
Patriotic Front Secretary General Wynter Kabimba has said that the calls by some opposition politicians to have Judge Lovemore Chikopa return to Malawi are misplaced. Speaking during African Freedom day celebration, Mr. Kabimba noted that Judge Chikopa has a constitutional mandate to fulfill and will only leave the country once the mandate to chair the tribunal is over.
Opposition leaders are demanding that Judge Chikopa returns to Malawi as the tribunal is not sitting due to an injunction that obtained by two suspended judges Nigel Mutuna and Charles Kajimanga.
On Thursday Zambian High Court maintained its ruling to suspend a special tribunal set by President Michael Sata to probe three judges he claims acted unprofessional in the case involving a $2.7 million loan to a local airline. High Court Judge Flugence Chisanga who dismissed the application on grounds that the application by the state was premature.
The state has not yet given a firm response to the Judgement or made public when it will take the next step. However, Attorney General Mumba Malila was quoted by the media as saying that the government will appeal against Lusaka High Court judge Fulgence Chisanga’s decision to sustain a stay of proceedings of a tribunal appointed by President Michael Sata to probe the misconduct of three suspended judges. “Obviously we are going to appeal, ” Mr Malila said.
Meanwhile, Mr Kabimba has advised opposition political leaders in the country to seek audience with the PF party or government on matters they feel they could be aggrieved.
Mr. Kabimba noted that it was also surprising for the opposition to shun celebrations of the Africa Freedom day saying the event should be used to signify the Unity of Africa and Zambia in particular.
Mr. Kabimba has questioned why the opposition political parties have resorted to expressing their grievances to the foreign diplomats’ resident in Zambia saying the diplomats are not here to represent the Zambians but their respective countries.
He adds that the one thing the opposition should understand that time is ticking before the 2016 elections saying the diplomats that they seem to be dating will not be relevant to them in the next elections because they are not voters.

I cant believe my luck! These Zambians first they give free fuel to my country which causes shortages for them and now they are giving me free money for doing absolutely nothing. Sata was not lying when he said more money in your pockets – for me anyway! They are so stupid that they are keeping here instead of letting me go back home to do my work for the people of my country seeing that a respected judge like myself would have a lot of cases to deal with. Anyway if they want to pay me for doing nothing why should I go back of my own free will, I think what I need to do is ask for the whole family to come over and get Kabipa and his cronies to rent me one of those big houses in New Kasama owned by GBM or Chikwanda or Sata himself although officially he only owns 7 guns.
Kabimba’s will never redeem himself from moron status if he continues thinking in this fashion. People want Chikopo to return because the review will take long to conclude and there is no need for the taxpayer to be yoked with the malawians hotel bills when he is doing nothing so far…..and i suppose he must have some work to do back home if indeed he is a good judge.
It is your time Kabimba which is ticking. 2016 will be here soon. Keep on campaigning like you are in the opposition.
Let the jugde from Malawi go back before he accumulates huge allowances from Zambia, we can use the little we have for our poor people, to hell, to Malawi.

@KACHIGAMBA you can not be serious. You can not expect to keep someone at tax payers’ cost in an expensive hotel for doing no work. Malawi is only an hour’s flight or so away and Judge Chikopa can always come back when the path is cleared for him to do his work. So what happens if grz appeals and the court of appeal and the case takes long to be concluded? Are you suggesting that in all this time the tax payer will be paying Judge Chikopa free money and paying for his accomodation and his security? It is the likes of you who do not have the country at heart.

The Malawian judge should humbly go back, to save the few dollars available.The problems in the judiciary are deep rooted and may not be solved by suspending three lawyers.There cases whose judgement has been pending for the last 7years, there people who are in prison because their cases have not been heard in court.The problems with our system requires proper analysis.Zambians are aware that he wants to cancel the 14billion debt and also to give jobs to friends and relatives.

In the game of chase, apart from anticipating your opponent`s move, you too have to consider the outcome/ consequence of your own move and, in this case, the judges who filed the injunction in a timely fashion, really outsmarted the government on this one, irrespective of the final outcome. They possibly did prognosticate and factor this side show in their move. For now, GRZ must be utterly despondent and in a conundrum.

PF never participated national events na its time that feel how it feels. Moreover, PF is not a unifying party and it is just right for the opposition to stay away from the cobra.

Those who think the opposition will wait for 2016 are misled. As soon as parliament starts to seat in the next two weeks, a motion of impeachment will be proposed. The opposition is currently compiling the constitutional breaches conducted by PF leadership. Instead of PF concentrating on finding ways to support their tribunal, they should be preparing defense by asking MPs to opposition the motion or better still, sympathize with the very courts they have so much humiliated. The game has already started and PF is on it`s defense while the opposition are on the attacking side. Let us wait and see. At the end of the day, the people will win. You can not defend criminals and get away with it.
You raise an interesting point. Nevertheless, to impeach the president, the MP`S will have to vote. Now, am not sure what the ratios are between the ruling and opposition MPS, can you shed some light?. Also, depending on the margin, Opposition MPS will have to be resolute; otherwise, some rebels will be targeted and bought for three pieces of silver. Remember when Chiluba was impeached, his abrogation of the law was so severe that the entire nation was in support and the vote was unanimous.

Block the tribunal. Corruption continues. Opposition parties are happy. Zambians are also happy or so they seem. Then more get corrupt since Judiciary can insulate itself. The next constitution should be more explicit on what to do with a corrupt Judge.
During his days in opposition His Excellency MCS would have not kept quiet on such an issue that involves tax payers money. Even Wynter himself could have lashed at Govt for incurring unnecessary costs. It is too early for PF to start emulating the extrvagance of MMD, who had closed their ears to credible civil societies and public voices. Let Chikopa go until when the matter is internally resolved by our Executive and Judiciary. We also want to hear the legislature, media and Church mother bodies help resolve this impasse.
So why don’t we give the tribunal a chance. I am not even apolitical but have friends from Burundi and Rwanda, Angola, Bosnia, the Czec republic, hong kong, china etc and I have seen forehand what misunderstandings can do to a country. Why is everyone trying to defend the 3 judges and at the same time vilify the commander in chief of Zambia who happens to be the president. After all, they are innocent until proven guilty. Why are we doing this to a fellow Zambian who happens to be the president. We voted for change and lets give change a chance to either succeed or fail. There is a very clear process of dealing with judges who go wrong. This is contained in the Judical complaints Authority.
That is why importing a judge was a problem.
Why import a judge, a homo, to come and try Zambian judges who had not gone through a procedure established by law?
