Prominent Lusaka lawyer Sakwiba Sikota has said there was no vacancy at the time President Michael Sata died.
Commenting on the transfer of power from Minister of Defence Edgar Lungu to Vice President Guy Scott, Mr Sikota said that President Michael Sata had already filled the position when went out of the country by appointing Mr Lungu to occupy the position in an acting capacity.
“There was no vacancy created, my argument is that at the time the President went out of the country the vacancy was then created which was then filled in an acting capacity by Hon Lungu,” he said.
Mr Sikota said that Edgar Lungu should have continued as acting President.
“At the time the President passed on there was no vacancy there was somebody in that position in an acting capacity and that person should have continued that is Honourable Lungu”
And Mr Sikota has said that the current acting President Guy Scott has no power to fire any top ranking officials without the approval of cabinet.
Mr Sikota said Scott could not dismiss Presidential appointees without seeking the approval of cabinet.
“The acting President cannot dismiss ministers or other appointees of the President in whose shoes he is acting,” he said.
“If there is a question of somebody to be removed from cabinet, it would need for cabinet to all agree for that to be done because obviously, if there is a situation grave enough parliament’s hands should not be tied but it is not the decision of one person it is a collective decision. One person in the name of the acting President cannot take that decision alone it has to be the entire cabinet.”
There may not have been vacancy,but there has been a leadership vacuum since PF came to power.
We have to move on. Nothing can be changed now. Guy Scott is only temporarily there. Musa Mwenye should be answerable if at all he blundered on this one. In the meantime, lets mourn and bury our late president. Thereafter it’s bye elections. Life has to go own.

The President is not a person, it’s an idea, it is that thought process that has the ability to create a buy-in from the electorate. That idea is the propagation of peace, prosperity and overall well-being of the general populace.
When the populace identify that with an individual then they are able to vote that person into office, the idea that he will look after their interest not his.

I have long argued that anyone who cares to read the relevant article 39 particularly 39(3) would have known without any doubt that Lungu should have continued as Acting President because that clause is very clear in suggesting how powers of a duly appointed acting president can be revoked. The constitution does not provide for any acting president to hand over power to another person so that they too can act. What is worrying is that our so called Prosessors in Law, working in the diaspora, including Prof. Ndulo, have all come out with the wrong legal wigs and failing to acknowledge what appears like common-sense.

You are a playing member of a football team (e.g Arsenal) Your team captain (President) gets injured and goes to hospital and gives you the armband as a stand in captain (acting president) instead of giving it to the non-playing Vice Captain(Guy Scott Vice President) who is on the bench. At that point on you become the captain/president of that game/process even if you receive news that your captain has died in hospital. Actually! I am pretty angry about this whole state of affairs. This situation arose due to the current cabinet having been stiff scared of president Sata. The current cabinet is made up of cowards who could not stand up to the late president Sata. They were all dead scared of him! Even when they were referred to as being useless, none, I repeat none of them stood up to challenge the president or threatened resignation for being treated like prats. He (Sata) erroneously appointed Guy Scott as Vice when in the actual sense he was ineligible to stand as president in the event Sata died. Isn’t that a gaping hole right there in the constitution. How can one act when they can’t be top brass in the event the opportunity availed itself? Do you need to be a lawyer to see this anomaly? Nada!
Therefore, what this means for Guy Scott is that he is acting as president illegally and should hand back power to Lungu with immediate effect. Conversely, we should first have a referendum on the new constitution before we have the by-elections. Guy Scott can remain the custodian of the presidency as a wrong has already been done. The outcome of the referendum will determine whether or not we adopt the new constitution as law and go to the polls in 2016 for a republican president using the prescribed constitution of the day. How about that? This way, the playing field is widened. We might just have NDOBO stand for the presidency with SAULOSI as his VICE (running mate) and MUSHOTA as their Minister of Mis-information!
I am not a lawyer but I understand this very well.It is very clear that only vice president can act as acting president when the siting president dies.Sakwiba as shown high levels of ignorance on this one.Guy scott did not fire edgar Lungu as minister but only fired him as secretary general of the party of which the PF constitution backs him.So pliz bo saki don’t dent your image for nothing.Go back and ready the law propery.There was no way Lungu would have continued as acting and hand power to himself as stated in article 39.that only provides for the president if he was acting at the time sata died.
More intelligent lawyers have already spoken. Professor Muna Ndulo, Professor Hansungule, LAZ, Attorney General, Munshya wa Munshya Elias etc have told us that ONLY THE VICE PRESIDENT takes over when a president dies. Article 38 has to be applied. In article 39 the president only leaves SPECIFIC FUNCTIONS to be performed by whoever he leaves to act. Once he dies, the vice takes over to perform ALL THE FUNCTIONS of president, except dissolving parliament and firing presidential appointees.

