Judgement day for Dora Siliya’s judicial review set

Supreme Court Judge Dennis Chirwa has set June 12th as Judgement day for Former Transport and Communication Minister Dora Siliya’s judicial review.

This will be two weeks after Ms. Siliya’s and the petitioners’ counsel teams file their submission.

High Court Judge Phillip Musonda has set May 29th as the dead-line for filing the submission.

Judge Chirwa ruled that judgement in the matter will be delivered two weeks after May 29th.

Earlier Ms. Siliya’s lawyer Eric Silwamba told the court that his team was Tuesday ready to file submissions to expeditiously dispose off the matter in the interest of justice.

Meanwhile Lusaka Lawyer Winter Kabimba is Tuesday expected to apply to join the proceedings in Ms. Siliya’s judicial review.

Mr. Kabimba was representing petitioners during the tribunal’s hearing on abuse of authority of office allegations against Ms. Siliya.

Ms. Siliya applied for judicial review into the findings of the Judge Dennis Chirwa Tribunal, almost two week ago.

Her lawyer Mr. Silwamba filed the application for judicial review in the Lusaka High Court.

Mr. Silwamba argued that the decision of the tribunal that his client breached the provisions of the constitution was in excess of its jurisdiction as stipulated by the provisions of the parliamentary and ministerial code of conduct.

The Judge Dennis Chirwa tribunal cleared Ms. Siliya on three allegations that she did not Breach part II of the Parliamentary and Ministerial code of conduct Act.

The tribunal however found that the former minister breached the provisions of the constitution and ignored the Attorney General’s advice.

  7. This story has factual errors. Why are you referring to Supreme Court Judge Chirwa when this matter is before High Court Judge Musonda? Dont mislead the masses, its the High Court that has set Judgment day, the Supreme Court has nothing to do with this silly case yet…

  8. I don’t know whether its Law language that has made me not to understand the article. I seem not to pick any sense from this article by ZNBC. Its full of ambiguities.

    Are you serious with your tuntrums on the watchdog.i think you should revisit your analysis.LT may have a good outlay but the watchdog beats them hands down in cupturing events.after all news is about latest events.

  11. I have no faith in a corrupt Judicial system like the one in Zambia,rich people don’t go to jail ba nunshamo fye like Regina.Poor people languish in over crowded prisons.Dora knows the outcome is already in her favour.

  13. The last time I visited The Watchdog I felt like a fish on dry land. The whole layout was so user-unfriendly and only a couple of columns with minor news/info were available.
    In my opinion, LT is not quite different from some of the classic news sites on the web like Allafrica & BBC. The crew surely deserves full credit for initiating and running this amazing site.

  14. I am no supporter of either party, but I believe that Miss Dora was abused by the tribunal. In legal terms, the tribunal erred in finding her guilty of what was not on the charge sheet, let alone given a chance to defend herself as she did competently on the three issues in the original charge. The best that the tribunal could have done was to amend the charges and let Miss Dora defend herself. Where is natural or other justice in this? Guys these things can happen to all of us. That is why we must stand for justice, think with our heads not our hearts, and most importantly not allow journalists to think for us.
    Because of this, I think that Miss Dora will go scot free and even regain her ministerial portfolio, which after all is still vacant and probably waiting for her.

  16. # 21 Regardless of the out come of the review, if Banda re-appoints her, he will be committing a calamitous political suicide of biblical proportions. Dora herself is not disputing that she breached the constitution, he bone of contention is that it was not one of the charges. This sounds like Chiluba stealing by mistake or Mandrax Mwaanga claiming their was no law against Mandrax in Zambia when he was caught with the drug on him. It’s Mvunga handling this case for the people, Dora will cry like a baby for opening a pandora’s box.

  17. ShakaZulu, You sound too strong. However, I conquer with your sentiments. I heard a complaint that Dora was frequently in the company of RB (Rupiah OBanda). I hope RB has not instructed Judges to pardon Dora. Using my Corruptionometer, RB’s corruption tolerance level stand at 99.9%.

  18. Hey LT, try to elevate your standard of reporting… you don’t write in a news report things like ‘… ALMOST two WEEK ago…’. ALMOST isn’t journalism. and look at this statement: ‘…The tribunal however found that the former minister breached the provisions of the constitution AND ignored the Attorney General’s advice…’. The word ‘and’ is inappropriate in that sentence. It’s like she was found of 2 things 🙁

  19. Even as we debate here, Dora and same politicians already know that whatever the outcome, she will not be going anywhere but the comfort of her mansion

  20. No Dora like her or hate her has a legal rights that she is free to pursue. And I agree with her that she was not given an opportunity to defend herself on the allegation. So let the judiciary hear it out
