Court Registrar rejects Chiluba’s submissions

Ndola High Court Registrar Jones Chinyama has turned down Second Republican President Frederick Chiluba’s application for submissions, pending judgement of his case.

Dr. Chiluba had last month made an application to file his submission after failing to meet the deadline.

Mr. Chinyama told the court that he had never instructed the senior court’s clerk to admit Dr. Chiluba’s application to file submission after the deadline.

Dr. Chiluba applied to file his belated submissions on May 21.[quote]

He was earlier supposed to file the submission on April 30.

His spokesperson Emmanuel Mwamba said Dr. Chiluba will revert to his defence counsel to decide the next action.

Meanwhile Mr. Chinyama has extended Dr. Chiluba’s bail application.

This is in a case where he is accused of plunder of national resources.

  1. But who does FTJ think he is?? Very good Chinyama. Law is Law. No one is above the law. Manje you need to convict him kabili!!

  2. On Bail from 2001? Its like being in prison already because you dont know whether it will be extended or not. No appetite man, its tough unless you have not experienced it.

  3. It is however, fortunately that Zambians are known to have very short memories.so much that they have even forgot why Chiluba is standing trial.All one would say ”Aliyiba”,He stole, If you ask what did he stole? Kaya… ndalama za ZamTrop

    That is the common nature and problem of Zambians they have more personal problems to worry about than those of public interest.The public can just drive someone crazy with all the money missing, Chiluba was accused of stilling nearly 10 years ago.now a young man Henry Kapoko, nearly half his age has stolen twice as much.

    While the attention on Public theafy has shifted to one Kapoko, Maybe the post should re-run the article about the charges that were slapped again Chiluba to refresh our minds and moods.

  4. Chiluba’s lawyers have employed all tactics to drag and delay the verdict. Levy who initiated this case has not lived to see the how the wheels of justice will finally halt after spinning for nearly 10 years.
    But it is not for Levy to see that justice prevails. it is the Right of many Poor citizens who call Zambia their Home.

    If anything Levy also help to slow the dispensation of justice in Chiluba’s case, involving Katanga Governor and Chani Fisheries Tamba Abashila proprietor Moses Katumbi, who had all chargers scraped against ,later dropped in the name of National unity even if Katumbi was ready to testify. In the effort by the government to swart this case we saw Levy firing of Vj Mwaanga. Like the Gabon Air disaster, there is still unsolved mystery and justice on that matter.

  5. The problem is Chiluba believes his own hype. He even believes he can argue the Law better than his lawyers. Why is he making submissions in person and then only reverting to his counsel once its rejected? Why not let the Lawyers try and do a proffessional job by giving them all the evidence in good time. Thats how the cookie crumbles. All i can say is that when he is locked up, he better not drop the soap….!

  7. Chiluba´s learned layers have had employed all tactics that is their dusty manual to drag, delay and even try to derail Chiluba’s Verdict. Levy the spirited leader who initiated the witch -hunt against corruption did not live to see how the wheels of justice will finnally halt on July 20,2009 after spinning for nearly 10 years.

    But it is not for Levy to see that justice prevails.It is the Vital Right of every Citizen rich or poor, thin or large ,Black or White who gladly calls this Country their Home.

    If anything ,Levy who has been hero worshiped for his crusade against corruption did not have clean hands himself.He openly prevented justice to prevail in the name of national unity when Katanga Governor; Moses Katumbi was found with a case to answer by Zambian Government.

  9. Chiluba should not take the Courts of law for granted.He was asked for his submissions in good time but he chose no to. That in itself is an admmisson of guiltiness.Lock this little thing

  10. I think High Court Registrar Jones Chinyama is one of the few seriuos judges i still have hope and faith in to deal with cases fairly, without fear or favour. Please make us proud History will judge you as a true servant of the people. If only he handled Dora s case.