Saki, the vacancy the constitution refers to is when the president resigns, is impeached, is unable to permanently perform his duties due to an illness or dies. A president leaving the country for whatever reason does not create a vacancy. Hence he can appoint anyone of his choice to perform a limited number of functions.Even at your law firm if a lawyer temporarily leaves the country he does not leave a vacancy but if that lawyer dies while away that’s’when a vacancy occurs in your company’s’establishment and that’s’when you can fill it up. When a president dies the constitution kicks in and gives all functions to the acting president only without the powers of dismissal. This acts to place the wagon back on the tracks and that’s the way it ought to be.
This actually makes a lot of sense to me. The president had already made an appointment. The vacancy argument would make sense if the president had died in a road accident or was shot while in the country and occupying his office. But the president left the country and put somebody there in case something goes wrong the person put there can continue to act. This makes perfect sense to me. Sata appointed Lungu, Mr. Sata is deceased and the acting president takes over but if the vice was incapacitated then the cabinet would appoint someone else to act. I honestly think Saki is deliberately confusing himself here. The president’s appointments in government cannot be undone by an acting one during the 90 days succeeding his demise before a new president is elected. That is governed by the republican constitution. However, his appointments of PF officials is governed by the PF constitution, it has nothing to do with the republican one that ties the hands of the acting president to hire and fire. The PF constitution allows Scott to fire!
This is the reason why I’ve never trusted lawyers. Unlike in the field of engineering where there is always a fool proof solution to a problem, in the faculty of law a multitude of solutions would be deemed correct and that depends on the supreme opinion of the presiding judge. Given the foregoing, if a plaintiff gets an unfavourable case ruling he needs to appeal to appear other court in order to obtain ‘a different opinion’. Law is a recipy for corruption in the country given that contrasting of opinions are encouraged. Lawyers who successfully defend clearly guilty clients are termed ‘good lawyers ‘. There are very few honest minds in this profession and few who still end up in law do not forge great careers as they lose most of their cases because of being too honest.
That’s why I couldn’t go to law school. If you defend a clear thief/ murderer and he goes free then you are ‘good’ and ‘clever’ !!! Imagine Its like the murderer is cleverer than the murdered . What logic this??

He obviously wrote against the Post newspaper recently which has been supporting Guy Scott. As a lawyer practicing for many years, the man surely knows that the constitution is the supreme law of the land. Michael Sata did not appoint Edgar Lungu to act in his death, he appointed Lungu to act for the time that he was going to be out for medicals. The constitution is as clear as a bright sunny day. When the president dies the Vice President takes over. It is surprising that most people presume that the law is not logically driven. Saki’s bone of contention is that there was no vacancy of an acting president when MCS died. How then did Guy Scott who never previously acted as president today qualify to act? To me three things must be clarified here i.e. 1. Either it must be accepted that MCS had confused the protocol 2. Guy as well qualifies to contest as republican president. 3. Sata’s impressions on not leaving Guy acting on several occasions were ill-conceived hence confused and never listened to his lawyers’ advice so that I must be at liberty to conclude that contrary to the praises that he (sata) was a humble man, he was adamant and incorrigible – mushololwa.

I believe the ‘vacancy’ Saki is referring to is not the actual ‘Presidency’ but in the context of the ‘Acting President’ vacancy. Saki is trying to say the ‘acting president’ role was already filled thus we shouldn’t have had a situation where the ‘acting president’ hands over to another ‘acting president’.
This whole mess is due to the badly written constitution and a clause that was targeting individuals. The constitution always assumed that the Veep qualifies for presidency and would be acting.

