I’m Innocent, Cries Francis Kaunda

FORMER Zambia Consolidated Copper Mines (ZCCM) chairman, Francis Kaunda, has denied allegations that he abused his office and conspired to defraud ZCCM by offering Ndola Primary School to Ndola Trust School maintaining that he is a man of high integrity.

In the first count, Kaunda, is charged with abuse of authority after he allegedly offered Ndola Primary School to Ndola Trust School.

In the second count, Kaunda and Access Financial Services (AFS) director, Faustin Kabwe, are charged with conspiracy to defraud after they allegedly conspired to defraud ZCCM by offering Ndola Primary School to Ndola Trust School, an act that was prejudicial to the interest of the Government.

High Court deputy registrar, Edward Musona, found the two with a case to answer and subsequently put them on their defence.

Testifying in the matter, Kaunda, 70, a business consultant, maintained that he was denying the charges against him.

He explained, during evidence led by his lawyer, Fred Mudenda, that in 1974, then Republican President, Dr Kenneth Kaunda, appointed him managing director of Metal Marketing Corporation of Zambia (MEMACO) and later Nchanga Consolidated Copper Mines (NCCM).

Kaunda testified that in 1981, NCCM and Roan Copper Mines (RCM) were merged and that Dr Kaunda appointed him chairman and chief executive of ZCCM, which he headed for 10 years.

He told the court that he was removed as chairman of ZCCM without reason or explanation when there was change of Government in 1991 and that during his career, he handled huge sums of money and that his integrity was never questioned.

Kaunda said in March 1997, he received a surprise call from then Republican President, Frederick Chiluba, that he was having sleepless nights concerning the privatisation of ZCCM and asked him if he could assist.

He stated that he suspected that Dr Chiluba asked him to help because of the manner he left office and that it took the Government almost two years to pay him his terminal benefits.

Kaunda said as a patriot, he accepted to assist and did not know that he was going to be appointed chairman of the privatisation team.

He said that his contract was signed on May 14, 1997 by then secretary to the Treasury, Professor Boniface Mweene, and that the contract stated that he was a public officer and a consultant.

Kaunda said it was not true that he was contracted to sell core assets.

  1. whats this business of sending everyone to court in Zambia these days? What was wrong with making Ndola primary into a trust school.Trust schools offered high educational standards on the copperbelt. So many children benefited from them.So whats the big deal. How many times did govt owned schools experience strikes.Francis Kaunda saved the day if he indeed turned it into a trust school. Come on Zambia focus on development not these petty issues.

  2. F. Kaunda was entrusted with a lot of responsibilities for Zambia and served very diligently. Gentlemen, if we have failed to solve the cobalt scandle, and other big transactions regarding privatization of many govt assets, stop this nonsense of a trust school thing! The guy has handled huge amounts of money on behalf of govt for a very long time! The trust school thing should be one among many other dubious deals if the guy was very corrupt. How can one serve for over 40 years and only get corrupt at the very last minute over only one deal? Lets get serious plz, investigate big things that have impoverished us and our unborn children! I will not be happy to see him go to jail unfairy!

  4. #3 inonge, Kaunda is not charged with creating trust schools but what he did after he left ZCCM and then beca Chairman of the privatisation of ZCCM assets. He sold the school to a trust which he had shares in without disclosing so, that is illegal in any country! Look at the charge…

  6. Zambia has a lot more to benefit by focusing on the opportunities instead of chasing ghosts. The monies in question are probably little and might be finished. The cost-benefit analysis of the state taking these guys to court will not be in favour of the ordinary zambians. There is need to focus on ensuring that the old trends are not brought back in the modern era. Let’s focus more on providing quality education, medicines in hospitals, empowering our people through employment and entrepreneurship skills. The chiluba era was a time of theft but we now have a chance to move in the correct direction.

If he is innocent then you have nothing to worry about but then if he is not, you better hope you trip to the US was not financed by his ill-gotten gains. By suffering do you mean him not being able to get medicine at UTH or not able to get clean drinking water or decent shelter or food like 80% of the Zambians? Just curious

How about the sale of the mines for a song for which your Dad was in charge. How much did he get in kickbacks? How much of those assets he was tasked to sell did he strip for himself and his colleagues? Some of us can wrote a book on what was going on. Please stay in the States, you have no idea what suffering your Dad and his colleagues brought on the Zambian people.

Let there be special courts to handle corruption cases as the would take a short time frame to come to conclusion. The way that man presided over the sale of our assets was purely satanic, ask Nawakwi and she will tell you that if Chiluba is a thief, and we have found him so in London Court, then Francis Kaunda is a top notch bandit. He should be jailed for his economic crimes, let him rot in jail.

Perfect example is the person calling himself “prof. mutengo waminga” who seems to be bent on insulting rather than analyzing the current economic and social quagmire affecting Zambia. One would expect such an individual to be learned and show a level of decency and some intellectually inclination to address issues. What people need to appreciate is that blogging is about being able to express well thought out ideas and contribute to the body of knowledge.

  41. I worked for the prisons for more than seven years as a senior staff. Believe me or not, most of the names of convicts are bemba related. But may be this could not show a true representation since i worked in 3 provinces out of the 9.
    However if one wants to get the true picture, do a research and get the statistics from prisons. Am sure someone can fund such a research. This can show us the people who, partially, are responsible to the country’s downfall.
