
FORMER Communications and Transport minister Dora Siliya will seek judicial review over the Dennis Chirwa tribunal pronouncement that she breached the Republican Constitution because that was beyond its mandate.
Ms Siliya said in Lusaka yesterday that the findings of the tribunal that she breached Article 54 (3) of the Constitution by failing to heed the attorney-general’s advice was never levelled against her as an allegation.
Ms Siliya, who stepped down as Cabinet minister on Tuesday, said she never had an opportunity to rebut the claim that she breached the Constitution in the manner she defended herself of the other allegations during the tribunal sittings.
“It is my considered view that the honourable tribunal exceeded its limit when it purported to pronounce itself on the legal status of the Attorney General’s advice.
“I have since sought the advice of my lawyers and, hence, intend to institute judicial review proceedings to address the propriety of this finding,” Mr Siliya said.
She was, however, grateful to the tribunal for establishing that she did not breach the Parliamentary and Ministerial Code of Conduct Act on all the allegations levelled against her.
“This finding clearly demonstrates that in the execution of my duties as minister and member of Parliament (MP), I did not gain any pecuniary advantage or convey the same to any other person,” she said.
Ms Siliya, who is Petauke MP, said the findings also confirmed that she did not abuse her office as minister and MP.
She said her decision to resign was not in any way intended to lend credence to allegations and innuendos suggesting wrong-doing on her part but to bring to an end a malicious campaign that had distracted the nation from productive activities.
She urged Zambians to re-focus their energies on addressing the economic challenges facing the country and thanked the people of Petauke for standing by her.
Ms Siliya reiterated that she never committed the Government to a US$2 million contract for the evaluation of Zamtel assets as stated in the statement that she issued in Parliament which was prepared with her ministry staff and the solicitor-general.
She said the evaluation of Zamtel assets was an initiative of the Ministry of Communications and Transport in an effort to assess the problems at the company.
“The consultancy costs for the evaluation as explained to Parliament and approved in the 2009 budget do not exceed US$50,000. This was again repeated by his honour the vice-president in which the solicitor-general personally again played a big role in drafting,” she said.
Ms Siliya said the $2 million was merely an expression of interest or quotation by the evaluation consultants as transaction advisor if the Government made the decision to sell.
And Chief Government spokesperson, Ronnie Shikapwasha said in an interview in Lusaka yesterday that the debate on whether Ms Siliya should vacate her parliamentary seat or not should be guided by the outcome of the tribunal.
Lusaka lawyer, Abraham Mwansa, who is the convener of the Law Association of Zambia human rights committee, said the tribunal should have recommended specific measures for President Rupiah Banda to take instead of making general recommendations.
“I personally feel the tribunal should not have left the issue to politicians. It should have made specific recommendations to the president with specific measures for him to take,” Mr Mwansa said.

I am not a lawyer but I noted this before. It is like the case of Kambarage Kaunda who was charged with manslaughter but the court found him guilty of murder. The tribunal was to rule on the lesser charges but instead delivered a judgment which was irrelevant to what the complaint was all about. I am disappointed that our learned judges can so lamentably fail to discharge their duty within the mandate they were given. I am totally opposed to corruption but I think Ms Siliya has been dealt an unfair hand. They wanted to protect the office of the AG but his advice is NOT law. Otherwise we could not sue the AG.
She is free to do that anyway.
I have just downloaded the tribunal report on Dora Siliya from the UKZAMBIANS website. It is about 108 pages.
I think we should let Dora practice her rights and defend her name. She has every right to do so. Some people are just hateful especially considering some of you prejudged Dora even before the tribunal report came out.
It would be interesting to see if you’ll accept the results, should Dora win this second development.

Let her go ahead without undue criticism and pursue her constitutional rights. What it also does for the the good of the country is it defines the do’s and donts or precedents. IWhat is not clear is what she wants to seek judicial review for. Is it aginst the fact that she was found to have breached the constitution ?or the right of the the tribunal to find her guilty owithout her having the recourse to the natural laws of justice (the right to be heard). Besides, the consistution does not say that the advice from the attoney general is binding it should just be sort period! what one does with the advice is up to him/her. If she is seeking Judicial review, she should then keep quiet other than just yapping around any how. Who is she trying to convince that she innocent? We all know know what has happened. I have decided to take up his advice. It was either free-market-economist or free-market-extremist. I went with the first one.
No human being is infallible. Even ourt courts make mistakes. Many an innocent man has been sent to prison and even to the gallows by courts of law. The judges and tribunals act on the basis of the ‘facts’ before them. However, these learned men misled themselvews by concluding something that was not on the charge sheet! It is a simple law in natural justice, that you answer to what is on the charge sheet! Ms Siliya has every right to clear her name, even if she is not going to be a minister or MP. To go on with the charge that she is the one who breached the constitution is serious and she must be allowed to defend herself on that charge.

