The Post editor in July this year, sent graphic images of a woman giving birth without medical assistance outside the University Teaching Hospital, to various prominent people in Zambia, including the vice president. If found guilty Chansa would have faced a possible five-year jail.
Magistrate Charles Kafunda today said prosecutors had failed to prove its case against the Post editor.
“The prosecution failed to establish an element of a prima facie case and I therefore dismiss the case and subsequently acquit the accused. The state has however the right to appeal,” Kafunda told a packed courtroom.
Kabwela, dressed in a black suit and accompanied by her husband Henry, smiled as Kafunda read out the verdict.
She later told reporters outside the court that her acquittal was a victory for everyone affected by the doctors’ strike, which lasted two weeks in June.
I thought the Executive always intreferes with the judiciary in Zed especially that RB really wanted to see her sentenced.

RB always talks about separation of powers but acts differently.Note his comments that it would have been expensive to appeal the acquitall of FTJ and that he would have found it difficult to imprison a former president.This to me suggests he influenced the no appeal stance of the so-called DPP. Since it may be cheap to appeal the Kabwela acquitall, as for the Sata judgement, he will advise the DPP accordingly.This to him is separation of powers.

Chansa kabwela could have been tried in any international court and found not guilty while chiluba would have been found guilty but only acquitted in Zambian courts. The fact that he was acquitted in Zambia and convicted in another court shows inconsistency

This judgment is meant to hoodwink and blind the masses. The Govt wont appeal. Next Regina Chiluba will be free and if anybody cries for appeal , they will say what about Chansa Kabwela. That to me sounds like a man who does not understand the role of the judiciary and would therefore be unlikely to entertain notions of their objectivity. The other point I am trying to point out is one of consistency. How can a presidential aspirant who wanted Chiluba to be free in 2006 protest his aquital in 2009? Can he explain to the nation just when he had his road to Damascus moment and realised that Chiluba was indeed guilty despite the fact that he at one time tried to bully the Zambian people to accept Kafupi as a president for a third term?

In hating the POST he announces publicly that they stole $30m dollars for which more than 6 months down the road investigations cannot be concluded yet in his mind he was sure. Talking about decision making, I’m extra worried with RB’s movements. Somebody help me with his diary. He has not been to his office for more than 2 weeks and he is not on leave. Before going to Burundi more than 2 weeks ago, he was out somewhere. On coming back from East Africa, he went to Eastern Province for 4-5 days to ”thank the voters”. He travelled directly from there to Solwezi to campaign for 3 days or so. From Solwezi, he connected to Libya and from there he has proceeded to Italy. Next stop or destination, only God knows. What makes a peadophile is not the age difference between two people but whether or not one is engaging in any form of sexual contact with a person whom the law of a particular country deems to be under-age. So for example a twenty year old engaging in sexual contact with a 15 year old in a country where the age of consent is 16 could be deemed to be a peadophile whereas an 87 year old in the same country engaging in sexual contact with a 17 year old would not. The age gap between Thandiwe and RB does not make him a peadophile and he would be within his rights to sue you r arse in court.

The nurses have a right to air their views but could the strike not have been handled in a manner in which such incidents were minimised? The opposition played a part in this sorry saga by politicising it and not scrutinising the health budget enough when it was presented in parliament. We need to move forward now as this has tainted the image of Zambia. The govt needs to grow a thick skin as far as the post is concerned. Many of us realise that Mmember is self-serving and does not have the interest of the country at heart so the govt should not give him the oxygen of publicity he so much craves.

What this case shows is that the DPP is not fit to be in his office for allowing this case to go into a court of law when the evidence was not there, but for FTJ he allowed the case to go to court, partly prosecuted by Red Lips and then chicken out like a crocodile facing the wrath of some enraged Hippo, the two cases unfortunately can not be compared beyond this and once again questions the way the DPP operates.
Chansa’s acquital is fantastic am only waiting to hear what the government has to say especially from Kwezani or Bwezani what u call him.
