Dora Siliya’s Judicial review set for May 26

The Lusaka High Court has set May, 26 and 27 as dates for

hearing former Transport and Communications Minister Dora Siliya’s application for judicial review into the findings of the Judge Dennis Chirwa Tribunal.

The matter will be heard before High Court Judge Phillip Musonda.

Ms. Siliya applied for judicial review last week.

Her lawyer Eric Silwamba filed the application for judicial review in the Lusaka High Court.

Mr. Silwamba argued that the decision by the tribunal that his client breached the provisions of the constitution was in excess of its jurisdiction as stipulated by the provisions of the parliamentary and ministerial code of conduct.

He further contended that the tribunal erred in law when it purported to adjudicate constitutional matters and pronounce itself on the provisions of the constitution.

Mr. Silwamba stated that the Judge Dennis Chirwa Tribunal also erred in law when it misconstrued the interpretation of the provisions of article 54(3) of the constitution.

He argued that the purported breach of the provisions of the constitution was not one of the allegations levelled against his client.

Mr. Silwamba states that in doing so, the tribunal exceeded its limit and statutory jurisdiction.

The Judge Dennis Chirwa tribunal cleared Ms. Siliya on three allegations.

The tribunal found that Ms. Siliya did not breach part II of the Parliamentary and Ministerial code of conduct Act.

The tribunal however found that the former minister breached the provisions of the constitution and ignored the attorney general’s advice.

  5. It appears Dorika Siliyi has lost direction and wants the ministrial portofolio at all cost. She has the money to shower the laywers representing her. The finds of Justice Denis Chirwa Tribunal was straight to the point. She breached the constitution and is lucky that she is still serving as an MP for Petauke Central. She is a disgraced upcoming politician who needs to be behave well and reform her public conduct. I pray hard day in day out the appeal for judicial review does not go her way. I dont think she read Tribunal’s findings. Dorika dont push your lucky too far.The JUDICIAL in Zambia has got teeth to bite. Its no longerbthe way it used to be pushed around by politicians.   10. Dora Siliya has got every right to seek judicial review. She has got every right to clear her name and no one must say otherwise because she is practicing her rights.

    Mr. Silwamba states that in doing so, the tribunal exceeded its limit and statutory jurisdiction.

    I trust Mr. Silwamba knows what he is talking about. Lets wait and see what comes of this review.

  12. #12 Dongo na fimo fimo as tax payers in theEU it hurts to see money go to the winds just like that. If this happened in one of the EU countries Kunda should have resigned. It doesn`t matter whether it has been reduced to ” manslaughter” or not. As a vice president he publicly supported Dora when he should have been one to say we are going to let the law take it`s course. By the way I like Dora. Love her boobs! I mean it in English please!

  14. Ba 3RqU, I have just gotten the point now. So the worry is that EU funded the tribunal and therefore Dora should not seek judicial review. Meaning that it must not have been EU to fund the tribunal because Dora was going to seek a judicial review and therefore the blame should now be on William Harrington for bringing up the whole issue. Furthermore, Kunda should have resigned because he supported Dora who is now seeking judical review because she feels the tribunal errored. Thus far she does not have a right for any appeal. Interesting. Or what is it that you are talking about?

  29. Dora has every right to appeal for Judicial review. Even before she appealed, I personally felt the tribunal indeed made a mistake by making judgment on something it was not asked to do. She is winning the case. Tribunals admit hearsays but courts dont. Whether you hate her or not, thats her legal right

  32. Dora is playing a losing battle. There is no way juniors will rubish the findings of their seniors, I mean supreme ourt judges sitting on the tribunal. If Dora has money to spend lawyers will milk her completely and leave her naked.

  34. Again Zambians are taking the Dora Siliya issue personally. What type of docile citizens do we have in Zed. People who can analyse beyond what they read or hear in the news! Zamtel needs to be privatised for those in urban & rural areas to even have access to quality fixed landline & broadband Internet access. Again those in the know are happy cause attention has been diverted to Siliya instead of a vital issue at hand and that is of privatising Zamtel. What a travesty and a huge disappointment.

  44. Zambia needs serious prayers, at the rate things are going we need Go’d’s intervention in our country. Witnesses that testified against the minister were fired, the Chief Justice also said he cannot protect witnesses, the PF Presidential candidate is soon to be disqualified from standing if the discriminatory law is passed. As much as i personally appreciate degrees i strongly think performance is a much better quality and this discriminatory law is being passed at a wrong time. If indeed it’s a matter of encouraging analysis then this degree requirement should be extended across the board to apply to MP’s who make and pass laws, Permanent Secretaries, Town Clerks and all Government and council workers apart from clerical staff.   46. I felt the tribunal gave ‘Pretty Dora’ a great break. They ignored a lot of stuff that was wrongly done. Now she is really pushing her luck. Lawyers will f**k you even when you r dead. Erick is doing exactly that as he has smelt the loot from Dora. I do not see the tribunal finding reversed at all. Infact this is when the S**t hits the fan!!! Mark my words. Dora is mearly opening a can of worms for herself and her sponsors.

  47. Bloggers , for the life of me I cant understand why you do not want Dora to exhaust her legal avenues. Come in , they will either uphold the previous ruling which will prove you breached the constitution or overturn, which in essence will mean that the tribunal erred.
