Three High Court Judges to hear Regina Chiluba’s appeal case

A panel of three high court judges is expected to hear the appeal case of Regina Chiluba’s receipt of alleged stolen properties and money. This came to light when high court Judge Evans Hamaundu informed parties to the case that the appeal case could not take place as it required more than one judge. The case has been adjourned to a later date. In adjourning the matter this morning, Judge Hamaundu says a penal of three judges has to be set and a pre-hearing be done before coming up with a date before the actual hearing of
the case commences. This is in a case in which Mrs. Chiluba is appealing against the Magistrate court’s sentence, to three-and-a-half years in prison for receiving and obtaining stolen state property while her husband Dr. Chiluba was Republican president. The magistrate’s court in Lusaka on March 3rd 2009 found Mrs. Chiluba guilty on five of six counts of fraud relating to receiving alleged stolen property and funds. Mrs. Chiluba was accompanied to court by her husband Dr. Chiluba and a number of sympathizers. Meanwhile Mrs. Chiluba’s legal representative Robert Simeza has requested the Lusaka high court to assist in securing the complete record of the evidence from the magistrate court. Mr. Simeza explains that the appeal case for Mrs. Chiluba cannot be properly argued without the complete record of the evidence that was produced in a lower court. He says the lower courts are obliged by law to prepare the record before the commencement of the appeal hearing.

    Agitators and loud mouthed cum Civil society organisations (CSOs) leaders involving Cowardly Sata, HH, Mmembe, Mulafulafu, Milupi, Fr.Mwelwa, Mark Chona and entire CSO leadership lose public support over failed acquittal protests. They were on Friday rebuked for abandoning their initiative to protest against former president Frederick Chiluba’s acquittal on corruption charges by way of honking and whistling every Friday.

The pseudo 18 CSOs some under intensive fraud investigation for the stolen ZK 148 million who held a public consultation forum at Lusaka’s Chrismar Hotel to chart the way forward on government’s refusal to appeal over Chiluba’s acquittal were grilled by various members of the public for their loud mouths but cowardly acts.

    The speakers observed that the pseudo CSOs backing out of the earlier honking and whistling was a serious indictment on their credibility as cheap talkers but cowardly loose canons.

  3. Former University of Zambia Students Union (UNZASU) president Antonio Mwanza submitted that the 18 organisations would not achieve anything by holding press conferences when they should have been on the streets influencing people.

  4. “I must express my disappointment with our 18 civil society organisations,” Mwanza said. “When they asked people to honk against the acquittal of Dr Chiluba, people turned up and some of them were arrested. Nine people were arrested including two members of parliament but none of these people were there to support the arrested colleagues. These orgainsations showed cowardice in that once they were threatened by Inspector General of Police Francis Kabonde they backed out.”
    Mwanza said those who wanted to start a war must be ready to suffer for it and should be ready to go to prison.

  5. useless judges, this all case does not make any sense if the husband was acquitented how honestly do u jail some body accused of obtaining stolen properties from the same person acquinted and sent scot free of not stealing? This is total zambian circus, the saga continues.

  6. We really have a serious matter on our hands…only that she is supposed to have received stolen goods from a fellow the ‘courts’ have singled out to be innocent…she is wrongfully accused!!!! A type II two error no doubt…to say that Chiluba is innocent, thereby allowing this lady to go without a case to answer is an insult to our justice system (which i dont really have faith in after the Chiluba saga) AND THE PEOPLE OF ZAMBIA…She should be given her day in court and justice should be allowed to take place for the second time in her life…

  7. The big thief has been set free. I would be foolish enough to believe this woman will be sent to jail for all the crimes she and her husbad has comitted to the zambian people?? I just dont have any hope in our judicial system. It seems the final judgement comes from state house and not the court. I just wish justice ca prevail

I don’t know why we tolerate so much nonsense in Zambia….just look at Mahtani and now Shawi Fawaz terrorizing us in our own country and we sit and do nothing all in the name of being of peace loving people…what a shame!!!!!!!!!!!!

  9. Could someone plz explain how the jurisdiction of courts is organised in Zambia.?.. I mean we previously had a single magistrate acquit the former President in a complex case involving serious charges.,..and yet this higher court in what appears to be a relatively straightforward case requires three judges. or do they always sit like that in the high court? ..Excuse my ignorance but i do learn a lot from you fellow bloggers. And believe it or not that also includes Mad Dog u know who… 🙂

More evidence is in how he sacrificed his late son Chilufya Sata who he did some charms to become confused and die in his bedroom within Sata’s house.Sata waited for over 4 days to finish all the satanic rituals before declaring him dead.

    THE Bemba Royal Establishment (BRE) has been saddened by Patriotic Front (PF) leader Michael Sata’s disrespectiful remarks against Paramount Chief Chitimukulu.

    BRE Spokesperson Bwalya Chiti said in an interview yesterday that Mr Sata’s accusations that Chief Chitimukulu’s pocket had benefited from President Rupiah Banda’s Government were unfortunate.

    Mr Chiti said it was saddening that Mr Sata could choose to bring the name of the Paramount Chief into disrepute.

  18. At the weekend, Mr Sata was quoted in the media as having said President Banda had achieved a lot of development in people’s pockets like Chief Chitimukulu’s.

    This was in his reaction to Chief Mwatakazembe of the Lunda People of Luapula Province who praised President Banda for initiating several developments in the province in the one year President Banda had been in office.

