Shikapwasha not impressed with police permit granted to PF

HOME Affairs Minister Ronnie Shikapwasha is surprised that the police on the Copperbelt have issued a permit to the opposition Patriotic Front (PF) members to protest over the election of President Rupiah Banda.

He said he could not understand the rationale because the permit when the political party had already petitioned Mr Banda’s election in court.

And Lieutenant General Shikapwasha has warned that Government will deal firmly with individuals trying to fuel anarchy in the country.

But PF secretary general Edward Mumbi said the party had not yet taken the matter to court and its members who wanted to protest peacefully should not be barred.

General Shikapwasha was reacting to media reports that opposition PF on the Copperbelt is this Saturday scheduled to hold a peaceful demonstration to register its displeasure over Mr Banda’s election as Republican president.

Copperbelt Police commanding officer, Antoneil Mutentwa was reported to have said the PF was given a permit to allow them to hold a peaceful demonstration because it was their constitutional right.

But General Shikapwasha said PF had already petitioned Mr Banda’s election in the courts of law where they wanted a recount in certain constituencies and should therefore wait for the court’s ruling on the matter, instead of resorting to protests.

He said he was also surprised that despite knowing that the PF had already taken the issue of elections to court, the police on the Copperbelt issued a permit to the political party to hold peaceful demonstrations.

General Shikapwasha charged it was anarchy for individuals or political parties to protest over the issue, which was in court and warned that Government would deal firmly with individuals trying to fuel anarchy in the country.

“It is not a constitutional right to resort to protesting on something you have already taken to court. This is anarchy and we shall not allow anarchy in the country. PF should just wait for the court’s ruling on the matter.

PF was beaten clean and squarely and if the court rules that a recount be done, they will end up losing more votes,” General Shikapwasha said.

Mr Mumbi said that the fact that his party was about to take court action to call for a recount should not stop people from exercising their rights.

Protest then what? we all know even if you have court cases nothing changes with RB as head of state.   13. MMD is in the forefornt of causing anarchy in the country. They have started arresting people who are democratically expressing their opinions. The arrest of Fr. Frank Bwalya will just bring more troubles. MMD should just concentrate on fullfiling their promises rather than wasting time chasing people around.

The only way you can remove MMD is to vote UPND because Sata even if he won, the armed forces would not allow him to rule because of his instability which those with the mandate to ensure that peace continues in Zambia feel may fuel arnachy in the country. The point is thus not to remove MMD from power but to prevent Sata from getting into power and if in the end MMD remains in power, the armed forces have got no problem. I shasre the same views with them because they are the ones with the responsibilitity to ensure that we continue to enjoy peace and Sata is highly unstable. Sata changes frequently and you cannot have such a head of state who can even lead you into war.

  17. It was very wrong for the CB commanding offer to do that, when the matter of elections is already being addressed through legal procedure and the vote verification is already in process. This does not maike any sense as no one has denied PF any legal redress. So protest agains what? The calibre of our officers need to be checked, I do not think Mateyo will even allow that.     you are right we want Change but not just Change. change must be for the better. Prior to Elections i thot HH was the better change but then the Post convinced me that UPND was regional and tribal so i went for PF. thats the worst regret ive evr had. yesterday i looked at the ECZ electrol map pull-out, i have since realised that PF is infact more regional and tribal than UPND. Sata only Won in Bemba speaking areas particularly towns with Big bus stations. even in northern he lost the mambwe and namwanga vote then carried the bemba by landslides. i will never vote PF again and i salute the rural people for giving us LPM and Now RB there wisdom is well diserved.

Even what we think is confusion, I have come to see that for them it is a way of life. If you critacaly look at the results of the voters against the registered voters and the number of constituencies won by RB compared to Sata you will discovere that RB won Genuinly and across a wide section of the country.     I like your rationale over the expectation that CB officer must consult IG. But I dont want to assume that your reasoning was following by the CB commander much as it is the ideal thing to do. I will tell you one thing; Mateyo has said time and again that he will not involve himself in matters of permit. He has always told the nation that he has decentralised the issuing of police permits. Now, it takes a commander with a sense of logic and analysis to differentiate cases at hand, to know which case is ordinary and which is not. That is why I used the term ‘Calibre’. Because much as they have been give authority to give permits, there are unique sensitive issues.

However, there are circumstances in which the police can on reasonable grounds advise against the demonstration provided they communicate with the would-be demonstrators at least three days before the demo and the police give an alternative date. It was decided in the Mulundika case that the freedom of assembly association and speech cannot be left to the whims and caprices of police, hence, no pemission is required. I think it is incumbent upon the organisers to use their make sure that their demonstration doesn’t breach the peace.

If the constitution had no logic there was going to be no need to have lawyers and judges to interpret it. What you see as ‘their right’ in the constitution may be viewed differntly by most including other lawyers and most judges.
