NATIONAL Democratic Focus (NDF) president, Ben Mwila yesterday told a Lusaka magistrate’s court that he gave second Republican president Frederick Chiluba’s wife, Regina, US$100,000 for her business.
Mr Mwila told Principal Resident Magistrate, Charles Kafunda that he gave Mrs Chiluba the money for her business to buy property.
He was testifying in the case in which Mrs Chiluba has been charged for being in possession of property suspected to have been stolen or unlawfully acquired.
Mr Mwila told the court that he gave Mrs Chiluba the money without security and that there was no agreement signed.
He testified that it was not the first time he was lending out money to individuals and informed the court that he also had dealings with the late Baldwin Nkumbula, among others.
In cross-examination by state prosecutor Dennis Simwinga, Mr Mwila admitted that he wanted the court to believe that he gave Mrs Chiluba the money without any security.
He said it was not his business to know the property that Mrs Chiluba wanted to acquire and that they agreed that he would take security once the property was registered.
Mr Mwila said he knew Mrs Chiluba in the political arena and that she was one of the most dependable political cadres and that was how they built a relationship.
He admitted that he would regret it if she was sent to jail and that nobody would be happy with that.
The defence has since closed its case and judgment in the matter has been set for March 3 next year.

Just last week the Justice Sakala was telling the courts not to delay the cases, this case is closed and the judge should have passed judgment at least mid December and not May 3. Are our judges really competent. Can you students of the law on this blog educate us as to why the judge needs that much time to pass judgment. I follow Zuma’s cases here as as soon as arguments closed, it never took that long to pass judgment. I suspect Chiluba’s cases are deliberately being delayed till the guys dies. It appears as though the courts are trying to make sure that all lies are exhausted and then to see whether they could fabricate more lies and in the process implicate others. But this is on the tax payers account and the lawyers benefit. Very unfair to the common man. When judgement is delayed justice is denied, in this case the common tax payers justice.

BY had cash those days and may still have. It could be true. But its up to the courts to decide. Whether acquito or otherwise its not my business. There are a lot of cases in courts, why should this one be so special.
It is not unreasonable to query and question the tendency of lengthy and protracted court cases. It is a horrible injustice to pepertuate this kind of thing and the least that the GRZ can do is to call for the attendance to this anormally. There are many innocent victims in jails awaiting thier trial and for lack of money are languishing in jails. This is very unfair and the little that our GRZ could do is to have a hearing and consideration for the poor souls languishing in prisons.
This calls for wisdom, if RB would win the peoples hearts, this is an opportunity. Let him ensure that justice prevails. The courts have a serious role to play in all this drama and it does not augur well for them to simply seem to be waiting apon direction from the executive.

It’s a shame that your expekrience returning to Zambia was a bad one but that is not to say that everyone experiences the same thing. I returned to zambia last year. Armed with 3 Job offers, I am not related to anyone and did not sleep with anyone. You have to test the market for your particular qualifications before you get on a plane and assume that people will be falling over backwards to employ you. I earned more money in England on paper in the UK but my quality of life in Zambia is far much better. I want for nothing and I can see tangible progress. You went about it the wrong way.

If it is relation then everyone becomes desparate in support of the desoparate person. If it is persuation usually issues of corruption could be involved. If the latter is the case, then the courts of law are in order to fix 5 months before judgement because much is at stake which needs careful study including possibility of corruption. If the former is the case, still there is need to do thorough investigation which might include probing BY’s bank accounts for information relating to the said periods. Such can’t take place overnight.
