Arrest Shamenda for not reporting alleged corruption within the stipulated 24hrs-FDD

The Opposition Forum for Democracy and Development has called for the immediate arrest and prosecution of Labour Minister Fackson Shamenda for failing to report to the Anti-Corruption Commission (ACC) the alleged corruption with the dangote official within the stipulated 24hours.

Speaking in an interview FDD spokesperson Antonio Mwanza explained that the Anti-Corruption Act section 39 clearly stipulates that any public official must report any incidence of corruption with 24 hours of coming into contact which the Minister did not do hence the need for his arrest and subsequent prosecution.

Mr. Mwanza noted that as high a ranking public official Mr. Shamenda should be an example to his juniors and that his failure todo so shows both lack of seriousness and commitment in fighting corruption.

He further said the arrest of Mr. Shamenda will not only send a massage to public officials but that it will also show the commitment and seriousness by the ACC to fight the scourge regardless of who is involved.

“As FDD we demand for the immediate arrest and prosecution of Labour and Social Securities Minister Fackson Shamenda failing to report the alleged corruption by the dangote official to the ACC within the stipulated 24hours. Section 39 of the Anti-Corruption Act is very clear that any public official has to report any incident of corruption to either the Police or the ACC within 24hrs.

“Mr. Shamenda’s failure to report the alleged corruption within the stipulated 24hrs shows a serious lack of commitment on his part as high profile public official and his arrest will send a clear massage to all public officers to take the fight against corruption seriously,” Mr. Mwanza said.

He added that the arresting of Mr. Shamenda would send a clear signal to all the workers in the country be it public or private to take the fight against corruption seriously and that the country will no longer condone the scourge which has continued to gable public resources meant for the development of the country and eradication of poverty.

Asked if he won’t be accused politicking Mr. Mwanza replied that failure to arrest Mr. Shamenda will only vindicate stakeholders who have for a long time accused both the ACC and government of following up cases selectively as the evidence clearly shows that Mr. Shamenda did not report the alleged corruption within the stipulated time frame.

  1. Shamenda has disgraced the party. He is too old too slow, too weak and offers too little.
    Let him defect to UPND.

    • Ba Mushota, Sata is older and slower than Shamenda. By your logic, remove the dinosaur at the helm first and progressively purge all the likes of Munkombwe and all the fossils in the diplomatic service.

    • FDD is right, SHAMENDA can’t publicly talk about people that attempted to corrupt him if he didn’t report them to the police. In fact he’s lucky that am not the accused in this instance coz I’d have sued for defamation, and seeing that SHAMENDA has no proof, I would be swimming in a few cool millions!!!!!

  2. Shamenda is no sacred calf, let the man be dealt with by the law. Any govt official that can tolerate the disregard of labour laws by the likes of Zambia Sugar, Zambeef and these other commercial farmers together with mining companies such as KCM should be sent away. The PF govt that I know doesn’t tolerate such nonsense.

  3. That is PF for you.They do not need opponents.Shamenda just stood up and told the world that Dan got offered him a bribe that he refused to accept implicating himself in a crime.How hopeless can people be.

  4. Better late than never! The Honorable Minister took the trouble to report the matter. He also did not benefit from the delay. When a Nigerian is involved, then the probability of being corrupt is higher. That is a statistical fact and a reality that can not be brushed away by pure sentiment. There is no need to scandalize the Minister for his willingness to inform ACC. Remember, he is not an employee of ACC.

      Your argument does not work. If you accept Shamenda ought to have reported the incident, then he ought to have done it timely. On this premise, his failure to be timely was an error. However his consequent report out of date and time was a serious character flaw and a decision he took which shows his bad judgement.

      By reporting it too late it rendered the ACC toothless in fighting corruption in Zambia. By that same late action, it put him in a position to have his character questioned and potentially slander Dangote by default as he now cannot prove his accusations.

      The best the gov’t can do at the moment is to sack Mr Shamenda to show that they are serious on fighting Fraud, Corruption committed by Investor communities.

    • Hey the issue here is not shamenda being corrupt, but the NOT report corrupt practices with 24 hours. Here is what the story says in part;

      Lack of understanding issues and analytical skills will kill this country. He failed to report so let him be arrested. If it were u teacher or nurse, the human resources in the ministry of health, accountant in the ministry of education, were you going to be spared?…

  5. Leave shamenda alone, he looks shabby but he is much smarter than most of the bloggers. First of all who came up with this rule of 24 hrs. Corruption is not like rape where you expect evidence to be on the person with 24hrs. Shamenada still claims to have the evidence so why not follow up the case? ACC you are also corrupt and only play to the gallary. What happenned to Kambwili’s abuse of office case. You must stop harassing the old man. If you cant take his evidence then forget everything. Go ahead and charge him, but who is your witness? Its high time you propossed amending that 24hrs duration. If anyting zambia is too large to restrict reports to 24hrs. Wake up zambia.

    • Don’t be naive. Even if Zambia is large, faster means of communication exists. Shamenda has phones and other gadgets with intenet connectivity paid for by taxpayers.

    • @ Czar, where have ever reported a case in zambia by phone or email. You have to walk into the police station physicaly to report and some police officers wont even know where to start from to get a statement. Besides you will go and queue for hours to make the report and will be very lcky to get a case number. Once you are done dont expect to leave in peace the some police officer will ask you for something for a drink. So what naivety are you talking about. You should comendy him for speaking out puublicly. Dont just play politics. Well from face value he doesnt look inteligent maybe thats why this Dangote guy miscalcuted on him, but he is straight forward. Poor judgement or what ever you might want to call it, but he never swept it under the carpet.

    • I stand by what I have said. Whatever you say James does not apply to Shamenda. No police officer would make a Minister wait for long and even ask money for a drink. The fact remains that Shamenda had all the means at his disposal including a vehicle bought with and fuelled by taxpayers.

  6. its unfortunate my uncle once told me that its the dull and lazy that stay in one place for a long time and raise to high positions as a consequence,he gave an example of the same minister but where are you the intelligent ti fill up the gap?as long as you hide you will keep complaining of shoody service…

  7. If that is what the LAW says, then let Shamenda be arrested. The LAW is clear but knowing our judicial system nothing will happen.
