Chief Chitimukulu challenges Government to arrest him

Paramount chief Chitimukulu Kanyanta Manga II of the Bemba people has challenged government to arrest him if they are aggrieved that he has been installed as Mwinelubemba.

The Mwinelubemba, Henry Chanda Sosala told the Daily Nation from Kasama yesterday that he would be in the town to wait for police officers to arrest him.

Chief Chitimukulu was responding to an order by Chiefs and Traditional Affairs minister Nkandu Luo that he and the other chiefs that were masquerading as duly elected chiefs should be arrested.

“Ok I am around, I am not at Kanyanta village, I am in Kasama and it will be easy for them to arrest me. I don’t remember imposing myself as Mwinelubemba but the Bashilubemba are the ones that elevated me to this position,” said the Paramount chief.

He said the Supreme Court ruled has already ruled that the appointing authority for the Paramount chief of the Bemba people was the Bashilubemba and not anyone else.

Earlier at a press briefing in Lusaka, Professor Luo said the law enforcement agents should arrest all chiefs that were not recognised by government including Henry Kanyanta Sosala.

“Anybody who is walking around and calling himself a chief in a chiefdom where they have not been recognised are committing an offence and must be arrested,” Prof Luo said.

She said Mr Sosala did not follow procedure together with several other individuals who were claiming to be chiefs in Zambia.

“As far as this office is concerned, we do not recognise anybody who has not been gazetted by President Sata,” Prof Luo said.

The minister further said the Mwamba chiefdom did not have a chief because procedure was not followed when choosing Mr Sosala and that it was not only Mr Sosala who was masquerading but many others.

“The Musokotwane chiefdom of Southern province has not had a chief because they also did not follow procedure, we are not selective when applying the law,” she said.

Prof Luo cited Mr Kapotwe’s case who went to Chienge district in chief Puta’s area and decided that he becomes Chief Puta when in fact the holder of the throne had been governing the area for quite some time.

“In this country, there is only one person who recognizes chiefs and that is the president of the republican of Zambia,” she said.

Prof Luo told journalist that whoever was claiming to be chief should produce their recognition from the president.

“There is supposed to be a meeting which is called to select a chief guided by the Chiefs Act. The members who attend the selection meeting, other government institutions, chief affairs officers, and other people are recorded according to traditions that select the chief,” Prof Luo said.She said people who attend were recorded together with the the minutes of the meeting.

“After the meeting, the provincial local government officer submits the minutes and the record of discussion to the provincial minister who scrutinises and forwards them to my ministry. And when they get here our director of chief’s affairs also scrutinises and compiles the minutes with a covering letter and then recommends to the president’s office,” Prof Luo said.

    • It is really sad that we have continued perpetuating colonial tendencies and laws.Prof Luo’s statement that its only the president that can recognize a chief is achronological and is a statement that should not be uttered in this time dispensation. For one the president was voted by less that 50% of Zambians so he does not represent the will of all Zambians.Secondly presidents are only there for a 4 year term whereas chiefs serve for life.It would be dumb and primitive to allow a one or two term president to decide on traditional leadership.Our colonial matters however put themselves over chiefs as part of their imperialist policies, this should not continue in an independent country.Our laws are primitive and hindering progress they need to be changed NOW

    • When Prof. Luo says it is only the President who recognizes chiefs, she did not mean that the President appoints Chiefs. This is what happens when people already have other things in their minds against someone (the President in this case. What she means is that after all that procedure is followed up to the Chief’s Affairs Officer, the minutes are sent to the President who also makes sure that procedure was followed and the right person was appointed. He merely signs if all procedure is followed, not that he appoints NO. In this case there are no minutes and appropriate people did not take part in the selection, what do you expect? Those of you who never did History in your school days, be informed that these are the things that brought about tribal wars in the past (SHAKA, ZWANGENDABA)

    • There is no point in insulting the Minister here. I am now wondering what is at play here; is it ignorance or total inability to understand issue? In traditional circle, there are Coup De Tarts as well. An example was the Chief Puta Saga. Even if Sosala is the right person, there must be minutes to show he was unanimously chosen. What the minister is talking about here has nothing to do with the lineage of Sosala, but just procedure.

