Revocation of RB’s diplomatic passport is illegal-Elias Chipimo

National Restoration Party (NAREP) party President Elias Chipimo has asked the Government to hand back former President Rupiah’s diplomatic passport without delay. In a statement released to the media today, Mr Chipimo said that it was illegal and improper, but also undermined the separation of powers set out in the constitution

HAND BACK RUPIAH BANDA’S PASSPORT WITHOUT DELAY

The decision by the PF administration to revoke the diplomatic passport of former president Rupiah Banda is not only illegal and improper but it undermines the separation of powers as set out in the republican constitution.

As a matter of law and procedure, therefore, the government should immediately hand back President Banda’s passport in order to uphold the law, preserve the integrity of parliament and maintain whatever goodwill Zambia is still able to muster amidst a long and ongoing series of social, political, economic and diplomatic blunders.

The Benefits of Former Presidents Act, passed by Parliament makes clear that every former president is entitled (among other benefits) to a diplomatic passport along with one return air ticket for such former president and their spouse.

The only instance in which any of the benefits of a former president can be revoked is if Parliament decides by two-thirds majority to do so. Parliament can only take such action if the former president has been convicted of an offence and sentenced to imprisonment for more than 6 months. This is clearly not the case.

The action by the PF administration amounts to a violation of the separation of powers as contemplated under our constitution. Should the government fail to hand back former president Banda’s passport, Parliament must immediately take this matter up as a breach of our constitution.

It is imperative that the Speaker of the National Assembly demand an explanation from the Minister of Home Affairs as to the legality of this action. Should Parliament fail to act, the courts will be able to intervene.

The office of the former president is a national institution that deserves dignity and respect. The current court cases against President Banda are not sufficient to grant power to remove the privileges accorded to his office as former president.

The more we undermine this office through these types of actions, the more we undermine our goodwill and standing as a nation. The more we undermine our standing as a nation, the less investment we will see, which will translate into less employment for our abandoned youth who have long given up on the promises that were made to them during the last election.

Unless we change the current trajectory of events I worry that history will judge us harshly.Ministers are not to supplant parliament by legislating from their offices.When President Sata took office he took an oath to protect and defend the constitution of Zambia and that included the separation of powers.Its time PF restored respect for the law , restraint of power and showed some humility.

    Advice to Mr Rupiah Bwezani Banda:_
    Micheal Sata is playing dirty politics, the only politics he knows.
    Banda qualifies for 2 more 5 yr terms of Presidency. As far as Sata is concerned Banda wil never enjoy retirement. it is, therefore, pointless to stay out of politics when the PF wants him in. President Banda, we have already seen that these PF, 90 DAY Government, has failed right from the start. Agriculture is on the way to death, Democracy is dead, fuel is double as compared to neighbouring countries. All these are signs. Wait & see what they will do to the Constitution, they might remove the 2 term restriction for Sata, the third_termer. So Banda is sitting back & watching his limbs being cut_off. Next it wil b his hands, his head.

  13. Whatever RB has done he deserves a Diplomatic Passport. Where have you seen a former head of state using an ordinary? I suggest that the Chief Immigration Officer should be fired for his incompetency, unqualified and failure to carry out duties in a professional way with due diligence. The chief immigration O needs to apologize to the nation & to RB. It’s a disgrace for PF Government for this behaviour. Give RB back his Passport. Remember Chiluba mistreated KK and that is the way you want to treat RB. Yes, RB has been accused if found guilty he will be punished, but he needs to be treated with respect. I support PF Gov. to probe RB, but not to mistreat him. I can’t understand this trash. President Sata should move in & stop the trash. RB is former President give him respect.

  18. Most of the bloggers seem to have forgotten about the quality of reporting on this website. Govt is justified to withdraw a passport from any fugitive. This does not mean that RB will not be issued with another Diplomatic passport in future; of course he is entitled to one.

  19. Honestly some times you just wonder who voted for these animals in the first place. Who votes for PF in these by elections? They should release his passport immediately. If they were keen on on confiscating his passport the matter should have been tabled in parliament. The government has broken the law. And for those of you saying RB is a fugitive, he is not. His not on the run. We are slowly becoming an autocratic dictatorship. This situation is made worse by a very weak opposition who it seems could be wiped out anytime soon.

  20. If Mr. Chipimo is right and his argument is based on law, why not challenge the withdrawal in court? Does he also believe that the courts will be biased against RB? As a lawyer, it is important that Mr Chipimo directs Mr Banda to the options available to him, not just making statements to the public. Having said that, Mr. Banda was no respecter of Law, a man who was keen to undermine the constitutional foundation of fighting corruption among government officials. A get rich quick President. These people have to be accountable at some point, including Mr. Sata!

    In advanced societies, promising to uphold the constitution is a matter of life and death. When the same is abrogated, “check” systems suddenly spring to life, to safe guard the supreme law, by which the President swore an oath to uphold.

    In Africa and particularly in Zambia, the supreme law is impunity and delusion. When the constitution is abrogated with glee, patronage such as some comments above, reign supreme and so called “check” systems simply go to bed. Which Court? Which Parliament? In Zambia? Are you joking? They hardly exist anymore man!

  27. RB IS TRYING TO SEEK SYMPATHY HERE. RULE OF LAW IS IMPORTANT . BUT THE SAME LAW NEEDS TO BE INTERPRETED BY LAWYERS. AND ONE THING IS CLEAR. LAWYERS DONT ALWAYS SAY THE SAME INCLUDING JUDGES.
