Speaker reprimands Chimwemwe Mp

Speaker of the National Assembly, Amusaa Mwanamwambwa has reprimanded Chimwemwe constituency member of parliament Willie Nsanda, for using disparaging language against fellow parliamentarians  his colleagues in the House.

Mr. Mwanamwambwa strongly reprimanded Mr. Nsanda for allegedly calling the then Deputy Minister of Sport, Youth and Child Development Patricia Mulasikwanda, who is now Minister for Gender in Development, and the Deputy Minister for Home Affairs Grace Njapau, “armhole”, meaning prostitutes.

This happened on January 18th, 2007 in the National Assembly chamber during the post election seminar for Members of Parliament.

The two ministers lodged a complaint to the Speaker of the National Assembly on
January 24th, 2007 against Mr. Nsanda, Pambashe MP Dr. Bernard Chishya and Chipili
MP, Davis Mwila, all of them members of  the opposition Patriotic Front (PF).

However, the other two who were jointly accused with Mr. Nsanda were not found with
a case to answer after all the  procedures.

The two  ministers,  who are nominated MPs for the ruling Movement for Multiparty
Democracy (MMD), complained that the remarks made by Mr. Nsanda reduced their
standing in society.

They further said in their letter of complaint that they were both widows and were
not known to be going out with any man including the three MPs who allegedly called
them prostitutes.

In delivering his ruling on the matter today, the speaker of the National Assembly
ordered Mr. Nsanda to go out of the Chamber and enter through the main entrance and
stand behind the bar near the same entrance.

“I also direct the Sergeant-At-Arms to take the mace from the racks and go and stand
behind the Hon. Member for Chimwemwe, Mr. Willie Nsanda, MP,” he said.

Mr. Mwanamwambwa told the MPs in the House that, after the complaint was formerly
lodged, the matter was referred to the Committee on Privileges, Absences and Support
Services for determination.

He said the committee then asked the trio to exculpate themselves from the
accusation levelled against them, to which they responded and denied making any
disparaging remarks against the two ministers during the said seminar.

He said the accused however confirmed having heard the remarks.

“Hon. members may wish to know that on the material date, there was no verbatim
recording of the proceedings of the seminar because the recording equipment had
broken down. However, the proceedings of the post-election seminar were recorded by
rapporteurs who did not capture the alleged disparaging remarks in their record,” he
said.

Mr. Mwanamwambwa further told the House that the two ministers had mentioned three
MPs as witnesses to the alleged remarks.

The three witnesses were MPs for Munali, Solwezi and Namwala namely Mumbi Phiri
(PF), Ben Tetamashimba (MMD) and Major Robby Chizhyuka of the United Democracy
Alliance (UDA/UPND).

In her evidence Ms. Mumbi said she heard the remarks being made in the Chamber but
noted that it was difficult to know who uttered the words “armhole” because there
was confusion in the House.

Mr. Tetamashimba, who is also Deputy Minister for works and Supply, said he did not
hear Dr. Chisha and Mr. Mwila insult the two ministers on the material day but
confirmed on Mr. Nsanda.

Major Chizhyuka said in his testimony that, “there was a physical threat to my
person by some members of Patriotic Front party.

He added that in the middle of that confusion in the Chamber, Ms. Njapau and Ms.
Mulasikwanda crossed the floor of the House and went to sit next to him, noting that
it was at that time that he clearly heard someone shout “amahule”.

“I turned round, saw and heard Hon. Willie Nsanda saying “Amahule”. Madam I confirm
that the said words were said by Hon. Willie Nsanda, MP. Although I could not put a
tag on the others who shouted the word, I am very firm on Hon. Willie Nsanda, MP,
because I saw and heard him say these words,” Major Chizhyuka said in his testimony.

The Speaker said Mr. Nsanda also called three MPs as his witnesses who testified
before the committee and were cross-examined by the two complainants.

“After listening to all the evidence submitted before them and thoroughly examining
the same, the Committee on Privileges, Absences and Support Services established a
prima facie case of breach of parliamentary privileges and contempt of the House
against Mr. W. Nsanda, MP, but not against Mr. D. Mwila MP, and Dr. B.E Chishya,
MP,” Mr. Mwanamwambwa said.

Mr. Mwanamwambwa explained in his reprimand on Mr. Nsanda that the action of the
accused to utter disparaging remarks against the two deputy ministers amounted to
breach of parliamentary privilege.

He said section 23 of the National Assembly (Powers and Privileges) Act, Cap 12 of
the laws of Zambia states that any person who assaults, obstructs or insults any
member of officer going to or coming from the precincts of the assembly chambers
would be guilty of an offence.

The Speaker said the offence was punishable by the house.

He told the members of parliament that the House would not entertain such language.

He told Mr. Nsanda that his utterances on the two deputy ministers were not only a
betrayal of the confidence the people of Chimwemwe constituency who elected him but
also an insult to the confidence and trust Zambia has placed on the two
complainants.

“The people of Zambia cannot have “amahule” in this honourable House. Mr. Willie
Nsanda, you should also know that, by making such disparaging comments, you in
essence undermined the dignity of the House. This constitutes contempt of the House
which is a breach of the trust that the House the nation at large have in you as a
member of parliament,” he admonished.