    But Mr Chiti said it was unfortunate that Mr Sata could bring Chief Chitimukulu in the subject when the paramount chief was not even the one who issued the statement.

  19. He said Mr Sata’s remarks were a sign of being disrespectful to the paramount chief and advised him to seek dialogue with the Chief if he had any issues to settle with him.

    Mr Chiti said Mr Sata was a Bemba who was supposed to have respect for the paramount chief and wondered how he would respect chiefs from other provinces if he could not respect his own chief.

    Mr Chiti said despite being a nephew to Mr Sata and differing politically, he had never insulted the PF leader and advised him to extend the respect to the chiefs.

  20. He said he was close to Chief Chitimukulu and the help the paramount chief had received from Government was to receive medical attention abroad.

    “Being taken for medical attention abroad by Government does not mean one has been bribed. Chief Chitimukulu is not the only one who has benefitted from being sent abroad for treatment as Mr Sata was also sent to South Africa by our late president Levy Mwanawasa and no one said he was bribed,” he said.

  21. He said it was Government’s duty to take care of its citizens and that even then, it was not President Banda who decided but a committee of adjudicators which included doctors that decided to evacuate someone for treatment abroad.

    And Luapula Royal Foundation (LRF) spokesperson Chief Chisunka said the LRF was also not happy that Mr Sata thought chiefs were corrupt just because they supported the government of the day.

    Chief Chisunka said it was policy that chiefs worked with the government of the day and that should not be construed to mean they were compromised.

    Meanwhile, Luapula Member of Parliament Peter Machungwa wondered how Mr Sata, who was aspiring for a position of Republican president would be able to respect the chiefs in the country if voted in as president when he could not respect them now as a leader of an opposition political party.

    Dr Machungwa said it was shameful for Mr Sata to think that chiefs were corrupt just because they were supporting the government of the day.

    Dr Machungwa said the MPs from Luapula Province would also issue a detailed statement after a meeting this week.

  25. Never direct your accusing finger on anyone— ifintu fyalipena kale…. It is this same finger-pointing mentality that is even delaying the development of our country further. Let’s learn to draw lessons from mistakes that were made in the past and think forward. We shouldn’t be wasting time accusing one another, or arresting one another at the expense of national development. Travel to other countries and see how their economies run..  It’s go go forward. The govt in power should set up within itself monitoring units to deal with any one found wanting, not after one has left office that is when you are  busy following them. That’s not intelligent at all. Does it mean that the law in Zambia only applies to those who have left office?!!!!

  26. #15 The LORD SITH A Subordinate Court of the first class to be presided over by a Principal Resident Magistrate who is mandated to handle a case of NOT more than K30,000,000.00,Subordinates Courts are also courts of first instance and they decide all matters as provided for by the Act except for offences of treason, murder, aggravated robbery, election petitions and all matters that involve the interpretation of the Constitution.

    According to Section 7 of the Criminal Procedure Code Chapter 88 of the Laws of Zambia, a Subordinate Court of the first, second or third Class may try any offence under any written laws of Zambia and pass any sentence but;A Surbodinate Court presided over by the Principle Resident Magistrate and Senior Resident Magistrate cannot pass a sentence of imprison

  27. contd:of more than 9 years;A Resident Magistrate cannot pass a sentence of imprisonment of more than 7 years;A Magistrate Class 1 cannot pass a sentence of imprisonment of more than 5 years; A Surbodinate Court presided over by a Magistrate of second and third Class cannot pass a sentence of imprisonment of more than 3 years.

As for the High Court, it can consist of 3 or more Judges who are deemed to have independent opinions about the case but at the end of it all they have to come up with a binding rulling which means that all their judgements could be independent from each other though once judgement is passed,it will be an agreed version to represent the 3. They might overule the megistrate if he erred in judgment and passing sentence, if the megistrates judgement is upheld,then she goes in,otherwise she will appeal to the supreme court which consists more than 4 supreme court judges,im not a law student so, hope it makes sense:

  29. #35 Mbo, yes my dear you are ignorant of the law. In appeal, the court hears the case depending on whether the appeal is a matter of facts or on law. Thus hence to grant such appeal, there should never be an even number of judges, so as to avoid a situation where, those in favour are equal to those against. Remeber that this is not a court of first instance, lets wait and see what the outcome will be, all eyes are on these judges. Let justice prevail.

  30. Since this is an appeal case, the high court judges will relly on the facts as presented in the subordinate court. Chiluba’s acquittal will not play any role in this appeal case. Unless, RB will again influence the outcome and that will be clear testimony that the judicial is not impartial and has been high corrupted by RB..

  31. Observer 21-22, Not only are your comments about Chilufya Sata’s cause of death or confusion as you call it highly erroneous, but they are highly libelous. I get the impression you think of yourself as a Christian, so perhaps you should do some self introspection and reflect on your words and their intentions. It is very cowardly to defame peoples’ characters simply because you think you are too far away to be brought to justice. And another thing, have some respect for the dead and let Chilufyas’ soul rest.

  32. Leave the Cobra alone, he is just giving Rupiah a good run and even these same bemba and luapula chiefs who cant see that it’s out of compromise because of the planes and medications abroad and the Chiluba acquittal respctively.

  36. Just how was Regina convicted of receiving stolen property(money) when the thieving husband did not steal? His was only money received from ‘well wishers’ that he decided – in his wisdom – to deposit in a government account. Now the judges are scared of hearing the case and want to ‘team’ up. Forgive my ignorance, but this is my first time to hear of a team of judges hearing an appeal case at High Court level in Zambia.
