
ACTING Chief Justice Lombe Chibesakunda is today expected to swear in three members of the tribunal to probe Justice Minister Wynter Kabimba over alleged breach of the oath of secrecy. The tribunal was supposed to have been sworn in by President Michael Sata last week.
Last week, the president took Government officials to task over their failure to present members of the Tribunal set up to probe Justice Minister Wynter Kabimba for the alleged breach of secrecy.
The members comprising Justice Evans Hamaundu, Justice Gertrude Chawatama and Justice Justine Chashi were to be sworn in by President Sata but were not present.
As soon as Mr Sata entered the room, he demanded to know the whereabouts of the members of the Tribunal from the senior Government officials who included Foreign Affairs Deputy Minister Gabriel Namulambe.
“Where is the Secretary to the Cabinet and where are the members of the Tribunal? I said I wanted to swear them in today, so if they do not come today then that’s the end, l will not swear them in,” Mr Sata said.
He then directed officials to avail him the members of the Tribunal for swearing in but later a State House official announced to journalists that the swearing-in ceremony for the Tribunal had been postponed to a later date.
Ms Justice Chibesakunda last week appointed a tribunal to probe Mr Kabimba over allegations that he abused his office and breached the oath of secrecy.
She said in her letter to the chief administrator of the Judiciary that she had no objection to the setting-up the tribunal to probe Mr Kabimba.
Ms Justice Chibesakunda will swear in the chairperson of the tribunal, Supreme Court Judge Evans Hamaundu and two High Court judges Gertrude Chawatama and Justine Chashi.
The swearing-in ceremony is scheduled to take place at the Supreme Court and will give indication on when the tribunal will commence proceedings.
Ms Justice Chibesakunda is also expected to give the terms of reference of the tribunal.
Former Solwezi Central member of Parliament (MP) Lucky Mulusa and civil eights activist Brebner Changala petitioned Ms Justice Chibesakunda to establish a tribunal against the justice minister.
They wanted the tribunal to state whether or not Mr Kabimba abused his office by using Government information rendered by Solicitor General Musa Mwenye to allegedly back up PF cases attempting to block parliamentarians whose seats had been nullified by the Supreme Court for engaging in corrupt practices.
The duo has indicated that it will call 11 witnesses to testify in the matter.

Is that tribunal another thing set just for face value? Because its impossible for Hamaundu and friends to accuse Injustice Minister Kabimba.
After-all thats why they didn’t want to be fooled by Sata, they would rather fool Chibesakunda, by saying “ok.. mwefipuba fimunshololwa, what do you want us to tell Kabimba”?

I was wondering the same. Why is Wynter not resigning so that he can be probed properly? This only means one thing, the tribunal is a cleansing process…the judges will find him not guilty and the PF will say, you see we respect the courts process – we are the best!
Justice must be seen to be done – the tribunal process will just breed further hatred for the PF

In order to have a fair investigation, shouldn’t kabimba be suspended first?

Surely as soon as the Tribunal Members are sworn in we expect Wynter to step down. In case he doesn’t, then I would urge the Petitioners Mr Mulusa and Changala to write to the Acting Chief Justice stating that for the inquiry to be seen to be fair and unfettered, Wynter needs to step down. Of course various precedents including the Dora Siliya can be cited in support of this position.

The Justices on this tribunal are credible and competent. Rest assured that they will give Wynter a very tough time. If he doesnt step down on his own, I see the Justices raising that issue with the appointing authority – which will give Sata a credible excuse to have Wynter step down ( as Sata seems powerless when it comes to Wynter) .
I see the Tribunal making key recommendations with far reaching ramifications ( the Executive will sit on the Report of course . Sata never releases Inquiry Reports to the Public . Just remember how many Commissions of Inquiry he set up upon taking office – ZRA Commissions of Inquiry, ZNBS CoI, ZANACO CoI, Barotseland CoI, ERB CoI – none of these have been made public . Now he wants to treat the Constitution in the same manner .
And when Wynter steps down , that will be poetic justice for GBM. GBM resigned on principle while Wynter will have been booted out in ignominy. How interesting , not even Hollwood could have written such a script. Without lifting a finger, Sata would have had both Wynter and GBM out of their cabinet positions, albeit in very contrasting circumstances. Now the down side -with too much time on their hands, the duo will go flat out to mobilise their opposing camps. They will both have taken off their kid gloves- be prepared for bare knuckles fight to the death as the two camps fight their decisive and last battle. After that, there will be no PF left.

First what makes me wonder is the fact that the whole head of state not knowing the whereabouts of the people that he was to swore in. No body gave the president the answer, is it possible for the president really never to know about what was happening?
Who is responsible of bringing those people in? Who goes to call the president for any ceremony? Did he not know that the people were not around for that particular ceremony? Life here on earth.
Another wasting tax payers money to start paying these people while people are sleeping hungry out there and in rural areas the hospitals have no drugs.