I actually agree with Dora , The tribunal acted outside it’s powers and their findings were not legally sound.Zambian case law is inconsistent and sets precedents that are antagonising. In my own personal opinion the tribunal was not driven by judicial expeditious efficacy but was driven by popular opinion from the public. Dora was tried on public opinion not law , I have a feeling the judges were just succumbed to cries form the public. Judges should be impartial in their findings instead of behaving like village headmen who succumb to popular opinions.
Im sure the Tribunal Judges and the Chief Justice would also want to defend their integrity. So I guess it will be the Dora vs The Chief Justice. Dont be surprised if MMD cadres start calling for the removal of the Chief Justice. Lets wait and see.

I hope Mr President RB Banda will advice her to relax from starting up with the Judiciary and appoint her as Minister (of Justice) since she did not do anything wrong in her past dealings as a Minister. Yes I do believe there is such a thing as free market economics. I just know of one place where we can see the beauties of free market economics and how it has worked to the benefit of the place. That place is no other than Hong Kong. Though it does not have a perfect free market economy model, it is the best real life example I could think of. I am not removing the role of govt in economics, I am just for the notion that govt must only be there to cater for market failures.

I was amazed at how often the existing law over and over again said: ‘The Minister shall…’ This was a refrain like a mantra. You would think that it is actually the minister who does the work but apparently it is the PS and the minister only signs on the dotted line! The tribunal findings are a clear reminder of why we are poor. People who should be better judges have connived to frustrate a good intention. The AG for whatever reason, didnt not careless what he was penning in his ‘high opinion’. The POST newspaper are right in the middle of the lurch of the retards. Their intent to harm Dora has blinded them to the sincerity with which aimed to achieve good. They are not concerned that the system has been misapplied resulting in the innocent person being blamed for her good effort. AG’s opinion in this matter was misplaced if one has an eye to see.

Dora has the constitutional right to go for a judicial review. But she should remember that the Harrington and the civil society organizations that that took her case to the tribunal and their posse of lawyers are not sleeping, but still baying for her blood. She may just open a can of worms and unleash forces she may not be able to control. Good luck to you Dora!
This is how lawyers “chew” money from dull and ignorant clients like Dora. It is a matter of fact that when you hire a lawyer, they will assure you even of impossibles; even where they know that you are clearly guilty. Now, if you are so dull and mediocre like Dora, even after being pronounced “guilty”, because your lawyer failed to defend your indefensible case, the same lawyer would still attempt to suck the last of you by convincing you that it is possible to magically change you from being guilty to innocent. My advice to you brainless Dora is that, shut up and go into hiding so that people can forget about you. That way at least you can drive around Lusaka without being called all sorts of names. Bottom line is there is no way you can convince anyone otherwise. You are condemned.

I did not expect “iron lady” dora to take it lying down. And she is absolutely right and she will win. Firstly, what kind of justice is it that condemns someone for a crime that she has not been accused of, let alone given a chance to defend herself?
Secondly, the constitutional article that she is alleged to have breached is crystal clear: it required dora to “seek the legal opinion of the Attorney General”, but once the opinion is given there is no obligation to follow the advice.
This is a clear-cut case where the judge will know the verdict even before he hears the case. There can be no two justices, one for mmembe and another for dora. Justice for all !!!!!!

so lets go for a judicial review and open the fraud cases in petauke, i think dora is a bit misled by eric silwamba. in the tribunal they saved her ass by not sticking to the findings on the 12.5million kwacha which the tribunal constantly brushed aside as a fraud case. she forgets that she confessed to not understanding NULLITY. today she becomes a champion to challenge the same judges?
So from the learned lawyer blogger’s, does it mean that when a judicial review takes place, issue not previously tackled in the tribunal can surface up? i bet Dora was saved from going to prison on the fact that the corruption , embezzlement and fraud issue was not a mandate of the Judge chirwa tribunal. so such cases should be taken up by TIZ and take them to criminal courts so we see who has been telling the truth?
