The National Constitution Conference (NCC) will commence business this Wednesday, December 19, 2007.
NCC secretariat requests all members to be seated by 13:45hours as the actual sitting starts at 14:00 hours at Mulungushi International Conference Centre in Lusaka.
This is contained in a press statement released to ZANIS by NCC secretary, Russell Mulele, in Lusaka today.
Mr Mulele noted that all members that have been successfully sworn in will begin the sittings while all those that were not sworn in last week will be sworn in at a ceremony which will take place on tomorrow, Tuesday the 18th of December 2007 at Mulungushi International Conference Centre at 11:00 hours .
Mr mulele further noted that the ceremony will be presided over by his Lordship the Chief Justice, Enerst sakala and all members are therefore requested to be seated by 10:30 hours in readiness for the ceremony.
Meanwhile, Opposition PF Mufulira Central Member of Parliament (MP) Majory Masiye has vowed not to withdraw her condidature from the National Constitutional Conference (NCC).
And Ms. Masiye has meanwhile asserted that her stay at the NCC was purely in national interest and meant to protect and safeguard the rights and aspirations of PF leader, Michael Sata.
The member of parliament told ZANIS in an interview in Mufulira today that the current Mung’omba draft constitution allegedly had a number of lacunars which would disadvantage Mr. Sata’s bid for the 2011 Presidential race.
Ms. Masiye cited a clause in the the Mung’omba draft constitution which stipulated that no persons above the age of 65 years should stand as Republican President.
This, she stated, would automatically mean that Mr. Sata would be technically excluded from the 2011 Presidential race.
She added that it was paramount that all PF MPs stood firm and openly discussed contentious issues in the draft constitution at the NCC before time was lost.
Ms. Masiye said at the NCC PF members would be in a better position to lobby other delegates to resent any draconian pieces of law that will be brought up.
She added that expelling MPs that will sit on the NCC was not the solution to the current constitutional crisist that the country was faced with.
The MP observed that the quest for a better constitution would only come through the NCC.
Ms. Masiye added that her sitting at the NCC should not be misconstrued to mean that she had stopped supporting the cause and vision of Zambia’s biggest opposition grouping.
She has since appealed to her constituents to remain resolved and support her efforts which were only bent at making Zambia a better place, adding that time for witch hunting was long gone.
Well I have not really followed this NCC thing and was wondering what the fuss is all about, but if what Ms. Masiye is saying is true, ie no one above 65 is allowed to stand, then that is sad. Another constitution targeted at an individual and I doubt the 27 PF MPs wont make a difference to change that. And the other bribed delegates will just endorse and walk away with K46 million. Just when will our leaders grow up and give us a constitution that is not meant to bar an opposition leader?

The National Constitutional Conference (NCC) delegates should consider looking at the age limit for people holding the office of Republican presidency, defence minister George Mpombo has suggested. And Mpombo said Patriotic Front (PF) president Michael Sata has demonstrated that at his old age, he is incapable of providing fresh ideas because he has become mentally tired.
In an interview, Mpombo said there would be nothing wrong with NCC delegates to consider the age limit for people to hold the presidency. He suggested that it should be prohibitive for people to hold the presidential office after the age of 80.“I think anyone above 80 years…that will be too prohibitive to hold office. The Constitutional Conference will be open to look at what is the best way. So if people talk about 80, they will be totally in order,” Mpombo said.
“Even as we sit down, we must start looking at the age limits for the presidency.” Mpombo said some people became mentally tired when they reached a certain age and in the process service delivery to the nation is affected.“We must drive towards that. Those are some of the areas that could be looked at so that the office of the President has got capacity to run the state,” he said.And Mpombo cited Sata as one of those whose minds has become tired.
“We really need to put in place safeguards. For example, Mr. Sata has demonstrated that at his age (71), he is incapable of providing fresh ideas,” Mpombo said.“There are certain fellows who could be very bright, like the Vice-President Rupiah Banda who is also 71 years old. He’s full of mental drive. He is an intellectual dynamite, but for Mr. Sata, it’s his age coupled with his educational background.”
Mpombo said unlike other old leaders who could perform their duties diligently, Sata was “woven from a different kind of material”.“So for Mr. Sata, the problem is his mental capacity…his own background, the way he reacts coupled with his level of education,” Mpombo said.“For Mr. Sata, he’s woven from a different material mentally.”

TWENTY-SEVEN Patriotic Front (PF) Members of Parliament (MPs) who have registered to participate in the National Constitution Conference (NCC) have obtained an interim court order restraining their party from expelling them.The Lusaka High Court granted the ex-parte order for interim injunction to Kasama Central MP Saviour Chishimba and Shiwang’andu MP Celestino Chibamba who filed on behalf of 25 other PF MPs who had registered to take part in the NCC.

Parliament cannot change the constitution but propose motions and debate them. Mungomba constitution review. What the NCC is doing is to look at the MCR and make proposes which will be then be tabled in parliament. CHILUBA is still vindictive and bitter about my restoration after he tried to destroy me in 1997, Mahtani Group of Companies executive chairman Rajan Mahtani said yesterday.
Reacting to former president Frederick Chiluba’s recent statements urging the government to clarify rumours that there were instructions for some parastatal companies and government ministries to divert business from ZSIC and Zanaco to Professional Insurance and Finance Bank owned by his group of companies, Mahtani said he was aware that Chiluba was on a mission to pull him down.
Mahtani said Chiluba had on two occasions in the recent past made adverse comments and unprovoked attacks on his person.“This is most disappointing, painful and hurtful and attach a stigma to my character and integrity,” Mahtani said.
“Despite having been close friends and brothers in Christ, it is incredible that the former president, when in office, chose to incarcerate me on false and trumped up charges of treason cognisant of the fact that such an offence was not bailable, his master mind concocted a charge in order to ensure that I was incarcerated. Can he explain to the nation why he chose to incarcerate me and link me with the 1997 coup attempt and Captain Solo?
“Why was he so vindictive? Is this not the action of an evil dictator? Can this be construed to be an action of a person who respects human rights, democracy, rule of law and fair play? Is this the reward that you give to a friend and brother in Christ?”
Mahtani said the grave injustice caused to him, his family and operations by Chiluba were premeditated and deliberate with the intent of taking his life with impunity and ruining all his businesses he was associated with. He asked whether or not Chiluba honestly believed that incarceration in Zambian prisons on false and malicious charges was a reward for an innocent friend.
“Does he have a conscience over actions that proved abuse of office by virtue of power or does he claim drug inflicted amnesia?” Mahtani asked. “Does he believe in the empowerment of Zambians or in the contempt of pulling everyone down for his own benefit or desires?”Mahtani said he had chosen to follow biblical principles in forgiving Chiluba because he vehemently believed that vengeance was not his but the Lord’s. He said although he kept silent for these reasons, he was requesting Chiluba to