      NOW, I DON’T WANT ANYBODY TO SHOW HIS/HER IGNORANCE HERE. JUST GO TO THE MARKET AND SELL VEGETABLES.

    • Let me also mention here that it is very possible to abolish chiefdoms. Nyerere did it in Tanzania. There are no chiefdoms in Tanzania (I mean NO CHIEFS IN TZ). If you want to prove, go there and ask. I have had a lot of chats with Tanzanians and I confirmed there are no chiefs in Tanzania. As a result, everyone is free to live the way they want. Of course there are tribes but no chiefs. So careful.

      After people do everything, the president is only informed of the decision. I don’t think he should have any proposal or debate to people’s choice as he is not the appointing authority for Chiefs.

ISN’T THERE ANY DOCUMENTARY EVIDENCE? ISSUES MUST BE EVIDENCE-BASED.   3. Shame that government has enganged itself in a “cold war” with traditional rulers instead of working together as partners in making sure that development is achieved!
    This in a nutt shell enlightens you to see clearly were their motives en priorities are based. That is in working hard to impower those that can “protect” and partner with them in making bad choices! Otherwise, what’s the fuss all about? We all know why but I keep wondering why this keeps dragging en everyone keeps looking on!

    • @Yaluka, well said- in just one sentence, brilliant. Luo should have told bashilubemba, ”Hey, you forgot to do something here. Please let’s have this redone”, period. What did we see? 500 cops bristling with hardware, were sent to Kasama to surround the Chitimukulu’s palace. Even during the Mushala uprising, we did not see that type of mobilization. When you are applying for a passport, for example, and you forget to fill in the affidavit, the officer will tell you to fill it in and bring it together with the application forms. From there, bingo, you have your passport. Is there something that we don’t know over this Chitimukulu saga?

  5. I challenge the Govt of Sata to go and arrest him if he is in a wrong position. What are you waiting for? The man is ready to defend himself.Since you know as a govt that he is a wrong man on this position, why not send police now so that this case can be closed. Am sure you are touching a wrong button.   7. My view is that the law should be repealed so that the appointing of chiefs is left to the tribal establishment. The President or simply the government should only be informed. It was crazy of the MMD to use taxpayer’s money to buy expensive vehicles and the PF to increase their allowances. My view is that if a tribe fails to look after its chief, let the position die a natural death.

Too many ego`s and personal interests have had contributed to this problem.As somebody who dealt with this family about a decade ago i know that there is more to it than what meets the eye.GBM,Nkandu Luo and Sata himself are somehow connected to the loyal family(GBM and Nkandu especially).It is just a pity that they are all using the media and offices to wash their dirty linen in public.I wish these people will find a way to sit down and discuss their problems.Where is Bwalya Chiti ?

      The matter remains trite. The Bembas have spoken through their traditional representatives and have of their own chosen and appointed a Chitimukulu.

      Hear this o yea that repose in power, momentarily. The Chitimukulu is Sosala and shall remain so till he rest at Shimwalule!

      I am glad that today there are Bemba bloggers that are coming to cause of this their King. That is as it should be! Learn from the Lozis who will never never ever allow you to say even a little slander against the Litunga. I love their deep respect for mulena.

How does mwinelubemba’s status affect the kwacha, employment, lack of medicine, KCM saga, constitution, political violence, defilers, useless ministers etc ?   13. What the hell! If the royal family has reached a consensus and chosen their rightful ruler why should someone refuse to recognise such a person? Is the president wiser than all the bashi lubemba put together? Nonsense, this just allows personal egos and hatred to come in disrupt what has been in existence for centuaries .

  14. When will this saga come to an end? We need a substantive Chitimukulu. If Kanyanta Sosala is so ordained by ba shilubemba, let him take position. But this should be after reconciliation with the head of state. Confrontational stance can not solve anything. Kanyanta Sosala as the appointed Chitimukulu should be wary of political vultures like HH whose opportunism can stop at nothing to plant seeds of discord in Bembaland and Zambia at large by dishing out huge amounts to his targeted weak points. Why is it that only yesterday the chap HH produced a press statement to the effect that Sata should stop harrasing Bembas and today Kanyanta Sasala is daring government to arrest him. This is not mere coincidence. I smell collaboration.