Mr. Mwanamwambwa said being a first offender, the committee on privileges, absences
and supporting services exercised leniency on him but warned that the House might
not do so in future.

He added that the House would not hesitate to impose necessary and appropriate
sanction against any one who breached parliamentary privileges.

He has since asked Mr. Nsanda, who he reminded that he has been in the House for a
long time, to reorient himself with the provisions of the National Assembly Act.

  “In the name and by the authority of the House, it is now, my unpleasant duty to
reprimand you and admonish you Mr. Willie Nsanda MP, for making disparaging
remarks at Hon. Patricia Mulasikwanda MP, and Hon. Grace Njapau MP. This reprimand
shall be recorded in the votes and proceedings of the house,” he said.

The Speaker then ordered Mr. Nsanda to make a public apology to the two deputy
ministers and to the House and the nation at large.

Mr. Nsanda said he was unreservedly sorry for the making the remarks on the two
deputy ministers and promised never to do it again.

At this, the members in the House shouted ‘hear! hear! hear! as Mr. Nsanda resumed
his seat.

What does he know about the National Assembly (Powers and Privileges) Act, Cap 12 of the laws of Zambia? What is an Armhole. Is he the one gives it everyone one or its chilalelale, Mukaufwilwa ukaipya bengi, Zambians you need to study laws its very interesting. Yesterday it was Singongo today its Nsanda.

  3. I have always said that there has to be a minimum standard for a person to be called Honourable. How on earth can a person of Nsandas standing in society issue such disparaging remarks??
    I feel also that the punishment meted out to Nsanda is too lenient as it cannot deter would-be offenders. The man has not only exposed his foolishness but to a large extent, insulted the well-meaning people of chimwemwe constituency in Kitwe.
    Lastly, i stand to suggest that an impeachment process against Nsanda be instituted by the people of Chimwemwe.

  5. What caliber could society expect from the PF MPs headed by a senior illiterate thug of Sata mess? I see nothing but a circus. Like Major Chizuka put it, they are indeed a legion of acrimoniously dysfunctional thugs.And he expects Zambian mothers being insulted like that to give them votes.Smart politicians don’t dare insult women. A woman’s vote is very powerful. This is why i see a serious vacuum in opposition politics in Zambia. There is need for a new force run on smart and political economy front. These intrigues have no place in modern Zambia hence the dismal results election after elections. With such undesirable caliber, MMD is headed for the 27 year Zambian tradition rule.

    Business was temporarily suspended in parliament today because of a technical fault in the public address system in the chamber.

    Speaker of the National Assembly, Amusaa Mwanamwambwa suspended business at 15:15 hours, saying he had been informed that the proceedings in the House were not being recorded and were not been transmitted by parliament radio.

    Mr. Mwanamwambwa said it was a requirement that what was discussed in the House was recorded and transmitted live on parliament radio.

  11. The Parliament elected in 2006 was the twenty-firsty Parliament to have been elected since Parlamentary government began in Zambia. This makes the Zambian Parliament one of the oldest continously functioning legislatures in the Southern African Sub-region.
    It is the National Assembly, which consists of elected and nominated members of parliament that carries out a wide range of important PUBLIC RESPONSIBILITIES. These responsibilities include making laws(Acts of Parliament), approving proposals of taxation(which, fortunately, are much advocated for by PF) and public expenditure and most importantly, keeping the work of the ruling Government under scrutiny and review.
    What this means is that we expect them to support Government when it does something good for its citizens and not just condenming for the sake of being in the opposition like Nsanda would like to believe.
    Therefore, there is absolutely no reason for the Honourable MP to resort to insults with so much work at hand!

It is for this reason that i implore people like Kuku to take a serious interest in the affairs of our country and not leaving the whole thing on the knife edge!   16. The whole circus episode of representatives of such mediocre caliber has been appallingly a serious liability for Generations. For how long should this ruin our deserved legacy of a people that won independence, governed themselves wisely, and collectively shaped their prosperity destiny? It’s this type of mediocrity that is making it more inevitable to start thinking of stepping forward for true service into the mainstream legislative roles of in which time has continued proving a void. Decision 2006 integrated a lot of wrong people in the house. The so called dubious civil society who sold out these thugs must take responsibility why they sold out such thugs as alternatives.

Levy was LAZ President before Sikota. Infact, Saki was mentored by Levy in his legal career way through to the LAZ top job.

The Guy am citing is no closer to EK but a professional Zambians with clean and strong professional credentials.But like Veteran put it, its Sikota on the line to plot one. I can compare him to Kavindele in 1988 at MRA. A person who can not stand pressure is not feat for president. Come the new constitution you see what happens. It is on record and you never even dared to apologise to fellow bloggers. At least The MP apologised. Realisation comes after making a mistake. So you apologise so that it goes on record. And your advice towards Kuku is somewhat misdirected. I think Kuku is not mature enough to be in parliament. Let him continue gaining experience in running businesses. Taking him to parliament will first render him bankrupt during campaign period. In order to recover from the shock once elected as MP, he will go flat out with fradulant activities in order to recover his finacial position. There is nothing convincing that would make me say Kuku should start preparing for 2011. You never know, may be the Kuku you are talking about is only 16 years old who happens to have access to literature that his father who is a politician is using.

