Ndola businessman accuse Judges of conniving with corrupt lawyers

A Ndola based businessman has urged government to control the mushrooming of law firms to protect the general public from exploitation at the hands of unscrupulous law practitioners.

Speaking in an interview with ZANIS in Ndola today, Edward Ng’andwe alleged that some law firms in Ndola were corrupt and taking advantage of clients who have little knowledge in legal issues.

Mr Ng’andwe also accused some judges at Ndola magistrate’s court of conniving with corrupt lawyers to acquit offenders.

Mr Ng’andwe, who claimed to have been duped buy a lawyer from a named Ndola based law firm, urged government to monitor the operations of private law firms so that innocent citizens do not suffer because of corrupt lawyers.

The Ndola businessman claimed that he was duped by a lawyer from a named Ndola based law firm in a case where he was involved in a road traffic accident in which he lost 46×50 bags of groundnuts worth about K400 million and the transporter he hired to transport the bags has not compensated him because he seems to have been protected by the magistrate’s court and the lawyer which the complainant used.

He alleged that a magistrate connived with the lawyer so that the transporter could be let scout free despite the charges that were laid against him earlier.

Mr Ng’andwe said he has not recovered anything since the accident happened in December, 2007, yet he has spent about K7 million in pursuing the case.

He named the transporters as Justine Phiri and Rabson Banda both of Chimwemwe residential area in Kitwe, the duo popularly known as Jafira.

  1. Iwe N’gandwe. Do you run a straight business yourself and pay your workers minimum wage of K600,000? Let judges do their job. If Lawyers dont open their own law firms, who is going to employ them?

  2. Law firm’s cannot just mushroom, you know what I am saying…to start or apply for a permit to run a law firm you have to have an education in law. We are not talking about a kantemba business which you can just work up and start…get the point?

Folks hold your fire……….lawyers are also human beings and they can err too.In a society where corruption is rife,like in Zambia,I dont think there’s alot of clean people,lawyers inclusive.Corruption’s a norm in Zambia…….you cant get anything done without it……of cause there’re a few exceptions,but that’s the reality on the ground,like it or hate it.
    My question is:where’s LAZ??I thought it’s supposed to monitor it’s members…….

  7. People always call lawyers dubious when the case doesn’t go their way. If you set foot in court you have a 50/50 chance of winning and losing. What this looks like to me is that the businessman had no knowledge of law whatsoever, he thought the case would be decided on emotion and sympathy. Sadly the law doesn’t work on sympathy and emotion it works on law and fact. Every law firm has a complaints procedure that should be taken up by LAZ, the fact that this man is crying out to government shows the judgement was right.

  8. Its sad Mr. Nga’ndwe that you have lost such huge amount of money. But the thing is that you can’t put the blame on the judge, blame your lawyer who didnt bring your case to the judge in a way that he it was supposed to be ruled in your favor. Try to appeal to a higher court and see how it goes and also use a different lawyer. On a different note, lawyers, judges policemen bla bla bla are all human beings who have families to feed, in these hard economic times, they might fall to temptation too, and we shouldnt look at them as super humans. People, remember how Chiluba furnished the houses of Judges during his nationality case, then later on he won, wasnt that bribery?……i will end…

  9. You chaps you don’t know what you are talking about. It is only a person who has been to the courts for years persuing the case who understand the depth of corruption in our courts. I for one at first thought corruption in courts was only at local court or magistrate courts. There is corruption everywhere. What I discovered myself was infact when a criminal pays a defence lawyer some money, that money is shared with these so called judges!!! I have evidence!!

  10. #5 Minkofwa: Not all lawyers or judges are corrupt, but I also suffered the same fate. My goods worth K25m were sold off by bailifs inspite of the injuction. I sued these bailifs and the court clerk but what happened is that these bailifs went to my lawyer who all of sudden started to give excuses why he could not come to court. I got fed up after 1 year and dropped the case. Thank God that these chaps got punished in some ways.

Not just Lawyers and judges are corrupt even the court clerks and office orderlies are all corrupt, You would find that a court clerk is coniving with the judge for the files she is keeping so that when the clients case is due that person will be adjourned being told that they can not find the file just for the interest of the person who has bribed them, nowadays you will find that by the time a court clerk is knocks off, they knock off with a lot of money and we know that nothing will be done but God will deal with them.

  12. I know several crooked lawyers pa zed. I live here and I know what I am talking about. The Zambian judicail system is rotten to the core such that no amount of overhauling can change anything.

  13. # 13 you very right most of these friends of ours dont know what they are talking about and they are not familier with what majority of this young lawyers are doing.we stay with them in the same communities,they are our neighbours,friends and we have used them to when we are on the opposite side of mr ngandwe.Yes they are learned and are propery registerted but I still fill they need to be monitored,its aquestion of how heavy is your pocket

  14. I’ve worked in a law firm, and do know that judicial corruption exists. Don’t take things at face value.

  15. To simply lare bare a general charge of corruption against judges or lawyers is not fair. If evidence exists, why not take legal action? Law firms dont mushroom. These are statutory firms that are licenced to operate. Tuntemba mushroom. I sympathise with the gentle man though he is partly to blame for the situation he finds himself in. Lets not perpetuate corruption. Lets fight it with the venom required to destroy it. Mind you, am not saying corruption is not there, but the question is what are we doing about it? To simply say judges are corrupt, is not fair.

  18. I only have one question for Edward Ng’andwe, Who was responsible for insuring the goods, you or the transporter? It it was your responsibility but opted not to take out any insurance, this loss falls squarely on YOU. You cannot turn around and blame it on lawyers/judges. I am not disputting the corruption in our court system, I have experienced it before. However, your was a business arrangement and you ought to have known the risk involved in transporting goods. In future, protect yourself by taking out insurance. Sorry, fighting insurance companies is another story!

  20. Yawn,,,,,,! What else is new? The police protects us from the criminals. But who protects us from the police? c’est la vie! Hire a lawyer and take them to court. Oh, I forgot you DESPISE lawyers and Judges!

  21. Laws form up the largest population of corrupt professionals in Zambia. They making they money by conniving with Criminals and Judges. The Government Should probe many of these Law firms( usually renting two roomed offices) and their source of wealth. Ninety Per cent is ill-gotten. Lawyers are shameless crooks. But because they get their money but making other people suffer, they always pay back their sins in one way. This Country needs Economists, Accountants, Engineers, Doctors and scientists to Develop. Lawyers are just unnecessary lot.
