THE Kitwe High Court has sentenced to death a Kalulushi charcoal burner for murdering and raping a pregnant woman in August last year.
High Court Judge Isaac Kamwendo sentenced to death Innocent Kunda after he convicted him of murdering Anna Chimfwembe on August 10, last year.
Mr Justice Kamwendo directed that Kunda should be hanged by the neck until pronounced dead.
“I hereby sentence the accused to death in terms of section 303 of the penal code and direct that he shall be hanged by the neck till he is dead,” ordered the Judge.
In delivering Judgment, Mr Justice Kamwendo said the prosecution had proved the case beyond reasonable doubt and dismissed Kunda’s evidence that he did not murder Ms Chimfwembe.
Mr Justice Kamwendo noted that no one saw the deceased being attacked and that the only evidence was by a Mr Yorum Chola who testified in the matter.
He said as there was no eye witness to the attack, circumstantial evidence must be called and that Mr Chola was a credible and consistent witness whose testimony was not shaken in cross examination.
The Judge observed that Mr Chola had no reason to lie against the accused person.
Evidence in court was that on the fateful day, Mr Chola, a charcoal burner, heard a voice of a woman screaming in the bush and when he went to check, he noticed that a man had hidden behind a tree.
Mr Chola testified that as he was trying to peep, he saw the accused person who was popularly known as ‘sharpshooter’.
The court heard that ‘sharpshooter’ ran away and Mr Chola gave chase but slipped and fell down.
He later went to check on the woman whom he found lying down, injured on the face and head while blood was streaming from the head.
She was taken to Kitwe Central hospital where she died three days later.
And according to the evidence on record, Kunda unlawfully wounded the woman after raping her while the postmortem report indicated that the deceased had head wounds and was about five weeks pregnant.
In defence Kunda denied murdering the deceased and said that he went to sell charcoal and when he went to demand for his money from one of his clients, he was apprehended and taken to Kalulushi Police station.

I absolutely think its repuslive to have a death sentence. I do not condone what this man did, what does the Bible teach about the state putting people to death? If we can ascertain that then it doesn’t matter what philosophers, theologians, sociologists, criminologists and weeping, whining and whimpering liberals have to say about the subject. I do not think the bible anywehere talks of accepting death a death sentence, a lot of more liberal countries have ablolished it, and have used a ‘Life in prisonment without parole’ Why not do that in zambia

Principally, we have people sentenced to death, but Zambia has never executed people for a long time. It can still remain there as precautionally measure, to deter monsters! The crime this man committed cannot go overlooked, but the death sentence is harsh — cant we just lock him up for life. With state of our prisons, he is sure to die of natural causes sooner rather than later.
I guess living in the UK rubs on you, found myself shocked that someone should be hanged by teh neck until pronounced dead. It was no problem when I lived in Zambia but now feel it’s too harsh, a life sentence could be a better punishment.
I guess the environment we live in influences what we feel about death sentence.

Yes, the Bible does not allow killing people. It was an eye for an eye before Jesus Christ came. Not anymore. God has forgiven us thru Christ and we are required to forgive too, no matter the wrong. God’s will is that every human being accept Christ the saviour, thereby be saved from going to hell where they would spend eternity away from God, in agony.

The death penalty should be banned, especially cruel methods such as hanging. No matter how well the prosecution puts a case together, there is a chance that the accused is innocent. The state should not be involved in the killing of innocent people. Even the U.S., which arguably has more money to spend on evidence-finding and better legal protections for defendants, people are put to death who did not commit the crimes they were accused of. This case especially, there is no witness, no DNA evidence or fingerprints linking him to the body, there is too much doubt. I think the prison system in Zambia also needs to undergo massive improvements, but it’s better than stringing up a man without evidence he committed the crime.
For those who would like to bring the Bible into this, The New Testament focuses on the theme of redemption and changing one’s life, and I don’t believe that Jesus would say that the state should kill a man so he can be saved in the afterlife. Reform the prisons, reform the mental institutions (this man may have a mental illness) and reform the country so that poverty doesn’t provide a breeding ground for crime. There will always be criminals, but it’s much better to alleviate the problems that push people into crime and work to help them to leave it, while incarcerating the most incorrigible. I’d rather have a small number of people get away with a crime than have to worry that my government can sentence me to death without a fair trial.

How do you prove someone is guilty beyond reasonable doubt through an eye witness? or how do you sentence someone to death without circumstantial evidence?
