PF challenges ECZ to bar Dora Siliya and Maxwell Mwale from re-contesting their seats

The Patriotic Front has challenged the Electoral Commission of Zambia to explain why it has not invoked section 22 of the Electoral Act which bars candidates found guilty of corruption from re-contesting their seats.

PF Copperbelt Provincial Secretary Chanda Kabwe says it is a serous act of hypocrisy for ECZ to raise issues on the airing of a PF political advert while remaining silent on serious matters.

Mr. Kabwe wonders why ECZ has been allowing some opposition MPs who lost their seats for corrupt practices to re-contest their seats.

He has cited the re-election of MMD’s Mtolo Phiri in CHIPATA Central among other cases. This is contained in a statement released to media news by Mr. Kabwe.

The Transparency International Zambian Chapter on Tuedsay raised concerns over the same matter.

But ECZ Director Priscilla Isaac has promised to respond to the TIZ concerns in due course.

      Dora has NOT been found guilty, her case is still before the court.. she is innocent until proven guilty before the court of law!!!!!

    • PF has so many worms, open the pot and see how Gabriel Namulambe, the Diploma forger Steven Masumba and others would be dragged to court under section 22 of the Electoral Act of Zambia.
      Still on corruption, go beyond Electoral Act of Zambia, the DPP Mutemba Nchito is corrupt AND a fraud ( He forge Judge Gregory Phiri’s Judgment ,contrary to Chapter 87 , Section 373 of the Penal Code, and lied to Parliament select committee-contrary to parliamentary rules , 14 billion DBZ theft and false pretence ,Contrary to Chapter 87 Section 264 ,265 and 266.).
      Madam Lombe Chibesakunda is an illegality; she’s nearly 69 years, contrary to Article 98(1) of the current Constitution which stipulates that “a judge of the Supreme Court ;shall vacate that office on attaining the age of sixty-five years”

    • PF has a big logs in its mkundu yet it wants to make other parties see the tiniest logs in their eyes.

    • Unless a candidate stands as an independent candidate,there is no way a candidate who is sponsored by a political party can directly be responsible for the campaign conduct of the sponsoring party.It is why an MP elected on a Party ticket loses a seat whenever such a person is expelled from the party that sponsored them.A seat in Parliament is viewed as a Party seat unless it was won as an independent candidate.Dora and Mwale held those seats on behalf of MMD.If there are sanctions to be imposed,they should be on the Party concerned.

    • The MAN HIMSElf floated the constitution by allowing unconstitutional person to run consttituion offices as well as appointing persons. He currently facing litigations by three top police officers etc, insults people and oftern brings the names of free citizen into riducle.

    • Boss, hold on to the pre-mature ejaculation as these innocent souls have not been convicted by a Court of Competent jurisdiction of any criminal offence making it premature for Sect. 22 to apply.

    • Was mtolo convicted? If so what was the sentence? Dont just read the act but comprehend. The courts ruled on the electral process. just face it yalula nkhani

  6. doesnt the section they are quoting tune that if the dude or dudette contensting the seat was found guilty of a crime and convicted, then said dude or dudette does not qualify to stand? Did i miss the news where they announced Dora’s guilt and conviction?

    • They may not have been convicted yet but they were found guilty and it was on that basis that the results were nullified by the court.

    • The cases being referred to here is election malpractices and not the other big cases which both Dora and her colleague Maxwell are well known for, for these one you have not missed the news as the results are not yet out.

  10. This is what happens when the supreme court abdicates respossibility by passing flimsy judgements. This just become senseless.

    For example, just how do you explain the tribunal case which starts at a lower court, goes to the supreme court as its resting place, but somehow works its way back to the lower courts again and now starts making a second trek back to the supreme court?

    This is crazy and unheard of. Only in Zambia with Kulima Tower and Matero University graduates at the wheel can you get such Schizophrenic behaviour in the system.

    Anyway, PF come September 5th, you are wining NOTHING and Zambians one day will send the bill to you for the by elections and it shall be repaid with interest.

    why are the seats nullified? this means those are not fit to recontest not until after five years

    • The elections were nullified because the ELECTIONS (not candidates) were not free and fair or not conducted in a free and fair manner,… so it was the system of election or the election which was convicted and found guilty not an individual… that why a re-run has been order.

  24. No one has been found guilty of corruption by the courts, they just nullified their election as MPs. Its up to ACC to follow up the cases and prosecute. If found guilty then they can’t re-contest.

If a person accused of winning the original election through corruption runs again in a by election and wins with even a larger margin, it means the courts probably got it wrong in nullifying the results of the original election. The more such results you get obviously means the problem is with the court decisions rather than the electoral system.

    • I disagree. I think the general populace votes on emotion. If their perception of the candidate is favourable, a good majority will disregard prior court convictions.

      Especially when you consider they may not have access to the pertinent info accessible via the various forms of media such as the Internet. They may simply vote based on the candidate’s own rhetoric.

      Besides, what is corruption to you and I manifests itself as a the bicycle they would otherwise never have had.

  38. The say vinabwela mochedwa vachizungu : translation white peoples westernization arrived late. For my Bemba traditional cousins even basic English has not arrived yet. Someone translate all laws bylaws and traditional cultural texts to all 73 languages of Zambia, but add pictures and cartoons to the BEMBA one please even their own language might be too difficult for their chitemene soil erosion ways ROTFLMAO.

  54. When the courts of Law found someone guilty of malpractices, they nullify the seat and declare it redundant. In this case, both Dora and Mtolo are corrupt!! ECZ is just a stupid institution failing to understand the codes that themselves they have put in place.

So much has been said,individuals have been torn apart because of political inclination.Such important issues people need to look at it with sober minds.This does not need a lawyer to read out to you,the Electoral Act 22 is very clear because it does not depend on the conviction but even on the report from the court which nullified the election of the MP. ECZ should have acted .The problem that the current Govt is facing is that in most public institutions the office bearers still have the MMD mentally of doing things.This is a challenge that PF will continue to face but they should stick to their road map to develop Zambia.

  60. Why is Kabimba still serving as a minister? Because his case of oil scandal is an allegation and has not been found quilt by the courts of law, Dora Siliya has not been found quilty by the courts of law either it is still an allegation. So bwana PF what is your problem? Dora can still contest and so are all others who’s cases are still allegations Period. Unless we begin to understand these things our country will remain forever in the fourth world quagmire.

    Is bribing an MP to change camp and cause a by-election not a criminal offense? why does your party accept such individual whose brains happen to operate from their bellies?

  62. The PF know too well that Ms Siliya and Mr. Mwale are well rooted in their respective areas of Petauke and Mambwe Districts. Kaweche Kaunda whom the PF is hoping to re-field in Mambwe, is not known to the peoples of Malambo. Kaweche is merely posing as a commercial figure hoping to milk parliamentary salary.

    The entire Kaunda family has no stake to the Kunda peoples. KK’s neglect of the mansion facilitated and built by the UNIP govt at Jumbe on the bank of Lutembwe River is currently the breeding ground for rats and mice. The KK family preferred to invest their fortunes in South Africa and Zimbabwe. Hence PF’s pretext of attacking the ECZ to save face. If PF has candidates of credible integrity, the ruling party must just pluck up courage to face Dora and Maxwell.
