Chansa Kabwela has been acquitted of

the charges of circulating obscene materials.

The Post editor in July this year, sent graphic images of a woman giving birth without medical assistance outside the University Teaching Hospital, to various prominent people in Zambia, including the vice president. During a press conference President Banda condemned the circulation of the pictures and ordered her arrest.

Kabwela argued that she sent the pictures because she wanted to highlight the effect the strike had on the health care system. The baby shown in the photos died.

If found guilty Chansa would have faced a possible five-year jail.

Magistrate Charles Kafunda today said prosecutors had failed to prove its case against the Post editor.

“The prosecution failed to establish an element of a prima facie case and I therefore dismiss the case and subsequently acquit the accused. The state has however the right to appeal,” Kafunda told a packed courtroom.

Kabwela, dressed in a black suit and accompanied by her husband Henry, smiled as Kafunda read out the verdict.

She later told reporters outside the court that her acquittal was a victory for everyone affected by the doctors’ strike, which lasted two weeks in June.

  4. We are very happy with this ruling, it’s good that all the channels have been exhausted, now it’s time for RB to aeal all the way to supreme court if he is not happy with Kafunda’s ruling. Can someone explain to RB what pono is all about. I think he must have attached his own definition. Bavo, Chansa, Post all women and men who supported Kabwela thru out the time this case was being dragged/delayed. Also I thank Henry Ngilazi for the support render to his wife during this trial. Could it be that the theif was really acquitted based on technicalities, thus a just ruling in terms of the law and not morally. If this is indeed political, how clever of RB, coz now those calling for appeal on Chiluba’s case will now be compromised, coz when its in their interest its a sound judgement. What a clever move by RB and his Judiciary.

  25. Since we say the Zambian judiciary is corrupt pro Government system and President Banda judicial verdicts, are we going to accept this outcome from a corrupt court? Is this verdict varied considering that its coming from a Zambian court we say its corrupt? Isn’t this the same Judge Kafunda hardly a month ago we said he is a corrupt MMD cadre?

RB always talks about separation of powers but acts differently.Note his comments that it would have been expensive to appeal the acquitall of FTJ and that he would have found it difficult to imprison a former president.This to me suggests he influenced the no appeal stance of the so-called DPP. Since it may be cheap to appeal the Kabwela acquitall, as for the Sata judgement, he will advise the DPP accordingly.This to him is separation of powers.

  30. #23…the answer is simple. The judge says who ever is not happy with his ruling is free to appeal. Thus let MMD and RB appeal up to the highest court of our great Nation Zambia. No one is against that. We will see where it will end. AFTER EXHAUSTING ALL THE COURTS IN ZAMBIA, they can appeal to the INTERNATIONAL COURT OF JUSTICE. We are waiting man. What we dont want to hear from them is that no, its good not to appeal against Chiluba coz we did not appeal against Kabwesha.

The judiary is an abitrater, an interpreter of laws, so we should know that their rulings will always leave some one with a bitter taste but it does not mean that they are compromisd

The reason why Chiluba’s acquittal is not being taken serious is because it’s not based in principle but opinion. Chansa kabwela could have been tried in any international court and found not guilty while chiluba would have been found guilty but only acquitted in Zambian courts. The fact that he was acquitted in Zambia and convicted in another court shows inconsistency

You know our ultimate aim is to sell as many papers as possible, so we alarm the nation and create frenzy that Rupiah has control of Judiciary, and our papers sell like hot cakes.   44. This judgment is meant to hoodwink and blind the masses. The Govt wont appeal. Next Regina Chiluba will be free and if anybody cries for appeal , they will say what about Chansa Kabwela. This is all engineered people. The thesis was simple: Charge somebody with a false and small case and let the courts aquit her, don’t appeal and if people come again for FTJ, use that small case as ammunition. I wouldn’t be surprised if Xavier Chungu has not be drafted into this new plunder against the state

I see no reason why MMbembe should also get highly charged and start pushing RB or dare him to appeal, am sorry but this should be where the paper decides to show some maturity and not make it look like a personal matter. You have won the case say you will be prepared should the state appeal if not then the law has verndicated the lady and the post as she put it.

