not understand the intention of the former vice-president because the matter at hand is the fourth mobile licence and nothing to do with other licences and spectrum that are not fourth mobile related.

“In view of the above, Mr Kavindele’s interpretation would have adverse effect on not only the economy but also the social and security aspect of the nation,” Ms Nankonde said.

  1. Like waz said yesterday, Gen. Shikapwasha should seek an audience with Kavindele, the C.A and the Attorney General, brainstorm, and then issue a comprehensive statement for the good of all. Spare the public theze counter statements.

  2. They have just been caught pants down. The Pilot where conducted and Huawai has since been given the contract to deploy 3G for ZAIN.
    The 3G licence can not be issued on the platter. The 3G licences should be auctioned for and MTN, CellZ , Zain and any other interested party should bid and Win. We have not heard of how much ZAIN is gonna pay for the licence since they have already deployed and using the 3G for commercial use.

  3. Ms Nankonde has done well to shed some light on this complex issue. We cannot allow Vodacom to jeopardize the tele/mobile network, much less the banking, national security and aviation communication system. Kavindele better keep a low profile and give way to the lawyers from CA to analyse this matter and deal with it properly before havoc breaks out.

  4. I would like to express my GREAT DISAPPOINTMENT at the way the RTSA is operating in Lusaka. May be Mwalusaka and his entire team are full of theories and have failed to deliver to expectations. The patrol cars are very prominent on roads on saturday and during working days Monday to Friday they not seen on roads during peak hours 06:30 -9.00 and 1630: t0 19:00hrs. Its common to find them parked after 17:00hrs. I thought those cars are meant for patrols not for display at offices. Could PS Dominic Sichinga and his men and women in Road Transport Dept do something. It appears the guys at RTSA are only after Mini-Buses. Their presence should be felt by every motorsist. Last Saturday 8th Aug 09 they were all over Kafue road after 18;00hrs. There is nid to change the pattern of their patrols.

  5. This one of the main reasons we shall forever be a developing nation. Lets stop dreaming and get on with life. why bother when the end is near?

  6. Usually most car owners use public transport on weekends while other simply park and lessen their movements. I have bin observing these officers come saturday a convoy of patrol cars refueling on Great East road Northmead to mount uncoordinnated and wrongly timed patrols. There must be coordianted between Lusaka ZP Traffic and RTSA. During peak hours some drivers behave as though they are the only licensed road users. Talking of Mini-Bus drivers its hell. I urge those charged with the responsibility of enforcement of traffic laws to sit up. Unless I am mislead to believe that the patrol cars are for other ceremonial purposes not for enforcement. PS Sichinga need answers from your office on RTSA operations.

    Thus, instead of crying foul over Mr Kavindele’s correct right, the GRZ’s Judiciary should just end the Supreme Court or High Court injuction by Vodacom Zambia in a nice manner in good time.

    Let us not be emotional and follow the rule of law according to its dictates. All the best Mr Kavindele.

  8. There is no smoke without fire. Acting director – public relations and consumer affairs Ngabo Nankonde madam tell us the truth. Transparency is the key to this problem. You people you like eating with both hands. This is the result. Kavindale knows what he is doing and you dont. Fyamipesha nomba. Give Encok what he wants. He requested for it legally but you sidelined him. What goes around comes around.

  9. #6 Kapembwa, It’s not that I’m happy with the changes but I have come to learn that change is inevitable and that in every crisis there is an opportunity. The future belongs to companies that are willing and able to repeatedly adjust to new market conditions. Even without zamtel, the Zambian economy must be ready for industrial and technological transformation. Not every company can master this challenge and that is why some will either be forced to sell their shares or left behind.

  10. This case stinks of conflicts of interest. Thats the danger of politicians envolving themselves in the sale of government owned companies. A clear example will be if God forbid Dora was to apply for a 3G license considering what transpared in the Zamtel saga. Kavindenle will haunt his friends because he is using inside knowledge.

  11. I think its a good move Kavindele has made. And this for sure will definatetly mean that government wont sale Zamtel. All government needs to do its float shares and good management of zamtel
