Man gets 18 months over cigarettes

A 27-Year-old man of chief Kaingu’s chiefdom in Itezhi-tezhi district has been slapped with an 18 month jail sentence for failing to pay for 12 cigarettes that he obtained from a makeshift shop.

Before Namwala Magistrates Munalula Mubita was Prosper Munyumbwe who was charged with the offence of obtaining pecuniary advantage by false pretences, contrary to Cap 301 Section One of the Laws of Zambia.

Facts of the matter were that on August 11, 2009 the complainant, a Mr Moboola, sent his 11-year-old nephew to sell his cigarettes in a makeshift shop but when he went to check on him, the nephew told him that Munyumbwe had taken 12 sticks of consulate cigarettes on pretense that he had no change and that he would pay later.

The court also heard that Munyumbwe was later found stealing 12 packets of consulate cigarettes at the same make shift shop prompting the owner to apprehend and take him to police where he was arrested and detained.

Munyumbwe pleaded guilty.

  3. It appears the magistrete in Itezhi Itezhi has little business to do there and the Judicial should consider transferring him to Lusaka or Copperbelt where there are serious cases. Jailing a man over 12 sticls of consulate cigerates to 18months jail sentence. The cost of prosecuting and keeping that man in prison far outweigh the benefits. A community sentence would have bin better. Pipo who still huge sums like etc and the likes go scot free. Its the poor who are asked to come in numbers and vote and its them who go to jail for lesser crimes. May those who are calling appealing against FTJ’s aquital come to the rescue of this poor man.

Zambia is a cursed country,the judiciary is unjust to the poor.Jails are full of poor people who commited small and pardonable crimes while the rich criminals are sentenced and released the next day on bail.The MMD government needs to be removed by force if necessary so the poor can be spared injustice.All magistrates and judges should be paraded and shot.

  5. i can answer this but you did not specify the units in which the sentence chiluba would get be given.Assuming you want the answer in days then the answer should be in standard form(x by 10 to the power y),if you want the answer in months the it reduces to tens of thousand.This also depends on the exchange rate at the time of jugdement which also depends on the judge.Lets take the judge to be chinyama and his coeficent is rupia then the sentence is zero since any variable multiplied by rupia the answer is zero.

  8. #1 Ba Honey, You are absolutely right there is no justice in Zambia for the poor. According to the charge the man was imprisoned ‘for obtaining pecuniary advantage by false pretences’, now the question is how about someone who continues to draw a salary from the GRZ after resigning and has not been arrested? Is this not a more serious crime? It seems to me that the rich and famous are above the law in Zambia. Chiluba was acquitted last week despite the massive plunder he did to the country. Dr Miti is walking the streets a free man. Zambia is a big joke.

  9. #10BA HONEY maths is not as easy as acquiting the one with case and sentencing the recipient.In maths logic and specifics is important.I still need your guidance,Do you want the answer in days,months,years,decads or centaries.Take into consideration that chiluba is over 37 the official life expectance in zed. you should also give me variables to use eg president,judge.By president I dont mean Rupia coz any number multiplied by Rupia the answer is zero.
    To prove this ask the monkey that conducted a babtism study in zambia;.According to the study ,One monkey poured urine on Rupia no changes where observed another Monkey dipped Mpombo in water the following week he resigned.Thats what i mean when i say (Rupia x Y equals zero)Where Y is any minister,judge,vice president.

    If you take exchange rate at 5000 per dollar 46milion dollars is 225000000000 kwachas.
    And if a ciggarete cost 500 ,8 ciggaretes translates to 4000 kwachas.
    Divide 225000000000 by 4000 you get 56250000 which is the number you multiply by 18 to get the actual number of months chiluba should go in.If you are not lazy follow me,if you multiply 56250000×18 you get 10125000000 months.Divide that by 12 to get the number in years gives you 84375000years.
    HOPE YOU ARE SATISFIED.I CAN SIMPLIFY IT MORE IF YOU LIKE I JUST LOVE NUMBERS.

    Lets just say the answer is that FTJ would spend the rest of his life in prison.

    Unless RB’s coeffiecient is used, it will not matter whether the units of the sentence is days, or months or years. After all, we live a day at a time.

  13. 9 months light sentence for murder/manslaughter (whatever they called it) and 18 months for stealing fwaka. Consistency is lacking in our judicial system. It seems like judgement is based on emotions and pressure in this country. Anyway, we sympathise with the gentleman, not coz what he did was right but he was unfairly judged.

  14. The coefficient for court cases depend on whether you plead guilty or not. The Mr 12 pleaded guilty he deserted maximum sentence. He was infact caught stealing not only found with 12 packets. The magistrate was actually very considerate. Stealing in such remote areas must not be condoned. The case with FTJ is of different material. I dont know whether to say that was not stealing but getting in possession of money ngo muntu uulekola inswa. Isha pita bambi ba senda. The poorest of the poor got nothing at the end of the day. That is y it is impossible em 2 know that inswa balilya

  15. It is so S.T.U.P.I.D of the rule of law that exist in Zambia. Why should poor people crowed the prisons when the chief-thieves roam the streets. MAY GOD DEAL WITH THIS UNJUST LEAGAL SYSTEM IN ZAMBIA.

  17. What is this? Is Zambia truly practicising Christianity when there’s two laws, one for the poor and the other for the rich? Does LT get some of these views to the powers that be? My heart bleeds over this injustice! God help us, in the name of Jesus.
