
Government has revoked the working permit for Konkola Copper Mines (KCM) Chief Executive Officer Kishore Kumar and declares him a prohibited Immigrant.
This means that Mr. Kumar will not, at any given time, be allowed to enter the boarders of Zambia.
This follows Mr. Kumar’s evading of a meeting that the Ministry of Home Affairs had asked him to attend to ascertain a statement he made in the media to describe as mere rhetoric President Michael Sata’s warning against firing any workers at the mine.
In statement released to Qfm today, Chief government spokesperson Mwansa Kapeya says following this decision by government, all law enforcement officers, at all border entry points, through the Ministry of Home Affairs, have since been notified.
Mr. Kapeya says government is of the view that Mr. Kumar is a bad seed and cannot be allowed to continue being among the business community in the country.
Mr. Kapeya who is also Information and Broadcasting Minister notes that government’s position on this matter does not mean that it has now declared war against investors as some sections of society are trying to portray.
He says as a sensitive and responsible government, the Patriotic Front (PF) government wants to ensure that the interests of both the Zambian people and investors alike are protected and adequately taken care of.
And Mr. Kapeya has maintained that government is still remains open to dialogue on any matter that affects the country’s investors and the Zambian people who must be the prime beneficiaries of such investments.
He says government also remains resolute to protecting the best interest of the people in the country regardless of the circumstances and will not allow threats and intimidation from any investor.
The Minister has however assured investors seeking to come to Zambia and the already existing investors that their investments will remain secure and safe.

I was recently at two board meetings and three business association meetings. And top on the list was the KCM issue. I can confirm that business now feels that they are being harrassed. Cited at these meetings was the shoprite saga, kcm tax assessment and general harassment of business and bullying by PF. That is the sentiment out there. Deal with it. Dont deny it.

Immigration and Deportation Act [ No. 18 of 2010 165]
Section 35 states that: Any person whose presence in Zambia is declared in writing by the Minister to be inimical to the public interest shall be a prohibited immigrant in relation to Zambia.
Subject to section thirty six, the presence within Zambia of any prohibited immigrant shall be unlawful and such person shall be arrested without warrant, detained and deported from Zambia in accordance with this Act.

I normally don’t welcome Govts interfering in private business and the private sector. However, these investors in Zambia do take advantage of both the Govt and the Zambian people. Mopani is South Africa and Zambians while at Luanshya Mine, the Chinese are present. Why should these be the case if the investors are “transparent” and willing to promote the interests of Zambians?
The problem is with govt. Their policies are chaotic. Nothing is clear. Each investor is treated differently instead of having universal standards. They must clean their own house first. Imagine the minister of finance removed duty only to be told by the president the following day to reinstate the statutory instrument. So we don’t even know who is in charge of govt budgeting. The other time PS issues nationwide licenses the next day the president revokes them. Total confusion. It’s a circus. This is a jungle government!
Try doing business with a so called Zambian Supplier and you will understand why mining companies are not in any hurry to use them. As Zambians, we need to up our game and stop always relying on government to protect us like little children. However, since then, in my books PF has been able to implement the most courageous set of economic policies that will change Zambia for good in the long term. If Zambia had detained Kumar unjustly the Indian State had a right under international law to mount an attack on Zambia to rescue their national under the doctrine of self defence. I dont know in what context your comment is, however, i would like to state that Zambia is a light years away to be compared with a developed world in all undertakings. A developed worlds way of business is outlined and dealt with in such a manner that no jim and jack can dare bend the rules even after sharing countless champagne glasses with the President or the CEO, in the developed world business is just what it is, regulations and terms of the contracts are strictly adhered to on top of that diplomacy is very important.
Reading the comments above I have come to the inescapable conclusion that many Zambians believe that it is right to flaunt power in the manner our government has done in the case of Kumar. Kumar has committed no crime neither has he done anything that is inimical to Zambia’s interest. The President know very little about business ,running a mine can not be compared to the way he is managing his useless and big cabinet. Zambians pay salaries for the most corrupt cabinet in Southern Africa. Diplomacy is what has avoided wars between countries and promoted peace. Presidents should act on behalf of their citizenry and not on a personal level. A note verbale to the High Commission of India would have spared the Indian government a lot of shame. We should desist from calling people names on the basis of their race. We pray that the Panga Fellows (PF) will not turn their pangas on investors. The PF are playing on the psychology of the vulnerable people who do not understand the dynamics of national economics. The PF should have used the services of human resources with best brains to negotiate with KCM rather than resort to political rhetoric to appease its followers.
Steps to instil confidence:
(1) President Sata must fire Kabimba, the culprit who started the war of castigating his PF colleagues in public.
(2) Condemn the PF panga-wielding youths involved in violence resulting in deaths of the youths in Lusaka.
(3) President Sata must make mends with Bemba Chiefs whose subjects constitute his greater constituency. Kabimba, Mmembe, Chief Nkomeshya, Masebo etc are just mercenaries.

Take or leave it, assuming that Vendatta decided to leave today, there would be more job losses than what Vendatta could have have preserved under the current status of the company. Do you know why the kwacha is losing value every hour despite measures put in place by government? is there a law that prohibits industrial restructuring and manpower realignment? Government must learn to do things by the rules and laws. this rule by man will harm Zambia in the long- term.