  16. I have to say, Sata’s PF philosophy of governance of the Country is the exact opposite of the developed World’s philosophy. Countries that are developed today, like here in UK, got to this level by nurturing its people’s centuries old traditions and norms. For instance, UK has what is called ‘Listed Buildings’- these are buildings of a certain age which are protected by law from any alterations by owners. This is to preserve tradition. A people’s tradition is a people’s backbone.
    Developed Countries are founded on a tradition which has its roots in a village concept, hence the Listed Buildings for one.
    I can therefore categorically say Sata’s PF had got it the wrong way round by making ‘gazetting’ a Chief by Govt to be more paramount than what the subjects have decided.

  20. Bashilubemba may not have attained the level of education necessary to understad these legal issues. It’s unfortunate the govt is capitalizing on trivial legal irregularities instead of advising them. The question govt should consider is; ‘will they appoint the same person if they duly follow the procedure?’ If the answer is yes then Sosala must be recognized. Even courts do not reverse the decisions of lower courts just because of some few technical errors, if in their opinion the result would have been the same even in the absence of such errors.
    For now, Sosala should just challenge the President’s decision not to recognize him as Chitimukulu in court, so that the whole thing can undergo judicial review.
    This is highly dependent on the degree of the courts.

  26. It is a pity that even those perceived as learned people can sink so low because of trying to impress someone and keep a job. These are the same chaps who are misleading the president because they are afraid to differ with him on principle and intellectually. This is very sad and no wonder the country seems to have no direction because there are just too many blind followers masquerading as leaders and misrepresenting the people. It is really embarrassing what sort of leaders we have!

Ba Presido, kindly re think what you are messing around with, it does not pay not to listen to the masses, mind you the masses are your masters, RB is not far away to give you advise on how messing around with the masses normally backfires. RB has a big testimony on this kind of advise and I guess he is no longer economical with giving out such advise for free.

  28. Chief Mukuni says it’s the people, not presidential recognition that makes a chief

    Senior Chief Mukuni of the Toka-Leya people of Southern Province has argued that the recognition of a Chief by the Head of State alone does not make one a Chief in the eyes of the subjects.
    Chief Mukuni explains that in the eyes of the people there are many processes required to be followed for one to be Chief of which recognition by the Head of State is just one of them.

    Chief Mukuni has told QFM News in an interview that Tradition must be respected because it has always been there before governments where formed.

  31. Its a pity that Persons are condeming Nkandu and Sata and praising an imposter like Sosala.
    If he is the chosen one, then let him humbly, and quetly call his kangaroos and follow the law as SATA wants. He will be King in no time!
    As it stands now with him throwing his weight around thinking all Bembamen will protect him, he better look back again. He may only have HH and GBM.

I think Nkandu Luo contradicts herself when she first says the President being a kind of Authority that must say that the person is now chief, then she say the following “…, and other people are recorded according to traditions that select the chief,” So she acknowledges the chiefs are selected according to their traditions.So if they are selected by their tradition to become chief there is nothing the President can do but only accept their choice of selection. So in this case Sosaala Kanyanta is Chitimukulu. Unless if the President had the power to select or overrule the choice of the people’s selected chief, meaning also overriding their tradition,which he does not have. Which would mean its no longer tradition but appointment.

    • @ Jairos Jiri, why are you so worked up about Umubemba Nkonko’s comments? And who says there are no true Bembas in Muchinga province e.g. Kwa Nkula in Chinsali(known as Ichinga to us)?

What comes first APPOINTMENT OR RECOGNITION??????It is like Nkadu has swapped the two.The chief was appointed and no one within Bemba land has risen against our chief except Nkandu the Bisa (our slave from one of the small tribes the bembas conquered).Nkandu should tone down otherwise to rise.