Sata is not the supreme law. The fact that Sata never appointed Guy to act as acting president is personal and not law. The fact that Sata who is not above the supreme law of the land never allowed Guy Scott to act should not in any way subdue the constitution. Sata by law had no powers to appoint Lungu to act in his death, the fact that Lungu was acting during Sata’s illness does not in any way legally mean the man should continue in his death. The constitution is very clear on who takes over as President in the event of death with or without an acting president in place. Very simple

An object lesson: A war was raging. A plantoon was sent on a 90 days rec mission far away from base. A shrewd 2nd Lt led 15 men carrying ammo, picks and supplies. The plantoon had only ONE sophisticated and deadly weapon operated by the 2nd Lt. The seargent (deputy to 2nd Lt) could not operate the weapon. Therefore, the 2nd Lt always left the weapon with the corporal when he was away. One day the 2nd Lt went to base and left the weapon with the corporal. One the way, he died in combat and news reached the platoon. The 2nd Lt’s batman and the searg’s henchmen and ordered the corporal to hand over the weapon to the searg. claiming that he was the one to take over!

Sakwiba, the best you can do is to lobby parliament to change the constitution to say in case the President dies and there is an acting President, the acting President should take over. For now, sorry we have to follow the constitution in place which clearly says that the Vice President takes over.
And there was another argument to say since the President gave instruments of power to Edgar Lungu, he should continue. Instruments of power are just administrative. In the handover notice in the Constitution the power, upon the death of the President, goes to the VICE PRESIDENT and not the acting President. Can Mr Sikota elaborate on that one, please…? Was Edgar Lungu then appointed Vice President??? I am sure he has noticed another slot to get some easy cash from the gullible.
This matter is likely to be litigated and add to SADC jurisprudence and constitutionalism.
The co-pilot could not fly a boeing dreamliner. The captain falls ill, 9 hours from destination, and hands over the controls to one of the crew (a steward) who could competently fly the ‘bird’. The co-pilot announces to the passengers that he is incompetent to fly the plane and hence the steward on the controls.
30 minutes after handing controls to the steward, the captain has a heart attack and dies. And immediately, the co-pilot pushes out the steward insisting that as the co-pilot ONLY he has the legal right to fly the bird.
And what did the rest of the crew and passengers do to the co-pilot? And what would you do if you and family were on plane? Would you let the co-pilot take…

Sakwiba sikota is not only a lawyer but also a politician. why should he be so sore on what the PF have decided to do as an internal matter?The statement issued at Guy scot’s farm states that the central committe of PF and Cabinet of zambia are ok with the leadership of Guy Scot.However, Sakwiba is well aware of Scot’s cababilities! Scot is more schooled than sakwiba. he holds a PHD in Artificial Intelliegence. by scot’s clever mobilasaytion, PF was able to beat such people like MMD, sikota, miyanda, and all the parties in zambia. so what we see is sour grapes here. Our advise is that scot must start mobilaisation to challenge the PF in the elections instead of trying to convince us with his interpretation of the Law.

It’s very shocking to get such misinterpretation of the constitution from a person I thought was a top lawyer. Article 38 is very clear. The position of President fell vacant when Sata died. Whenever the office president falls vacant by way of resignation or death, the Vice President will perform the functions of the office of President unless he is unable to so by reason of physical and mental infirmity. this is what the constitution says. it is the same Article 38 that provides for holding of presidential election (by-election) within 90 days of the office falling vacant. Article 38 must not be confused with Article 39 that provides for appointment, by the President, of a person to perform the functions of the office of President when the president is absent from Zambia or is ill or…

Why did the late president never even once appoint the vice president as Acting President in many times he left zambia? The constitution says if the vp is incapable among other things, the president needs to appoint someone else, not the vp who is incapable in the case of Guy Scott he’s incapable that’s y the latepresident cud not appoint him to act because doing so wud be against the constitution. Sata’s spirits will punish those who appointed the incapable Guy Scott for ignoring him.
When Mazaka died,either Sakwiba or Chisanga ws supposed 2 takeover the leadership of UPND as per party constitution but this ws not so and HH tookover because neither Sakwiba nor Chisanga ws a Tonga by tribe.

Six yrs ago president Mwanawasa passed on and by then Hon Geeorge Mpombo was acting as president. The same law this man is trying to manipulate was put into play and RB took over the presidency since he was the vice president. This questionable lawyer didn’t say anything like what he is saying today and when RB went on to be the candidate for that presidential bye- election Sakwiba was the first one to go out and campain for him. The man even forgot about his own party and he has never gone back to it. Maybe he has even forgotten his party’s name; I can’t remember it either. The man is a great hypocrite. Thank you!
