Former Evangelical Fellowship of Zambia Executive Director Bishop Paul Mususu says the suspension of the three Supreme and High court Judges confirms the need for separation of powers in the governance system of the country.
Bishop Mususu says the situation where the head of State is empowered to make such decisions might erode the judicial confidence in the country.
He says justice system might be compromised if such powers are left with the president.
He says judicial matters are some of the issues that need to be addressed in the constitution.
Bishop Mususu has also hoped that the tribunal set up by the President will not raise concerns of a pre-determined outcome as has been the suspicion with the commissions of inquiry.
Bishop Mususu explained to QFM news this morning that the tribunal should act in a very fair manner in order for fair justice to prevail.

Ba Bishop twapapata, research before you expose yourself. The Zambian Constitution allows that President to consitute a tribunal if a judge is found wanting. Its not the first time its happening in Zambia. Remember the renowed Judge Kabazo Chanda and his decision to free criminals who later committed serious crimes?
Its practiced in most commonwealth countries.
The suspension of the 3 judges by the president is a welcome move. The people who are against this move are those who have not taken time to visit the court and follow court procedings. indeed there have been a lot of misbehaviour by our judges in handling cases. If lawyers and others who understands law better than me have complained then it will be unwise for to say the opposite because even with my little understanding of law and justice i have observed the same

The problem with the three judges is the fact that all involve Mmembe the King maker. He is the one behind these changes and single handedly has suspended these judges using our president as the front. He would rather steal the money from the bank, what a shame. Mmembe should just pay back the money period. If the sells of his paper have gone down he should sate so.
why are pastor and priests so involved in politics?people in their churches should take this into consideration becoz these clergymen are supposed to be seekers of peace not a source of ostracism. they just make chaos in the country ehen people start arguing about their uninspired comments. nothing even changes when they comment. their is just pandemonium, is that what the peace loving god that they represent atually want? i dont think so. politics and god can never mix…..period. so these hypocritical clergymen should either join politics or turn away from these satanic acts of mixing god and politics.

You know the Bishop has a moral right to comment on these issues the same way the Catholics Bishops do. what Bishop is saying in case Chizungu capita apa! Is we need to limit the powers of the President to avoid the Executive interfering with the Judiciary which is an independent arm of the government. He is merely expressing the need to separate the powers. of the organs of the government arm. So Bishop Mususu you are within your rights and indeed limits to comment of this very unfortunate matter. The Bishop’s submission is implying that the President interfered in the Judiciary meanwhile he was just following the constitution. LAZ has confirmed that they were the complainants. So mufuna chani imwe
When I look at the constitution I see the president is within his right to do what he has done and nothing has violated the separation of powers… Can the “learned” bishop guide us as to his utterances??? Or was he preaching?

I strongly support what the good bishop is saying. Judiciary is supposed to be an independent arm of govt. Such actions by the president undermines it and gives the citizens less confidence that it can deliver justice. Our democracy is being stolen in broad daylight and we are degenerating into a dictatorship. A one man show!!

Sad day in Zambia’s governance. Where is the separation of powers The chief justice should have made the recommendations not this corrupt LAZ chaired by a corrupt Banda. This name Banda make me feel sick. Its either answering charges on corruption or plotting to assassinate an incumbent president. What a name Banda?
@2 Boss Wamphamvu, It is you who’s exposing your ignorance and not the bishop. The bishop is not questioning the legality of what the president has done. What he is highlighting are the excessive powers of the president. He is basically arguing that the power to suspend erring and corrupt judges should be vested in another office or body that does not fall under the executive arm of government to safeguard the independence of the judiciary. Well spoken bishop!
Separation of of power is more academic and theoretical than practical.There is no such thing as equality when it comes to power.Obama or the American president( NOT the Chief Justice) is the most powerful person not only in America but in the world.Why?A president is a president bane,respect!

Two issues; i) that Judge Mutuna transferred the case to himself from Judge Wood, without following procedure and ii) that DBZ had already withdrawn the case …..” LUSAKA High Court judge Nigel Mutuna has passed judgment against JCN Holdings, Post Newspapers Limited and Mutembo Nchito in a matter that has been discontinued by DBZ.
But Post managing director and editor-in-chief Fred M’membe said the judgment was part of a deliberate and desperate scheme to try and humiliate the three defendants.
This is in a matter where Development Bank of Zambia sued Post Newspapers Limited, JCN Holdings and Nchito in relation to the defunct Zambian Airways”
The bishop is right, I know the President has a right to suspend judges
But the real issue here ,Removing a high profile person like a judge , you have to come up with real proof,Conclusive hard evidence not just general thing like corruption, And tell us Zambian
People what they really did, Not just general thing of corruption, at least some truth ,too many

Imwe ba Maxine @20 surely you have been to school and have read this thread and other related articles. Do you think that the President has just suspended the Judges and it ends there? he has set up a tribunal were thier case will be reviewed and if found clean, will be reinstated.
Long overdue move by the President. Better late than never.
Couple of questions for His Excellency:
1. Why only this three?
2. Why not investigate all their previous judgements?
3. What about general state of administration of justice and redress to the thousands which have been denied legal protection? How come only selected few? I thought that justice was blind. Now it appears it can read “the Post”?