    To come out and start daring each others just shows that too many issues in Zambia on national interest are being made too personal. The people caught in between in these issues are those on the prosecutor side pushed by RB and the reporters from the Post like Chansa pushed by MmBembe. lets wait and see and not daring each other on what happens next

You can make all sorts of allegations but without proof you are merely aping Fred Mmember and alarming the nation. I am glad that she has been set free because she should have not been prosecuted in the first place. She is just a pawn in Mmember’s need to feel important and his attempt to blackmail the nation to pay for his debts. He is just as corrupt as the short one.

The outcome of this case only manifest that indeed the Zambian judiciary is the most professional, independent and researched judiciary.It shoots down all conflict and subversive theories that the judiciary takes political orders in its adjudications.It is no surprised that the Zambian justice system has continued appealing to the wider world more especially in commonwealth market delivering professionals serving impeccably.Over the years we have had Zambians serving as Chief Justice, judges, law school Dons, Electoral judicial commissioners etc in Namibia, the Gambia, Sierra Leon, Liberia, Cambodia, Bangladesh, Kenya, Rwanda,Cape Verde and at the Hague.

  58. Mwanawakwithu #51 I think you are missing my point. Perhaps I should explain it to you more clearly. Sata wanted to aquit Chiluba in 2006 arbitralily if he had been elected. That to me sounds like a man who does not understand the role of the judiciary and would therefore be unlikely to entertain notions of their objectivity. The other point I am trying to point out is one of consistency. How can a presidential aspirant who wanted Chiluba to be free in 2006 protest his aquital in 2009? Can he explain to the nation just when he had his road to Damascus moment and realised that Chiluba was indeed guilty despite the fact that he at one time tried to bully the Zambian people to accept Kafupi as a president for a third term?

We all know that Chansa was not guilty but Regina was found guilty of accepting stolen goods., I guess what I’m trying to say is that if Regina is aquitted the Judiciary will say they are not corrupt because Chansa was also acquitted.     We want Rupiah Banda and his lawyers George Kunda and Chalwe Mchenga to appeal this “no case to answer” judgment if they are still not satisfied with the outcome as they have a right.
    In the same vein, we would like the state to appeal the FJT Chiluba acquital as “We the People” have not been satisfied with the ruling because we know that “Chiluba is a THIEF”. Also, we need the London Judgment to be registered in Zambia as it has taken too long for action.

In hating the POST he announces publicly that they stole $30m dollars for which more than 6 months down the road investigations cannot be concluded yet in his mind he was sure.   96. Talking about decision making, I’m extra worried with RB’s movements. Somebody help me with his diary. He has not been to his office for more than 2 weeks and he is not on leave. Before going to Burundi more than 2 weeks ago, he was out somewhere. On coming back from East Africa, he went to Eastern Province for 4-5 days to ”thank the voters”. He travelled directly from there to Solwezi to campaign for 3 days or so. From Solwezi, he connected to Libya and from there he has proceeded to Italy. Next stop or destination, only God knows. Come on, is this fundraising for allowances or more of poor judgement. The man is total loss. Agony indeed…..

What makes a peadophile is not the age difference between two people but whether or not one is engaging in any form of sexual contact with a person whom the law of a particular country deems to be under-age. So for example a twenty year old engaging in sexual contact with a 15 year old in a country where the age of consent is 16 could be deemed to be a peadophile whereas an 87 year old in the same country engaging in sexual contact with a 17 year old would not. The age gap between Thandiwe and RB does not make him a peadophile and he would be within his rights to sue you r arse in court.

  108. #105 you are making a valid point here. The govt should be looking at what caused the nurses to strike in the first place. The nurses have a right to air their views but could the strike not have been handled in a manner in which such incidents were minimised? The opposition played a part in this sorry saga by politicising it and not scrutinising the health budget enough when it was presented in parliament. We need to move forward now as this has tainted the image of Zambia. The govt needs to grow a thick skin as far as the post is concerned. What this case shows is that the DPP is not fit to be in his office for allowing this case to go into a court of law when the evidence was not there, but for FTJ he allowed the case to go to court, partly prosecuted by Red Lips and then chicken out like a crocodile facing the wrath of some enraged Hippo, the two cases unfortunately can not be compared beyond this and once again questions the way the DPP operates.
