FTJ has a Case to Answer, Trial Date Set

Former Republican President, Frederick Chiluba has this afternoon been found with a case to answer. This is in a case in which he is accused of stealing public funds amounting to $488,000.He faces a minimum of five years in jail if found guilty.

The Lusaka Magistrate Court has consequently asked Dr. Chiluba and his co accused, to defend themselves. Magistrate Jones Chinyama set the trial date for May 5. Chiluba denies any wrongdoing.

The former president is accused along with former Access Financial Services Chief Executive Officer, Faustine Kabwe and Managing Director, Aaron Chungu.

They all face 12 counts of theft.

Dr. Chiluba and his co-accused are expected to start their defence at the next court hearing scheduled for May.

Principle Resident Magistrate, Jones Chinyama was satisfied that the prosecution has proved its case against Dr. Chiluba and his co accused beyond reasonable doubt.

Mr. Chinyama further said ledgers and other accounting documents admitted as evidence by the prosecution are conclusive and can not be easily dismissed.

The entire case revolves around funds paid to Dr. Chiluba’s children, which were trasmitted from the Zambia Security Intelligence Service account at the ZANACO Bank London branch called the Zambia Transregional Operations Account (ZAMTROP).

According to evidence produced by the prosecution team, funds were diverted from the $9.6 million meant to pay two United States firms Wilban Incorporated and Systems Innovations for upgrading security installations at several strategic government departments.

Mr. Chinyama said in his ruling delivered that Part of the funds were also used to buy houses in Lusaka’s Roma and Kabulonga residential areas for two Lusaka Lawyers, Eric Silwamba and Vincent as renumeration for defending Dr. Chiluba in the 1996 presidential petition.

Mr. Chinyama said his findings are not withstanding Dr. Chiluba’s assertions that funds paid to his children from the ZAMTROOP account were from private sources and had co mingled with the government funds in the ZAMTROP account.

But Chiluba has said some of the funds were his own money, given to him by his friends, while the rest was for national duties taken by the intelligence agency.

He is also fighting in court to block authorities from recovering $58 million that last year a London high court ruled he had to repay, with interest, for allegedly stealing while in office.

Zambia lodged the civil case in British courts in the hope of recovering properties allegedly purchased with stolen funds and owned by Chiluba and 19 other defendants in Britain and other European countries.

Chiluba has not been convicted on criminal charges of stealing the funds and he does not recognise the authority of the London court

  1. I hope this trial take one month maximum. We have just lost too much money as a state on laywers fees. That coupled with abuse of public funds by LPM’s controlling officers since they came into power, I can bet we are talking about more money lost than the money we ate trying to recover in this case.

Our justice system is so slow that by the time the finish this case the guy will be dead!! or they will go half way spend billions of kwacha and then state will enter a nolle prosequi.

Given the time it has taken to wind up on the preliminaries, I wonder how long it is going to take for the trial. Like someone pointed out, it is the lawyer’s case. How prudent is it that the London court started the case after our Zambia, courts and still managed to dispose of the case while our court was still on preliminaries. Talk about the efficiecncy of our court system, WOW!

  8. I think it’s time to leave Chiluba alone. Courts should not be used to harass one’s enemies. It has been more than six years since the man’s immunity was lifted. Any serious courts manned by law men with half a brain cell would have concluded the case one way or the other. LPM and his minions are not serious. It is time they discontinued this charade. Lawyers are getting richer but there is no justice for the down-trodden Zambian tax payer. Sad!

  47. The major contribution to the delayed Chiluba trial is the continued adjournment by the Chiluba legal team citing ” medical issues”.
    In this case the State should adhere to due process until these cases are disposed of in the courts of law.
    This notion that somehow Chiluba is being persecuted for political reasons is pandering to cheap and sectarian politics. We, the people of Zambia, through our Attorney General have a strong prema fasie suggesting that Chiluba defrauded and grossly mismanaged our resources.
    Let him attend court and prove our case against him otherwise. We are a nation of laws, if he is innocent he will walk and, equally so, if he committed the crimes he must do the time.

Anyway, now that we are finally getting there, we want to have every chap who participated in these shameful activities brought to justice and most importantly to pay back the money, it must be recovered at all costs. Infact there are a lot of chaps who have properties that they cannot account for, especially civil servants, ZRA etc. We must be seen to get down to low levels inorder to make a difference! A Kafupi mwatilengeska, just say sorry and bring back the cash, Zambians are very forgiving, its our nature and we are proud of it!

Zambia does not yet have effective ICT laws besides, LT is not registered in Zambia so they can’t be “stup down” from within Zambia. The best thing you can do is just to contribute to the topics because if you are shopping around for respect and praise, you might not find it online, on blogs.

Levy has not been managing our parastatals such that funds in their accounts are now being hosted by private banks instead of ZANACO. He sold shares of Zanaco to foreigners regardless of what the amajority of citizens wanted. All insurance policies for all parastatals are now handled by a private insurance firm, Professional insurance. This was done WITHOUT any tendering for this service. Levy has appeared to be protecting KCM even when the company has poisoned citizens via dangerously polluted water being let freely from its operations into the Kafue and public water works. Thus Levy will have to go in too.
