New gratuity law not for RB – Ronnie

CHIEF Government spokesperson Ronnie Shikapwasha has said the Presidential Emoluments Amendment Bill is not meant to benefit President Rupiah Banda as suggested by some sections of society, but to address a gap in the law to ensure that every person who serves as president receives their dues accordingly.

Lieutenant-General Shikapwasha said in Lusaka yesterday that the current law on presidential emoluments was unfair and against basic human rights.

Gen Shikapwasha, who is Information and Broadcasting Services minister, was reacting to Patriotic Front (PF) leader Michael Sata who has written a letter to President Banda demanding that he withdraws the Bill from Parliament.

“The Bill is not in anyway tailored to benefit President Banda. It covers anybody who will be president in future.

“The Bill is intended to address a lacuna in the law over a president who serves less than five years,” he said.

He said the current law did not allow a person who served as president for less than three years to get gratuity, which he said was unfair and against human rights.

Gen Shikapwasha said it was unfair for a person who had served in the office of president for three years or so not to get any gratuity, and that the Presidential Emolument Amendment Bill, currently before Parliament, was meant to address the anomaly.

He said the Government would not make laws targeted at individuals like what Mr Sata used to do when he was in government.
“For Mr Sata, he sees everything as a mater of personal benefit. Didn’t they tailor a law (on motor vehicle theft) which caught up with him?

“Mr Sata was locked up over a vehicle, and as Government we saw it was a bad law and it was removed,” he said.

Gen Shikapwasha said Mr Sata made bad laws when he was in government and he would do the same if he became Zambia’s president going by his advocacy for laws to recognise gays and lesbians.

    True, human rights are a complex (and much debated) concept, but according to UN Declaration on Human Rights at least, there are four basic freedoms to which all human beings are entitled. These are: freedom of speech, freedom of belief, freedom from want, and freedom from fear.

    Please don’t tell me Mr. Banda is “wanting” for a generous pension or “fears” he will have no place to live at the end of his term. To do so is nothing short of mocking humankind plain and simple.

  22. In some companies, there is a minimum period that must be served before one can be paid gratuity. They have done away with pro rata. I hope government would also extend this generosity to these companies. At least I know 2 that I have worked for that won’t pay gratuity if you rleave employement before the minimum period sepcified in the contract.

If this prposed bill is not for the purpose of benefitting RB, then why not make the law applicable only to the next president and future presidents?

Where have you seen a CEO of any organisation allowing changes to the conditions of his contract to his benefit? It’s highly immoral for Rupiah to allow his appointees to propose & pursue that bill.   74. Sorry General. Gratuity is NOT a salary. Gratuity is not an allowance. Gratuity has NOTHING TO DO WITH HUMAN RIGHTS. How many Civil Servants, Teachers, doctors, Nurses, etc get gratutity? Peeping into the future relative to the respective scenario here it is not difficuilty to see a very serious problem for this third world state when the number of its past presidents and judges, alive increase. I would have thought that it the plausible thing now would be determing a way of shading out some of the respective benefits with a view to enhance the country’s payload capacity.

  81. President Banda should get his gratuity on a prorata basis as others have earlier alluded. If we deny what is due to a person we force them to use illigitimate means to accrue wealth. However, us Zambians, we are understanding people and we will give him the gratuity no matter what the law says but they should not twist our generocity by changing the law to suite him.
