Former Chief Justice Mathews Ngulube makes submission to NCC

Former Chief Justice Mathews Ngulube says the legal immunity availed to the state should not be extended to individuals holding public office.

Justice Ngulube says public officials such as ministers should be made accountable for their actions in the course of their duties.

He told the National Constitutional Commission’s Human Rights Committee in Lusaka, Tuesday that the move can help to enhance good service delivery.

Justice Ngulube was making a presentation about Article 80 which deals with the enforcement of the bill of Rights.

The former Chief Justice also said there is need to avoid a situation where some individuals may abuse the right to institute legal action on behalf of an aggrieved person.

When People like former Chief Justice Mathews Ngulube speak out, there is sense in what they are saying, things that can wake selfish people up so they know that the positions they hold are not for enriching themselves but to serve the Zambian people. Lets hope his submissions will be written in the new consititution. These are wise men who know what they talk about. If only most politicians would think like this.

Mathews i totally agree with you.If we look at the hot issue involving Dora Siliya,she is being treated like she has some immunity.Despite her holding office she has to answer to the allegations against her.The fight against corruption in our country wont yield in results if other people are treated as special ones.

    • In as much as you guys agree to that we should also the benefits or effect of such laws that are targeted on a particular individual so i dont agree with you guys lets not form a rule based on one person its wrong

  3. Mathews is right if we are going to fight corruption but if leaders are going to sweep corrupt practices under their carpets then, this submission will be thrown out by these NCC delegates.

  5. Justice Ngulube as a beneficiary of Zamtrop money knows the neggative effects of corruption. So NCC implement this wise advice. We know NCC are enjoying taxpayers money and doubt if such submissions can be valued.

  8. I dont agree with Mathew Ngulube in that its based on the current scandal of Dora Siliya but thats not the right way of coming up with a constituition coz it will not focus on the future but on individuals

    • Dr Bill, if you have noticed our system of Governance is not focused towards the future. Just look at the same MMD when Levy (RIP) was President, no one saw the need of having a party Vice President, instead everyone was confortable with it.

There are so many serious revelations that are coming.But because the people involved are looked at as sacred cows,nothing is happening in ensuring that people who are mentioned are brought to book. With such wonderfull submittions people like Dora Siliya cant be above the law.We need people who will submitt sensible staff like Mathews Ngulube,for our constitution to be a respected document.   13. Yes, JI totally agree with him. Justice Ngulube was well meaning but was simply smeared of the dirt by Chiluba. I hope they did not withhold his pension, Zambians owe him more than Kafupi tried to smear on him. The man was a very good Chief Justice.

Now answer me, U resigned because you were corrupted by FTJ, he gave u slash funds from Zamtrop Account to buy a house and you gave a favarable pertition hearing to support him and levy when mazoka was dribbled.   17. Ngulube knows what he is talking about. He is actually talking about the immunity of the President. There is a tendency in the Presidency to commit illegal acts (including corruption) particularly using OP and claim that such acts were committed in interest of the state. This is a line that the Judge is saying should be drawn. Example of this could be mixing Presidents personal funds or that of his political party with that of the state, to protect the President / his political party from blackmail from his dubious contributors. Certainly such an illegal act cannot be in the interest of the State but to protect the money laundering activities of The President as an individual. Such acts can…

  19. Such acts can there not be covered by immunity. This issue goes further to even cover acts of fraudulent acts of selling Zambian companies under the pretext that was done because of pressure from Donors or order for Donors to release support. Whether there is Donor pressure or not, that is no substitute from following the law in disposal of national assets. This is my understanding of this presentation; I hope NCC understands the logic behind the submission made by this great mind

  21. Rubish!! This guy brought a lot of disgrace to the credibilty of the judiciary after being implicated in the zamtrop matrix. Imagine the castodian of our justice system being prone to such levels of compromise? What hope does a poor child from whom we borrowed this country have in the future if people like ngulube let FTJ’s injustices happen on their watch let alone participate in it. We are all entitiled to commit crimes apart from those in the justice system. This is the unwritten yet most supreme law in any social justice system. Who shall guard the guards?

  22. Good point, but we as Zambians also need mechanisms to check the President and his/her Vice President also. So let us not limit this to Ministes and MPs alone. We are all equal despite the positions of offices we hold and let not one be above the law all the time so that we can have proper checks and balances and provide a way for Presidents to resign is they fail to perform.
