Vice PRESIDENT George Kunda says government is not getting rid of the abuse of office offence but could not guarantee whether the offence will be contained in the revised Anti Corruption Commission Act.
Mr Kunda told Parliament yesterday that the abuse of office offence also exists in the Penal Code and that government wants to avoid the duplication of offences as it reforms the law.
He said government wants to re-align the law so that it makes sense by avoid duplication.
Mr Kunda said abuse of office would continue to be an offence in Zambia’s statute books, but that the offence will be contained is government’s pre-rogative.
He explained that there is need to update the laws so that they are consistent with the country’s constitution so that even accused persons can receive justice.
The vice president said government wants laws which are in accordance with principles of justice and acceptable to Commonwealth standards.
Government has come under heavy criticism from various stakeholders over its intentions to remove the abuse of office offence from the Anti Corruption Commission ACC Act.

He is not making sense to me this man. What is wrong with duplication in this case? I thought the idea was to strengthen our laws and not to dilute them? Are they preparing for something only they know? I say leave that clause where it is both in the Acc act and in the Penal code. Where we need to streamline and avoid duplication is the cabinet.
please help us who people have done law we ordinary people i failing to understand what Kunda is saying when the prepared ACC acts where not expert that now we should remove is (abuse of Offfice)
VP Kunda has no intentions whatsoever to backing down on this. He’s determined to weaken the law. And of course, RB is in on it too although no he’s busy trying to desperately mend his broken image, if there ever was an image in the first place.

Kunda what have you done that makes this mmd government so, jittery about the ACC act which has been in our statue books long before RB and Kunda tested the power of our country? To a layman like me this means, you are quilty of some unknown offences which you are so determined to sweep under the carpet.May the people who understand law in this counrty stand up and protect this act from removal by this desparate mmd thugs.
Even if you dont take it out, we will treat you and your many friends under the same clauses you changed and within the time of your stealing. Law can be manupilated-we will too for the favour of many zambians out there.

8&9, Just think of something else to make the justice system better for all citizens. Do not waste your time dreaming about a PF or PACT government because it cannot happen. 2011 is not for you. You guys are busy digging your own graves and at the same time hope to govern this country! You can’t have your cake and eat it. And from the various court cases and convictions, have you noticed that the opposition has its fair share of criminal minded people, it is not confined to the ruling party alone, as you would like us to believe. It is clear that in the unlikely event that you assumed power, all these vices would continue and maybe on a grand scale, given the history of some of your leaders.

No. 10 are you sure Kunda is making sence? Lets not piliticize everything, honestly speaking why should a government be weakening the law in the light of massive office abuse? All previous defence and security chiefs were caught napping by this same clause, cant you see something wrong here? I think you’re a wrong chap. While other nations are working day and night to strenghten laws and regulations its only in our country were we spend time trying to secure our hold to power and make laws that suit people in power. With this kind of double talk, how can you trust these guys on anything?! Why can’t he just be straight forward about it and us whether the “Abuse of Office” clause will be removed from the ACC act or not!! What is it that he can’t guarantee when he is among the people working on the bill to revise the ACC act!!!
Kunda knows exactly what they intend to do. He his simply buying time here. The same way they have done with the Mobile Hospitals and the sell of Zamtel, they wait until opposition sort of dies down, then they go ahead and do it. Same thing here!!!