    Like the Gabon air disasters it adds to the unsolved mysteries.It is however very fortunate that Zambians are people of short memories they are best known to easily forget and forgive-It should qualify as a land of chosen people.
    Zambians are too forgetful that they have even forgotten why Chiluba he standing trial.All one is likely to say is that” Aliyiba’ others would say ‘anaba’ He stole!, Asked what did he steal? Kaya bakamba ati ndlama za Zamtrop.
    This is the unfortunate common nature and problem with Zambians,They more personal problems so much that have little or no business with issues of public interest.Understandably the public domain can be drive someone crazy especially with all these money missing.Chiluba was accused of stealing nearly 10 years ago.

Guys are you all blind? what will happen is, Chinyama will convict chiluba, chiluba will be given bail same day waiting appeal, during appeal, Judge Musonda is going to clear chiluba of all charges simply because, Chiluba’s defense was not taken into account by the lower court. Well played Chinyama + CJ himself.

  13. While the public attention is has shifted to Kapoko and his Empire, the post should give as a fresh recap of Chiluba’s charges before many people begin to think that he is being unfairly treated.
    Mind you Chiluba he not standing trial in Supreme court which means if convicted he has the right to get bail and appeal to a higher court, he can continue doing that until kingdom come.It has taken nearly 10 years to come to this verdict it will take the same period for another court to deliver…yet they say Justice delayed is justice denied.In this case justice has failed the people of Zambia.
    This this kind of compromised justice system in Zambia, they people should put more pressure to see that dispensation justice is done fairly and hold political leaders accountable of their dealings.

  14. The people should not wait for the president to leave office or even die before they start saying infwe nfwe..What is the point of having the govt if it cant provide basic human needs.

    1. Basic Health: A dosage of Panadols, adrip of water, a crowded ward and a rude nurse
    2. Basic Education: A black board and a bench
    3.Human Right: A Police Post with a Fee paying car Park
    Forget about other Human Rights if you are not ready to pay for them.
    The current infamous president Bwezani has blood dripping on his hands of the people who have died of preventable diseases during the strike of health workers.However,he is glad to rush them to their graves in his H3 hearses , which he recently procured from China.
    Which Govt would buy 100 hearses when most clinics and Hospitals have no Drugs

  15. People, have faith in our judicial system (panono at least). FTJ will be convicted. The question is, will he ever do time?

  16. Chilubas Verdict is in 30 days.I hope it deos not come out like Dora’s case.With no case to answer.
    With the impoverished judicial system the poor continue to receive stiff sentences while rich criminals enjoy freedom on their expensive half billion bails I wonder how they manage to pay these huge amount in the middle of financial, is there a standard amount an average civil servant can have in the bank? or it does matter anymore.

I will advocate and support the donor community to withdraw AID to Govt sectors where there are questionable transactions especially that I am also paying huge TAX through the nose for those funds.Which Kapoko and his allies are effortlessly using to maintain their string of girl friends.How on earth do you have seven girl friends.No wonder the guy looks kwati talia.

  19. Back to business the Ministry of Works and Supply in conduction with Ministry of Comms and trans are offering Tenders worth billion of Kwacha to mediocre Contractors who have no ideal of road engineering what so ever.
    You remeber and saw what happened during the constructing of the foot bridge over at UNZA.I the heart of the capital where the same donors drive pass and the citizens mingle, The Govt together with their cheap mediocre contractors staged an Exhibition of Engineering mediocrity, one does need to be a qualified engneer to see that the bridge in question was being constructed with people without proper know how.How do built a bridge kwati mule kula akanteba.and if you look at the budget for the same bridge-No it is the same model like a bridge in Kenya- so what?

  20. Imagine what kind of drama,is in shangobo and many other rural areas where peasants think that the Govt is doing them a favor by clearing feeder roads. Do you think the villagers can complain over substandard jobs.If learned people in Lusaka are subjected to an environment best fit to stage an horror or alien movie.

    1:Burnt Sky scrappers
    2:Brok ed sewerage pipes
    3:Public buses without brakes and sitting limit capacity .
    4:Vendors in the middle of the road
    5.Streets full of pregnant homeless children
    6:Uncollected Garbage making mountains along busy streets.

  21. I thank LT for the platform ,I am edging All Zambians be more involved politics beyond casting their votes, especially rural voters because they are famous for voting in these infamous Presidents.

  22. According to the sources Chiluba will be arrested. And the MMD will use him for there campain in 2011.
