
The Zambia Congress of Trade Unions has strongly condemned government for u-turning on the application of the controversial Pubic Order Act.
But Chief Government Spokesman Kennedy Sakeni has maintained that the Public Order Act is relevant as it helps to maintain public sanity.
ZCTU General Secretary Roy Mwaba said it is disappointing that the PF government is now in support of an archaic law which they condemned whilst in opposition.
Mr. Mwaba said the Public Order Act is a colonial piece of legislated that should be done away with.
“We are worried as the Labour movement that one of the bad laws you condemned when you were in government was the Public Order Act, we are concerned that you are now embracing this law. I think this is one issue that you need to relook at.”
“The Public Order Act is archaic, undemocratic and today it is the opposition being prevented from meeting and tomorrow it will be the labour movement,” Mr. Mwaba said.
The ZCTU General Secretary was speaking in Lusaka today during the opening of a three day workshop organised by the Labour Media Project which was officiated by Information and Broadcasting Minister Kennedy Sakeni.
But Mr Sakeni defended the application of the Public Order Act adding that the law is critical to maintain public peace and order.

“People want absolute freedom, there is no absolute freedom anywhere, you can’t just allow people to be assembling anyone as they wish, that will bring anarchy,” Mr. Sakeni said.
“Freedoms must have limitations, if you give absolute freedoms, people will start walking around naked and there would be no pornography, sodomy and all that.”
And Mr Sakeni has said that the Freedom of Information (FOI) bill will be dealt with within the next two sittings of parliament.
The minister called on the media in the country to effectively highlight labour issues in order to raise awareness among the workers and other stakeholder

MMD took 20 yrs to receive their RED Card but what i see is like PF will get theirs soon. Public order act is an ancient law that does not fit the modern day political dispensation in which fredom of assembly and association done within the cnfines of the law is the undisputable human right, PF please you r taking us in the stone age. Mr Sakeni knows nothing about the public order act. Sakeni should read the Musakanya papers to understand what the law was meant for by the colonial government and for how long it should be in force. Musakanya lectured the supreme court as a lay person who was very conversant with the law as an administrator of the law when it was effected. Virtually he presented himself as an expert on that law even though he was not a qualified lawyer in the 1980s.

You are contradicting yourself in a major way for example, in your first paragraph you seem to be supporting Sakeni albeit you are still unsure of him because he is unreliable. The premise you attributed to that, is that it is because he is a loose canony. Note that in the second paragraph without quotation marks you are not clear at all except that one has to guess as to what you were trying to convey to your recipients. My guess is that you are opposing/deconstructing what you initially stated in your earlier rantings. Your entire post has blunders similar to blunders made by a drug addict. What drugs are you consume there in Europe. Here in South Africa we drive nice expensive cars and it is easy to buy houses and cars.Everything is readily available unlike in Europe.

The POA is necessary in Africa and Zambia in particular.This law restricts retards from taking the law in their own hands as they may misunderstand absolute freedom.Our behaviuor as africans with low literacy levels and low public decorum we need to be regulated in the way we conduct ourselves.We behave like wild animals.For example,any simple protest gathering can turn into agree affair with crooks pretending to be advocates taking advantage to cause anarchy not in tanderm with the objectives of the gathering.We may remove POA,but some other regulatory laws can come into place.POA is not bad on face value but taking advantage by powers that be is what is wrong.The opposition should also exercise restriant in their quest to practice the freedom of assembly.,

I think the PF have seen how careless some Opposition Leaders like HH can be, hence they know that if they allow absolute freedom then it will be very easy for people like HH to organise Lozis to rise against the Government on the pretext of not having fullfiled promises of the Restoration of the Barotse thing. On one hand, the Public order act is good but when it is abused the authorities to supress the people with divegent views , it become a very bad law. Two of the hallmarks of integrity are truthfulness and consistency. PF have changed their position on the POA without so much as an explanation or an apology. The least that the PF could have done was to modify the act by making it less susceptible to abuse by the police or politicians. This lack of respect to the expectations of the electorate will not be tolerated. Anyway, what can we expect of the likes of Sakeni who was one of the chief bootlickers in the Chiluba government.
The reintroduction of the public order act is no surprise to me. Fellow bloggers, just understand that every incompetent government will do anything to repress any dissenting views especially from those in opposition. The ruling party will have to shield itself by enacting laws that will serve its interests. By the way Mushota, I like your description of that loose canon…..
