LAZ backs plans to reorganise Attorney-General’s chambers

THE Law Association of Zambia (LAZ) has supported President Rupiah Banda’s plans to reorganise the Attorney General’s chambers if the measure will enhance efficiency.

Speaking in an interview in Lusaka yesterday, LAZ president, Elijah Banda said the association was in support of the president’s decision.

“Any such change is welcome if it will help enhance efficiency in the operations of the office of the Attorney General’s chambers,” Mr Banda said.

He said the Attorney General’s chambers had performed well as it was run by eminent lawyers who, by LAZ standards, had done extremely well.

Mr Banda said LAZ had so far not discovered any shortcomings in the way the lawyers in the Attorney General’s chambers had been operating.

He said despite the lawyers at the chambers working well, the president, as the appointing authority, had the powers to make changes.

“The president is the appointing authority and he is at liberty to make changes where he sees the need to do so. For as long as he considers to do so, he has the legal right,” Mr Banda said.

He said the president could not be compelled to divulge reasons for the changes, as when making appointment for such officers, he did not inform the public why he had done so.

“It is not important for the president to give the public the reason for the changes because the decision is entirely in the hands of the appointing authority,” Mr Banda said.

On Tuesday, President Banda said he would reorganise the Attorney General’s chambers to prevent the recurrence of confusion, which surrounded the provision of legal advice to former Transport and Communication minister, Dora Siliya.

The president noted that the tribunal found that Ms Siliya was somewhat misled by the confusion in the Attorney-General’s chambers and it was, therefore, necessary to reorganise it.

Again our Constitution is failing us.There is no way the Presdident can have so much poers in almost everything like GOD.If he can make changes in the operations of the AG,how can we believe that he doesnt interfere with the judiciary.we have to re-look into oyr consititution so that those sweeping powers vested in the President are reduced to acceptable levels that will separate the Legislature and Judicairy from the Executive.

  2. Had Dora won the case, RB would have praised the attorney -General Chambers! infact he would have even created a new higher position for Malila! Thank God, justice prevailed

  4. Listen to this! We support the move by the President as it will enhance the perfomnce, from the same mouth-The Chambers have performed very well as its manned by eminent lawyers. Now which is which? Forgive me, I smell two things year- the speaker has the same name as you know who, or some one wants the AG to be fired and hopes to take the job himself. How else can one explain the contradictions in this article; Kakwindi kalesuma no kuputilishisha

  5. First it was Mangande Nyama Soya sacked for challenging him. Then came that small Icengelo Father he engineered to sack. Now its the AG he is vowing to sack. Well, by the time we go for the 2011 polls, Banda will cry. In case he is deficient on the length of memory, Chiluba’s cabinet and majority in parliament fell apart before the 2001 polls. Banda will face the same fate, mark my word, it could come even earlier for him.

  6. With forked tongue colleagues like Banda of LAZ, does Malila need any enemies? The answer is an emphatic no!

  7. LAZ should not be happy with AG troubles. Malila stood for the truth in this instance and has his intergruty intact despite the ramblings of “bafuna kimipoka icichintu chanu”. What disorganisation in AG chembers are they talking about? What are these people upto? When are we going to see proper organisation and maturity in the way we conduct our selves in zambia. Is it a wonder we remain lagged behind.

  8. There is nothing wrong with re organising an office. If anything the whole of Government needs to be re organised. The question we need to ask what re – organisation will be done. It could be strengthening of the office, weakening or making the office act as a active internal part in decision making as opposed to asking it for an opinion

    On Mumba Malila, I commend him for a great job well done. The truth must always be put above personal and foreign interests. He has and is still doing a good job for Zambia. Should I have a case to answer in future, I will seriously consider asking Mumba Malila to represent me. such men and women who stand for the truth are rare in Zambia and Mumba Malila deserves my recognition for a jolie job well done.