    Just to shot your dogmatic or view of issues down, am no closer to any of the tribes lined up there to be a tribalist.My own home is a typical reflection of your baseless stigma that will never hold private or otherwise. My hypothesis is based on substantiative or say matchable behavior patterns, consistency, vision, credibility, shared ideological values, chances for internal and external acceptability in MMD of potential candidate, and legislative experience not forgetting desirable line of background of leaders post LPM era. Comparatively, Saki in his steady state comes out more smart, Diplomatic, consistent, credible, sober and non managed by foreign forces besides maintaining his family among the very suffering masses in Zambia. He has never hidden or subjected his family to any foreign land sanctuary or to ship them after some immoral solicitations only. He has never torn or lobbyed for mayhem against his own country for any loss of favors. Such is salable Saki.

So you can see the kind of leaders you . This Mrs Kennedy went first only to Algeria leaving the team behind she was schelude to arrive in Algiers on the 4. 7.07 so she was doing I dont know as delegation leader.     PRESIDENT Mwanawasa says political parties, and not civil society groups, will lead the constitution-making process.

    And President Mwanawasa has asked political parties to put aside their differences and dedicate their energies to issues that would improve the well being of the Zambian people.

    Speaking on arrival at the Livingstone International Airport yesterday, Mr Mwanawasa said if the non-governmental organisations (NGOs) wanted to participate in the constitution-making process, it was important for them to affiliate themselves to political parties.

    NGOs did not have the people’s mandate for them to start championing the constitution-making process, he said.

    He wondered why NGOs were concerned with matters of government instead of dealing with poverty and hunger.

    “I feel the question of the constitution-making process should be led by politicians and not the NGOs.

    If the NGOs want to contribute to the process, they should join political parties,” he said.

    “We have never refused them from joining political parties. Why should they be concerned with matters of government? Instead of talking poverty, you have engaged yourselves into politics.”

    The President said it was a breach of the law for NGOs to abandon their responsibilities and engage in politics.

    He said Government had decided that political parties would lead the constitutional process because NGOs had continued to denounce him despite several meetings with them to share constructive suggestions on the matter.

    “I have met many NGOs and although I have made constructive suggestions, they have gone out to denounce me by calling me a trickster and manipulator,” he said.

    Mr Mwanawasa also said political differences among parties should not stand in the way of national development.

    He said Zambia was more important than individual aspirations and that it was important for political parties to take a reconciliatory route.

    He commended Livingstone member of Parliament, Sakwiba Sikota, for seconding his proposal at the inter-party summit on how the constitution should be dealt with.

    He also commended Mr Sikota for receiving him at the airport, saying the gesture was a symbol of reconciliation.

    “The last time I spoke about Mr Sikota I said a lot of bad things against him and even challenged him to join me at a political rally so that I could dress him down,” he said.

    “All that is now history and we have reconciled and are dialoguing because Zambia is more important than Mr Sikota and Mwanawasa.”

    He said he respected the decision of the people of Livingstone to elect Mr Sikota as their representative.

    Meanwhile, the President cautioned the Patriotic Front (PF) not to return to the Zambia Centre for Inter-party Dialogue (ZCID) with a motive to cause confusion.

    Mr Mwanawasa hoped the PF was coming back into the ZCID to make meaningful and honest contributions on the constitution-making process.

    PF had agreed to the constitutional conference as the mode of adopting the constitution at the ZCID summit of presidents, but changed their position a day later.

    Mr Mwanawasa said it was surprising that the PF president, Michael Sata, changed his mind on what was agreed and started denouncing him barely hours after agreeing.

    He said the PF decided to pull out of the ZCID but when the Government of Netherlands started donating computers to political parties they returned to say they were still part of the group.

    “When we first met at the ZCID summit, Mr Sata agreed with us and there was a picture where we were photographed with him on my right side like God and His Son Jesus Christ. But he changed his mind the following day and started denouncing me,” he said.

    “Today if Mr Given Lubinda says we are in it, it is because they have come to eat. We hope PF will honestly contribute to the process. If he is coming to cause confusion, I suggest that he leaves and sits with the Oasis Forum and come up with their own roadmap.”

    He asked Zambians to pray for political leaders so that God could continue giving them wisdom.

  33. #35 Kuku, Now that I have a rough idea about your age, I would advise you to find a better strategy towards 2011. Do not be mislead with people that have not tested power. Consult extensively. Get closer to people like CK, Easy, Chitapankwa, M. Daka, Tonga Bull, Chapi, Sneior Citizen, Vetran and other formidable bloggers not people like Ba Joze. If you associate yourself with people like Ba Joze, just be prepared for the negative in 2011.

Now that things seem to going in the right direction party presidents do us one more favour remove Kalumba Katele as chairman of ZCID.     Za wile’s work are has been around the notorious KMB bus stop in Kitwe, where the most vile language and obsenities are part of the Language.
